CM 1994-03-16 MINUTES OF MARCH 16, 1994 The City Council of the City of Coppell met in Special Called Session on Tuesday, March 16, 1994 at 6:00 p.m. in the City Council Chambers of Town Center, 255 Parkway Boulevard, Coppell, Texas. The following members were present: Tom Morton, Mayor Ron Robertson, Mayor Pro Tem ~ Peyton Weaver, Councilmember Danny L. Watson, Councilmember Mitch Reitman, Councilmember Lanny Mayo, Councilmember Jim Garrison, Councilmember Councilmember Flo Stahly was absent from the meeting. Also present were City Manager Jim Witt, Assistant City Secretary Linda Grau, and City Attorney Peter G. Smith. REGULAR SESSION (Open to the Public) 1. Call to Order Mayor Morton called the meeting to order. Councilmember Reitman filed a Conflict of Interest with the Assistant City Secretary Linda Grau and abstained from discussion or voting on the following items. 2. Report and recommendation from the Coppell Municipal Utility District No. 1 --.. Task Force. Councilmember Weaver addressed the Council and stated that the Council had been briefed by staff on this issue at the last City Council Meeting. He further stated that the financial options could be reviewed at a later date due to the District being funded through Fund Reserves through the year 1995. Consensus of the Council was to abolish the Coppell Municipal Utility District No. 1. 3. Discussion and consideration of approving an ordinance finding that the Coppell Municipal Utility District No. 1 is no longer needed, assuming property, assets, bond liabilities and other obligations of the Coppell Municipal Utility District No. 1, and agreeing to perform the services and other functions previously performed by the Coppell Municipal Utility District No. 1 and authorizing the Mayor to sign. Councilmember Weaver moved to approve Ordinance No. 94640 abolishing Coppell Municipal Utility District No. 1 finding that the Coppell Municipal Utility District No. 1 is no longer needed, and the services furnished and functions performed by the District can be furnished and performed by the City, and the abolition of the District is in the best interests of the residents _... and property in the City and the District, and to authorize the Mayor to sign the ordinance. Mayor Pro Tem Robertson seconded the motion. Motion carried 5-0 with Mayor Pro Tern Robertson and Councilmembers Weaver, Watson, Mayo and Garrison voting in favor of the motion. Councilmember Mitch Reitman filed a conflict of interest with Assistant City Secretary. Mayor Morton requested that the minutes reflect, if he had the opportunity to vote on the issue, it would have been an affirmative vote adopting the Ordinance. CM031694 Page 1 of 2 (;:;:;040 Councilmember Weaver stated that, as one of the missions of the Task Force, City Staff embarked on a mission to determine how various connections were made to the MUD line without being annexed into the MUD. City Manager Jim Witt addressed the Council concerning this matter and referred to several older documents. Mr. Witt informed the Council that his report would be reduced to written form and copied to the Council. Council held a discussion regarding the procedures as to several areas being serviced by the MUD. EXECUTIVE SESSION (Closed to the Public) 4. Convene Executive Session A. Texas Government Code, Section 551.074 Personnel Matters 1. Discussion of Public Officers Mayor Morton convened into Executive Session at 6:18 p.m. as allowed under the above-stated article. Mayor Morton adjourned the Executive Session at 6:39 p.m. and opened the Regular Session. REGULAR SESSION (Open to the Public) There being no further business to come before the City Council, the meeting was adjourned.
