OR 95-712 Adopt Uniform Fire Code & Standards, 1994 Edition AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 95712 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE CODE OF ORDINANCES BYAMENDING ARTICLE 15- 5 TO ADOPT THE UNIFORM FIRE CODE, 1994 EDITION, THE UNIFORM FIRE CODE STANDARDS, 1994 EDITION, AND THE NATIONAL FIRE PROTECTION ASSOCIATION STANDARD 14, 1986 EDITION, AS THE CITY OF COPPELL FIRE CODE; PROVIDING AMENDMENTS; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE, EXCEPT, HOWEVER, WHERE A DIFFERENT PENALTY HAS BEEN ESTABLISHED BY STATE LAW FOR SUCH OFFENSE, THE PENALTY SHALL BE THAT FIXED BY STATE LAW, AND FOR ANY OFFENSE WHICH IS A VIOLATION OF PROVISION OF LAW THAT GOVERNS FIRE SAFETY, ZONING, OR PUBLIC HEALTH AND SANITATION, INCLUDING DUMPING OF REFUSE, THE PENALTY SHALL BE A FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Code of Ordinances of the City of Coppell, Texas, be and the same is hereby amended by amending Chapter 15, Article 15-5 in part to adopt the Uniform Fire Code, 1994 Edition, (Volume 1) including Appendix, Chapters I-C, II-B, II-E, II-F, II-G, II-H, III-C, V, VI-A, VI-B, VI-D, and adding Appendix VII and VIII thereto, the Uniform Fire Code Standards, 1994 Edition (Volume 2), and the National Fire Protection Association Standard 14, 1986 Edition, with amendments to read as follows: i AGGO72AD "ARTICLE 15-5 FIRE CODE Sec. 15-5-1 FIRE CODE - ADOPTED There is hereby adopted the Uniform Fire Code, 1994 Edition (Volume 1) including Appendix X, Chapters I-C, II-B, II-E, II-F, II-G, II-H, III-C, V, VI- A, VI-B, VI-D, adding Appendix VII and VIII, the Uniform Fire Code Standards, 1994 Edition (Volume 2), and the National Fire Protection Association Standard 14, 1986 Edition, with amendments and made a part hereof for all purposes, the same as if fully copied in full herein, with the exception of such sections hereof, which are hereafter deleted, modified or amended. If any conflict exists between or among any of the Codes or Standards, adopted herein, the Code of Ordinances or any other ordinance of the City, the most restrictive Code, Standard, ordinance or regulation shall apply and the Fire Chief shall have the authority to resolve any such conflicts or disputes. Sec. 15-5-2 AMENDMENTS The following sections of the Uniform Fire Code, 1994 Edition (Volume 1), including Appendix, Chapters I-C, II-B, II-E, II-F, II-G, II-H, III-C, V, VI-A, VI-B, VI-D, the Uniform Fire Code Standards, 1994 Edition (Volume 2), and the National Fire Protection Association Standard 14, 1986 Edition, are hereby amended to read as follows: 1. Section 105.3 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 105.3 Application for Permit. Applications for permits shall be made to the bureau of fire prevention in such form and detail as prescribed by the bureau. Applications for permits shall be accompanied by such plans as required by the bureau." 2. Section 105.3.1 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 105.3.1 Fees. Permit Fees established by resolution of the City Council from time to time shall be paid to the City of Coppell." 3. Section 901.4.1 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 901.4.1 General. Marking of fire apparatus access roads, fire lanes, address, and fire protection equipment shall be in accordance with AGGOTZAD Section 901.4. For the purposes of this Code, the term "Fire Department Access Road" shall include private driveways and private roads." 4. Section 901.4.2 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 901.4.2 Fire apparatus access roads. When part of a private road, parking lot, driveway, or equivalent is selected as a fire lane by the Fire Chief, or his designated representative, it shall be marked along the perimeter with conspicuous markings in accordance with the specifications shown on Exhibit 15-1. The markings shall have the words "FIRE LANE - NO PARKING" PAINTED: 1. in four (4) inch high, white block letters; 2. at fifteen (15) foot intervals; 3. on a six (6) inch wide contrasting background stripe - red in color. The Fire Chief may also require signs to be posted along the perimeter of the fire lane. These signs shall be painted in accordance with Exhibit 15-2." 5. Section 901.4.3 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 901.4.3 Fire Protection equipment and fire hydrants. Fire Protection equipment and fire hydrants shall be clearly identified in a manner approved by the chief to prevent obstruction by parking and other obstructions. Fire hydrants shall be color coded according to the following: Fire hydrants installed in accordance with City standards, within easements and accepted by the city shall be painted yellow. ( Sherwin-Williams # B54Y37 or equal) Private hydrants or those hydrants supplied through or by a fire pump shall be painted red. (Sherwin-Williams # B54R38 or equal) All fire hydrant locations shall be identified by the installation of a blue reflective marker, according to City specifications." 6. Section 902.2.2.1 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 902.2.2.1 Dimensions. Fire apparatus access roads and fire lanes 3 AGGO72AD shall have an unobstructed width of not less than twenty four (24) feet, inside of stripe to inside of stripe, and an unobstructed vertical clearance of fourteen (14) feet. EXCEPTION: Vertical clearance may be reduced, provided such reduction does not impair access by fire apparatus and approved signs are installed and maintained indicating the established vertical clearance when approved by the Chief. Vertical clearances or widths shall be increased when, in the opinion of the Chief, vertical clearances or widths are not adequate to provide fire apparatus access." 7. Section 902.2.2.2 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 902.2.2.2 Surface. Fire apparatus access roads and fire lanes shall be designed and maintained to support a 40,000 pound apparatus on an all weather driving surface." 8. Section 902.2.2.3 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 902.2.2.3 Turning Radius. The turning radius of a fire apparatus access road and fire lanes shall have a minimum of 30 foot inside and 50 foot outside radius." See Exhibit 15-3. 9. Section 902.2.2.4 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 902.2.4 Dead ends. Dead-end fire apparatus access roads and fire lane in excess of 50 feet in length shall be provided with an approved provision for the turning around of fire apparatus." See Exhibit 15-4. 10. Section 902.2.2.6 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 902.2.2.6 Grade. Grade incline of fire apparatus access road and fire lanes shall not exceed 10%." 11. Section 902.2.2.6.1 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 902.2.2.6.1 Speed Reducers. When approved by the Fire Chief, 4 AGGO72AD speed reducers may be installed on fire department access roads and fire lanes. Speed reducers shall be of type and size approved by the Chief." 12. Section 902.2.2.7 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 902.2.2.7 Collapse Zone Exclusion. On Buildings where the Fire Chief determines that a building collapse potential is present, the Fire Chief may determine that the Fire Lane be so located that the building walls are distanced at least one and one-half times (1.5) the height of the building from the closest point of the Fire Lane." 13. Section 902.2.2.8 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 902.2.2.8 Controlled Access. When approved by the Fire Chief, a gate or barrier may be installed across a Fire Lane, provided that the gate or barrier has approved equipment or locks installed to allow fire apparatus access. Approved equipment may include approved keyed access or emitter controlled devices as required by the chief." 14. Section 902.4 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 902.4 Key Boxes. When access to or within a structure or an area is unduly difficult because of secured openings or where immediate access is necessary for life-safety or fire fighting purposes, the chief is authorized to require a key box to be installed in an accessible location. The key box shall be of a type approved by the chief and shall contain keys to gain necessary access as required by the chief. Multiple key boxes may also be required in locations where because of the size or arrangement of the building or structure, access to the building or area is required from multiple locations." 15. Section 903.2 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 903.2 Required Water Supply for Fire Protection. An approved water supply capable of supplying the required fire flow for fire protection shall be provided to all premises upon which facilities, buildings, or portions of buildings are hereafter constructed or moved into or within the jurisdiction. When any portion of the facility or buildings protected is in excess of 150 feet from a water supply on a public street, as measured by 5 AGGO72AD an approved route around the exterior of the facility or building, additional fire hydrants and mains capable of supplying the required fire flow shall be provided when required by the chief." 16. Section 1102.3.1 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 1102.3.1 General. Open burning shall be conducted in trenches with approved equipment and in accordance with Section 1102.3. Open burning shall also be conducted as required by other governing agencies regulating emission. Exception: Recreational fires shall be in accordance with Section 1102.4." 17. Class 1I standpipes need not be provided in basements having an automatic fire- extinguishing system throughout. 2 The standpipe systcm may be combined with the automatic sprinkler system. 6 AGG072AD 3 Portions of otherwise sprinklered buildings which are not protected by automatic sprinklers shall have Class II standpipes installed as required for the unsprinklered portions. 4 In open structures where Class II standpipes may be damaged by freezing, the building official may authorize the use of Class 1 standpipes which are located as required for Class n standpipes. 5 Hose is required for Class II standpipes only. 6 Clas8 n standpipes need not be provided in assembly areas used solely for worship. 7 For the purpose of this table, occupied roofs of parking structures shall be considered an additional story. In parking structures, a tier is a story. 18. Table 2501-A of the Uniform Fire Code, 1994 Edition, is amended to read as follows: "Table 2501-A -- MINIMUM WIDTH OF AISLE AND OTHER MEANS OF EGRESS IN ASSEMBLY OCCUPANCIES WITHOUT SMOKE PROTECTED ASSEMBLY SEATING. The correct formula for "CLEAR WIDTH PER SEAT SERVED IN INCHES" for stairs assuming unlimited number of seats is: (0.300 x A x B x O.L.). O.L. = Occupant load." 19. Section 7801.1.1.1 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 7801.1.1.1 Manufacturing. The manufacturing of fireworks is prohibited." 20. Section 7802.3 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 7802.3 Prohibition. The storage, use and handling of fireworks are prohibited. EXCEPTIONS: 1. The use of fireworks for display is allowed as set forth in Section 7802.4." 21. Section 8102.6.1 of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: "Section 8102.6.1 General. When smoke and heat removal are required by table 81-A, smoke and heat vents shall be provided in accordance with Section 8102.6. In buildings equipped with an ESFR Sprinkler System, curtain boards and draft stops may be eliminated with an approved smoke and heat removal 7 AGGO72AD system. This system must operate with the activation of any water flow alarm. The system shall have a manual override system in addition to the vent controls located in the protected area. A separate Fire Department access or key switch may be required at a remote location in the building. When activated by the water flow alarm, all other mechanical ventilation systems shall shut down." 22. Table 81-B of the Uniform Fire Code, 1994 Edition, shall be amended to read as follows: Table 81-B -- REQUIREMENTS FOR CURTAIN BOARDS AND SMOKE VENTING, Footnote 2.] 2 When curtain boards are provided in buildings equipped with early suppression-fast response sprinklers, the curtain boards shall be located only at the interface between early suppression-fast response sprinklers and other types of systems. 23. APPENDIX VII, and VIII are hereby added to the Uniform Fire Code, 1994 Edition, to read as follows: "Appendix VII - Automatic Sprinkler System Requirements. In addition to other sections of the 1994 Edition of the Uniform Fire Code, an approved automatic fire extinguishing system shall be installed in the occupancies and locations as set forth in this section. 1. All Buildings, 3 or more stories or, 35 feet in height, or greater than 5,000 square feet, Excluding Group R, Division 3, Except for Group R, Division 3, any building or structure three or more stories or greater than thirty-five (35) feet in height; or any structure with a gross square footage greater than five thousand (5,000) square feet shall be equipped with an automatic fire sprinkler system. Any Group R, Division 3 buildings with a gross square footage greater than ten thousand (10,000) square feet shall be equipped with an automatic fire sprinkler system. 2. Group R, Division i Occupancies. All Group R, Division 1 Occupancies shall be equipped with an approved, hydraulically designed automatic fire sprinkler system. Residential or quick response standard sprinklers shall be used in the dwelling units and guest room portions of the building. 3. Group R, Division 3 Occupancies. All Group R, Division 3 Occupancies which contain two or more separate dwelling units shall be equipped with an approved, hydraulically designed, automatic fire sprinkler system. Residential g AGGOTZAD or quick response standard sprinklers shall be used in the dwelling units. The system shall be designed according to NFPA standards, on all floors of the building. Two (2) complete sets of plans, shall be submitted to the Fire Marshal for review. Upon completion, the installer shall furnish the Office of the Fire Chief with a copy of "as built" plan for the system and a letter stating the name of the company installing the system, date of completion, a statement that the system has been installed to meet the requirements of the ordinance, and the notarized signature of the installer." Appendix VIII - Exit Travel Distance Requirement. "The maximum travel distance shall not exceed 150 feet, unless otherwise allowed by this section. The maximum travel distance may be increased in accordance with the following: 1. In a building equipped with and automatic sprinkler system throughout, the maximum travel distance may be 200 feet. 2. The maximum travel distance of 150 feet and the maximum travel distance of 200 feet allowed by Item 1 may be increased up to an additional 100 feet when this increase in travel distance occurs in the last portion of the travel distance and is entirely within a one-hour fire resistive corridor complying with Section 1005. 3. The maximum travel distance of 150 feet and the maximum travel distance of 200 feet allowed by item 1 may be increased up to an additional 200 feet in buildings meeting the requirements of this section. In no case shall the maximum travel distance exceed 400 feet. In addition to other requirements as set forth in the 1994 Edition of the Uniform Fire Code, Buildings meeting this Section must be equipped with: 1. an approved ESFR automatic fire sprinkler system throughout; and 2. a Class III Standpipe system throughout; and 3. an approved fire alarm system, meeting the requirements of NFPA 72; and 4. maximum travel distance to a manual fire alarm pull station of 200'; and 5. a mechanical heat and smoke ventilation system, including an automatic activation as well as manual override capability; and 9 AGGO72AD 6. emergency lighting and exit path markings; and 7. an ADA compatible Fire Alarm System. In addition to the building requirements listed above, the following requirements must be met: 1. emergency plans shall include the procedures for reporting and notifying, relocating and evacuating occupants; staff member duties during emergencies; floor plans identifying the locations of portable fire extinguisher, other manual fire-extinguishing equipment, manual fire alarm pull stations and fire alarm control panels; floor plans identifying the primary and secondary routes of evacuation for each room or portion of the occupancy; floor plans indicating the locations of interior areas of refuge; and site maps identifying the designated exterior assembly area for each evacuation route. 2. Review. Emergency plans shall be submitted to the fire department for review when required by the chief. 3. Maintenance. Emergency plans shall be reviewed and updated annually. Additional reviews and updates shall be provided whenever changes are made in the occupancy or physical arrangement of the building. Revised plans shall be submitted for review in accordance with Section 2. 4. Employee duties, Assignments and Training. When required by Section 3, all employees shall be assigned duties for emergencies and shall be trained in their duties in accordance with this section. Training shall include familiarization with assigned duties, evacuation routes, areas of refuge, exterior assembly areas and procedures for leading groups or assisting individuals to evacuate. Employees shall be trained to know the location and proper use of portable fire extinguisher. Employees shall be familiar with fire alarm signals, when alarms are provided, and emergency action required under potential emergency conditions. Employees shall receive training in the emergency plans and their duties as part of new employee orientation and at least annually thereafter. 5. Fire Drills. When required by the AppendLx, fire drills shall be 10 AGGO72AD conducted in accordance with Section 1. Fire drills shall be conducted in a manner that provides for execution of procedures set forth in the emergency plan. In addition, fire drills shall include a review of the emergency plan and execution of assigned duties. When fire drills are conducted, the orderly evacuation of the building shall receive priority over the speed of evacuation. 6. Drill participation. When fire drills are conducted, all persons who are subject to the fire drill requirements shall participate in the drill. 7. Drill times and conditions. Fire drills shall be conducted at varying times and under varying conditions to simulate conditions that could occur during a fire or other emergency. 8. Records. Records of fire drills shall be maintained on the premises for review by the fire department. Records shall include the date and time of each drill, the person conducting the drill and other information relative to the drill." 24. Chapter 8. Tests and Inspections. 8-15 of the National Fire Protection Association Standard 14, 1986 Edition, is amended to read as follows: "Chapter 8. Tests and Inspections. Before it is restored to service and before water is turned into it, a standpipe system which has been out of service for a period of longer than one (1) year shall be tested with air at a pressure not exceeding 25 psi to determine its tightness. The standpipe system shall also be hydrostatically tested at 50 psi above the normal pressure." Sec. 15-5-3 OFFICE OF FIRE MARSHAL A. The office of City fire marshal is hereby created. The fire marshal shall be appointed by the chief of the fire department. The fire marshal shall be properly qualified for the duties of the office. B ..... C ..... D ..... 11 AGGOTZAD E. Any witness who refuses to be sworn, or refuses to appear or testify, or disobeys any lawful order of the Fire Marshal, or fails or refuses to produce any book, paper, or document touching in any manner under examination, or who is guilty of any contemptuous conduct during any of the proceedings of the Fire Marshal in the matter such investigation or inquiry, after being summoned to give testimony in relation to any matter under investigation as aforesaid, shall be deemed guilty of a misdemeanor, and it shall be the duty of the fire marshal to cause all such offenders to be prosecuted. H .....provided, however, that said owner or occupant aggrieved by such order may within five (5) days appeal in writing to the Fire Chief, who shall investigate the cause of the complaint and unless by the Fire Chief's authority, the order is revoked, such order shall remain in force and be forthwith complied with by the owner or occupant. Any owner or occupant who fails to comply with such order shall be deemed guilty of a misdemeanor. I ..... J. (Reserved) Sec. 5-5-6 APPEALS BOARD SECTION 2. That all ordinances and provisions of the Code of Ordinances of the City of Coppell, Texas in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That should any word, phrase, paragraph, section or portion of this 12 AGGO72AD ordinance, or of the Code of Ordinances, as amended hereby, be held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance, or of the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 4. An offense committed before the effective date of this ordinance is governed by the prior law and the provisions of the Code of Ordinances, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 5. That any person, firm, or corporation violating any of the provisions of this ordinance or the Code of Ordinances as amended hereby, shall be guilty of a misdemeanor and upon conviction in the Municipal Court of the City of Coppell, Texas, shall be subject to a fine not to exceed the sum of Five Hundred Dollars ($500.00) for each offense, except where a different penalty has been established by State law for such offense, the penalty shall be that fixed by State law, and for any offense which is a violation of any provision of law that governs fire safety, zoning or public health and sanitation, including dumping of refuse, the penalty shall be a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and every day such offense is continued shall constitute a new and separate offense. SECTION 6. That this ordinance shall become effective immediately from and after 13 AGGO72AD its passage and the publication of the caption, as the law and charter in such cases provide.
