CM 1996-05-09 MINUTES OF MAY 9, 1996 The City Council of the City of Coppell met in Special Called Session on Thursday, May 9, 1996 at 6:00 p.m. in the City Council Chambers of Town Center, 255 Parkway Boulevard, Coppell, Texas. The following members were present: Ron Robertson, Mayor Pro Tem Norm Alexander, Councilmember Chuck Sturges, Councilmember Danny L. Watson, Councilmember Marsha Tunnell, Councilmember (late arrival) Lanny Mayo, Councilmember Candy Sheehan, Councilmember Mayor Morton was out of the country. Also present were City Manager Jim Witt and City Secretary Linda Grau. REGULAR SESSION (Open to the Public) 1. Call toorder. _~ Mayor Pro Tem Robertson called the meeting to order. Councilmember Tunnell arrived at this time. 2. Canvass returns of the May 4, 1996 Municipal Election and Half Cent Sales Tax Election, approval of an order declaring the results of said election and authorizing the Mayor to sign. City Secretary Linch Grau read the Canvass of Returns and Declaration of Results of Election into the record showing the following number of votes: Norman Alexander, Place 1 1109 votes Danny Watson, Place 3 1132 votes Lanny Mayo, Place 5 1089 votes Candy Sheehan, Place 7 1018 votes Byron Clayton, Place 7 394 votes The following were elected as Councilmembers to serve a two-year term: Place 1, Norman Alexander; Place 3, Danny Watson; Place 5, Lanny Mayo; and Place 7, Candy Sheehan. (The original of the above-named document is on file in the City Secretary Department.) Councilmember Tunnell moved to approve the Canvass of Returns and Declaration of Results of Election. Councilmember Sturges seconded the motion; the motion carried 7-0 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. 2A. Consider approval of an Ordinance declaring the results of the sales tax election and imposing a sales tax of one-half (1/2) of one percent (1%) pursuant to Section 4B of the Development Corporation Act of 1979, Article 5190.6, Texas Revised Civil Statutes. City Secretary Linda Grau read into the record the Ordinance Canvassing the Returns of an Election for the Adoption of an Additional Sales and Use Tax within the City at the Rate of One- Half of One Percent. There were 1655 total votes cast of which 891 votes were cast FOR the adoption of Proposition No. 1 and 764 votes were cast AGAINST the adoption of Proposition No. 1. Councilmember Mayo moved to approve Ordinance No. 96761 declaring the results of the sales tax election and imposing a sales tax of one-half (1/2) of one percent (1%) pursuant to Section 4B of the Development Corporation Act of 1979, Article 5190.6, Texas Revised Civil Statutes. Councilmember Sheehan seconded the motion; the motion carried 7-0 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. 3. PUBLIC HEARING (CONTINUED): Consider approval of the updated Comprehensive Master Plan for the City of Coppell. Mayor Pro Tem Robertson advised that the Public Hearing remained open from the April 23, 1996 City Council meeting. Gary Sieb, Director of Planning and Community Services, made a presentation to the Council regarding the Comprehensive Master Plan. Mr. Sieb reviewed some concerns which had been presented to Council by speakers at the previous Public Hearing dates. Joe Pobiner, Director of HOK, the Consultant on the project, addressed the Council. Mayor Pro Tem Robertson asked for those persons wishing to speak regarding this matter. Robert Reeves, 500 S. Ervay, Suite 426 A, Dallas, Texas, representing WHRB Real Estate Partnership, addressed the Council regarding tracts 30 and 31 and would like a Light Industrial zoning; Ike Scype, 1717 Main Street, Dallas, Texas, representing the owners of the Centex property, spoke to the Council regarding the levy district, road utility district and tax base on their property; Dennis Winzeler, 5059 Berkshire, representing Vista Properties, answered Council's questions regarding the RUD tax and his concerns, objections and requests regarding Vista's property; Jerry Ragsdale, 8440 Walnut Hill Lane, representing Republic Property Group, Page 2 of9 spoke concerning tract 33 and requested that it remain Light Industrial and asked that the floodplain designation be removed. At this time, a short recess was held. Mayor Pro Tem Robertson resumed the meeting and announced that one other person wished to speak. Don Moulton, 2727 Chemsearch Boulevard, Irving, representing NCH Properties spoke to Council concerning Area #9. Mayor Pro Tern Robertson advised that Council would consider each item separately. Area #1 -- Councilmember Tunnell inquired as to whether this freeway could support more commercial. Area //2 -- Gary Sieb, Director of Planning and Community Services, advised that he had received no verbal or written response to the proposed change in the land use plan. Area #3 -- Councilmember Tunnell inquired as to whether more commercial would be warranted at this intersection. Access was stated as a problem with having commercial at this site. Councilmember Sheehan requested that the retail nodes along Highway 121 be pointed out. Councilmember Watson asked about the industrial property abutting the lake and objected to having industrial in the residential area. MOTION -- Councilmember Mayo moved to accept Area #1 to change from Commercial for the Land Use Plan to Industrial use and Area #3 to change from a Highway Commercial to Industrial use. Councilmember Sturges seconded the motion; the motion carried 7-0 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. Mayor Pro Tem Robertson indicated a difference of opinion on Area#2 and asked for a motion. MOTION -- Councilmember Sturges moved to retain Area #2 as Multi-family-2 use. Councilmember Sheehan seconded the motion; the motion failed 3-4 with Mayor Pro Tem Robertson and Councilmembers Sturges, and Sheehan voting in favor of the motion and Councilmembers Alexander, Watson, Tunnell and Mayo voting against the motion. MOTION -- Councilmember Mayo moved to change Area #2 to the proposed land use classification as Industrial. Councilmember Alexander seconded the motion; the motion failed 3-4 with Councilmembers Alexander, Tunnell, and Mayo voting in favor of the motion and Mayor Pro Tem Robertson and Councilmembers Sturges, Watson and Sheehan voting against -- the motion. Council abandoned discussion on Area #2 to consider at a later time. __ Area#4 and Area#5 had no opposition from Council. Area#6 -- Councilmember Sturges raised questions regarding a possible land use to reflect residential. Councilmember Mayo brought up the issue of the airport noise in this area for residential use. City Manager Jim Witt brought up the fact that there are two commercial sites in close proximity. Area #7 -- Councilmember Tunnell questioned the Mixed Use classification and why it appears on this piece of property. Gary Sieb, Director of Planning and Community Services, explained the purpose of the Mixed Use category. MOTION -- Councilmember Mayo moved to change designation of Area #4 from Light Industrial use to Regional Retail; Area #5 from Commercial to Industrial use; and Area #6 from Light Industrial to Mixed Use. Councilmember Alexander seconded the motion; the motion carried 7-0 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. MOTION -- Councilmember Mayo moved to approve Area #7 as Light Industrial use. The motion was withdrawn to consider at a later time. Area #8 -- Councilmember Watson inquired as to why this piece was proposed for SF-7 versus SF-9 or SF-12 density. Discussion was held regarding the density of the residential area. Council agreed to make the designation as Single Family without a density requirement at this time. Area#9 brought no opposition from Council. MOTION -- Councilmember Mayo moved to change the land use on Area #8 from Single-family to Residential Medium Density which means a zoning classification approximating SF-12, SF-9 and SF-7; and Area#9 use would remain identical to the current LI zoning. Councilmember Sheehan seconded the motion; the motion carried 6-1 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Mayo, and Sheehan voting in favor of the motion and Councilmember Tunnell voting against the motion. Area #10 -- Councilmember Tunnell questioned whether this would eventually be a zoning classification or an overlay. Area #11, #12, #13 and #14 -- Councilmember Sheehan voiced concern over having Historic use designated on the land plan and asked to go over the written report. Mr. Pobiner defined Historic District and discussed the overlay. Councilmember Sturges asked that Area#12 retain the recommendation for low density single-family residential use even though the historical overlay had been removed. Councilmember Tunnell inquired as to the Light Industrial use in Area#12 and how the area for the historic overlay was decided. Mayor Pro Tern Robertson suggested pulling this item out until the historic issue could be resolved. Gary Sieb, Director of Planning and Community Services, stated that Council might want to reflect the land use as residential and take the historic overlay off so that the park is protected with the residential around it. MOTION -- Councilmember Alexander moved to retain the proposed land use on Area #10 and #11 with an Historic overlay. Councilmember Tunnell seconded the motion; the motion carried 6-1 with Mayor Pro Tern Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, and Mayo voting in favor of the motion and Councilmember Sheehan voting against the motion. Area #30 and 31 -- MOTION -- Councilmember Mayo moved to approve Area #30 and #31 for land use as it currently stands at LI zoning. Councilmember Watson seconded the motion; the motion carded 6-1 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Mayo, and Sheehan voting in favor of the motion and Councilmember Tunnell voting against the motion. Area #33 -- MOTION -- Councilmember Mayo moved to retain Area #33 as Light Industrial usage. Councilmember Alexander seconded the motion; the motion carded 6-1 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Mayo, and Sheehan voting in favor of the motion and Councilmember Tunnell voting against the motion. Area #25 -- Mayor Pro Tem Robertson advised that the developer would like to see a portion of the land use stay as is which is Highway Commercial or some type of Regional Retail. MOTION -- Councilmember Sheehan moved to approve Area#25 as Highway Commercial use. Councilmember Watson seconded the motion; the motion carried 7-0 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. (See below for reconsideration of this area.) Area#26 -- Dennis Winzeler, representing Vista Properties indicated he would like to see the Public/Institutional use portion of Area #26 changed to Medium Density Residential; the area designated as Regional Retail and Freeway Office changed to Mixed Use.. Councilmember Sheehan voiced concerns regarding schools and residential sites along the bypass. _ MOTION -- Councilmember Mayo moved to approve the part of Area #26 shaded in blue and red be changed to Mixed Use. Councilmember Alexander seconded the motion; the motion carried 6-1 with Mayor Pro Tern Robertson and Councilmembers Alexander, Sturges, Watson, Mayo, and Sheehan voting in favor of the motion and Councilmember Tunnell voting against the motion. Councilmember Mayo suggested that the Public/Institutional use area be changed to Medium Density Residential. Councilmember Watson also expressed concerns with having residential property along the bypass and stated he would like to see Area#26 as Regional Retail and Mixed Use and consider Area#25 as Multi-family use. Councilmember Sturges agreed with the concept proposed by Councilmember Mayo. MOTION -- Councilmember Alexander moved to change the Public/Institutional and Multi- family zoned portion of Area #26 to Single-Family Residential. Councilmember Mayo seconded the motion; the motion carried 4-3 with Mayor Pro Tern Robertson and Councilmembers Alexander, Sturges, and Mayo voting in favor of the motion and Councilmembers Watson, Tunnell and Sheehan voting against the motion. At this time the Council reconsidered Area#25. MOTION -- Councilmember Sturges moved to designate the yellow portion of Area #25 as Multi-family use. Councilmember Alexander seconded the motion; the motion carried 5-2 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Tunnell and Mayo voting in favor of the motion and Councilmembers Watson and Sheehan voting against the motion. Area#12 -- MOTION -- Councilmember Alexander moved to approve Area#12 as Light Industrial use. Councilmember Mayo seconded the motion; the motion failed 2-5 with Councilmembers Alexander and Mayo voting in favor of the motion and Mayor Pro Tem Robertson and Councilmembers Sturges, Watson, Tunnell and Sheehan voting against the motion. Area#12,#13 and#14 -- MOTION -- Councilmember Tunnell moved to change Area#12 Light Industrial to Historic use; Area #13 from Commercial to Historic use and Area #14 from PD-SF to Historic use. Councilmember Sheehan seconded the motion; the motion carried 7-0 with Mayor Pro Tern Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. ~e ~ ~9 A short recess was held at this time. Area #15, #16, #17, #18 and #19 -- MOTION -- Councilmember Mayo moved that Area #15 be designated an Historic use; Area #16 be Freeway Office use; Area #17 be Freeway Commercial use; Area #18 be Freeway Office use and Area #19 be Freeway Office use. Councilmember Sheehan seconded the motion; the motion carried 7-0 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sbeehan voting in favor of the motion. Area#20 and #21 -- MOTION -- Councilmember Tunnell moved to change Area #20 from Retail to Light Industrial use, and Area #21 from Commercial to Mixed Use. Councilmember Mayo seconded the motion; the motion carried 7-0 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. Area #22 -- MOTION -- Councilmember Watson moved to change Area #22 from Office to Mixed Use. Councilmember Sheehan seconded the motion; the motion carried 7-0 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. Area #23 -- Council discussed the possibility of residential on this tract. Councilmember Watson moved to change Area #23 from Commercial to Residential Medium Density use. Councilmember Sturges seconded the motion; the motion carded 6-1 with Mayor Pro Tern Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell and Sheehan voting in favor of the motion and Councilmember Mayo voting against the motion. Area#24 -- Mr. Pobiner, representing the Consultant, stated this was a small property with not enough area to do much of anything. MOTION -- Councilmember Watson moved to change Area#24 to Neighborhood Retail use. Councilmember Sheehan seconded the motion; the motion carded 7-0 with Mayor Pro Tern Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. Page 7 ~9 Area #27, #28 and #29 brought no opposition from Council. MOTION -- Councilmember Mayo moved to change Area#27 from Office to Institutional use; Area #28 from Single-family to Retail use and Area #29 from Single-family to Retail use. Councilmember Tunnell seconded the motion; the motion carried 7-0 with Mayor Pro Tern Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. Area #32, #34, #35 and #36 brought no opposition from Council. MOTION -- Councilmember Mayo moved to change Area #32 from Light Industrial/Agricultural use to Neighborhood Retail/Commercial use; Area #34 from Single-family to Retail use; Area #35 from Agricultural to Residential Medium Density use; and Area #36 from Agricultural to Residential Medium Density use. Councilmember Sheehan seconded the motion; the motion carried 7-0 with Mayor Pro Tern Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. Area #37 -- MOTION -- Councilmember Tunnell moved to change Area #37 from Retail to Residential Medium Density use. Councilmember Sheehan seconded the motion; the motion carried 7-0 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. Area #38 -- MOTION -- Councilmember Sturges moved to change Area #38 to show the Highway Commercial use remaining at Highway Commercial and the portion that is shown as Light Industrial south of the Denton County/Dallas County line be reflected on the land use map as Regional Retail and the remainder of the interior portion of that property be Residential Medium Density Single Family use. Councilmember Mayo seconded the motion; the motion carried 5-2 with Mayor Pro Tern Robertson and Councilmembers Alexander, Sturges, Tunnell and Mayo voting in favor of the motion and Councilmembers Watson and Sheehan voting against the motion. Area #7 -- Mr. Pobiner raised the further possibility that this land could be used for park land. MOTION -- Councilmember Alexander moved to change Area #7 from Light Industrial use to Residential Medium Density use. Councilmember Sturges seconded the motion; the motion carded 4-3 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, and Sheehan voting in favor of the motion and Councilmembers Watson, Tunnell and Mayo voting __ against the motion. Area #2 -- MOTION -- Councilmember Watson moved to change Area#2 from Multi-family to Residential Medium Density use. Councilmember Sheehan seconded the motion; the motion carded 7-0 with Mayor Pro Tern Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion. MOTION -- Councilmember Watson moved to close the Public Hearing and adopt the Land Use Plan as amended. Councilmember Alexander seconded the motion; the motion carried 7-0 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell, Mayo, and Sheehan voting in favor of the motion.
