OR 94-677 Regulating designated truck routes AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 94677 AN ORDINANCE FOR THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES BY AMENDING SECTIONS 8-4-3 AND 8-4-6 REGULATING TRUCK ROUTES; PROVIDING A REPEALING CAUSE; PROVING A SEVERABILITY CLAUSE; PROVIDING A PENkLTY NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00); AND DECLARING AN EFFECTIVE DATE. SECTION 1. That the Code of Ordinances of the City of Coppell, Texas be and the same is hereby amended in part by amending Section 8-4-3 and 8-4-6 to read as follows: "Sec. 8-4-3 TRUCKS PROHIBITED OFF TRUCK ROUTE; EXEMPTIONS A. No person may operate, leave, park, stand or permit to be operated or parked any commercial motor vehicle, truck tractor, semi-trailer, pole trailer, or trailer upon any street within the City except those streets designated as truck routes below: STREET EXTENT Beltline Road all portions within the City limits Denton Tap Road all portions within the City limits B. The provisions of this Section shall not apply: 1. to emergency vehicles operating in response to emergency call; 2. to vehicles operated by a public utility while in an assigned area for the purpose of inspecting facilities or providing maintenance services to such facilities; 3. to vehicles operated for public service i.e. garbage pickup, street repair and water service; 4. to a vehicle traveling to or from a location which is not on a designated truck route for the purpose of providing repair or maintenance service, loading or unloading goods, wears or merchandise, provided such vehicle is operated over the shortest practical route, and if the operator of such vehicle has in his or her immediate possession evidence of the local destination and point of origin. Any such vehicle shall not be permitted to proceed from a location off the truck route to another location without returning to a designated truck route. AGG~C Sec. 8-4-6 TRUCK ROUTE SIGNS The traffic engineer or designee shall erect appropriate signs and markings to designate the truck routes established herein." SECTION 2. That all provisions of the Code of Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That should any word, phrase, paragraph, section or portion of this ordinance or of the Code of Ordinances, as amended hereby, be held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or of the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 4. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction shall be punished by a penalty of fine not to exceed the sum of Five Hundred Dollars ($500.00) for each offense, and each and every day such offense is continued shall constitute a separate offense. SECTION 5. That this ordinance shall become effective from and after its passage and the publication of the caption as the law and charter in such cases provide.
