CM 1998-10-27 MINUTES OF OCTOBER 27, 1998 The City Council of the City of Coppell met in Regular Called Session on Tuesday, October 27, 1998, at 6:30 p.m. in the City Council Chambers of Town Center, 255 Parkway Boulevard, Coppell, Texas. The following members were present: candy Sheehan, Mayor Marsha Tunnell, Mayor Pro Tem Greg Garcia, Councilmember Pat Keenan, Councilmember Doug Stover, Councilmember Larry Wheeler, Councilmember Bill York, Councilmember (late arr/val) Also present were City Manager Jim Witt, City Secretary Kathleen Roach and City Attorney Peter G. Smith. REGULAR SESSION (Open to the Public) 1. Call to order. Mayor Sheehan called the meeting to order and adjourned into Executive Session. EXE, CUTIVE SESSION (Closed to the Public) 2. Convene Executive Session A. Section 551.071, Texas Government Code - Consultation with City Attorney. 1. Sowell, et al vs. City of Coppell, et al. B. Section 551.072, Texas Government Code - Deliberation regarding real property. 1. Land acquisition. Mayor Sheehan convened into Executive Session at 6:44 p.m. as allowed under the above-stated article. Mayor Sheehan adjourned the Executive Session at 6:57 p.m. and opened the Work Session. CM102798 Page 1 of 7 WORK SESSION (Open to the Public) ~- 3. Convene Work Session A. Discussion of Rules, Times, and Procedures for conducting City Council Meetings. B. Discussion of redesign of City logo. C. Discussion of Agenda Items. Councilmember York arrived at this time. REGULAR SESSION (Open to the Public) 4. Invocation. The Reverend Ron Taylor with Church of Jesus Christ of Latter Day Saints led those present in the invocation. 5. Pledge of Allegiance. Mayor Sheehan led those present in the Pledge of Allegiance. 6. Presentation to Gold Star recipients. City Manager Jim Witt and Mayor Sheehan presented gold stars to the city employees who were present. 7. Quarterly presentation to Council by the Keep Coppell Beautiful Committee. Richard Murphy, Chairman of the Keep Coppell Beautiful Committee, made a presentation to the Council outlining the goals of the committee. 8. Presentation on the Coppell Community Garden by Amanda Vanhoozier. Amanda Vanhoozier made a presentation to the Council and introduced the steering committee. Marietta Gale, Greg Dean and Cheri Maimy discussed their CM102795 Page 2 of 7 involvement with the Community Garden. Bunny Summerland /rom the Metrocrest Social Service Center discussed the impact of the donations of produce from the garden. Council commended Amanda and the gardeners for their success and contributions to the garden. 9. Citizen's Appearances. A. Arthur Kwast, 123 Sandy Oak Lane, addressed the Council regarding the work session item about rules and procedures for conducting Council meetings. B. Laura Swaldi, 1506 Pebblecreek Drive, spoke to Council concerning the future development of southeast Coppell. C. Jerry Baker, 215 Salem, appealed to Council to appoint him to the open position on the Plsnning & Zoning Commission. D. Mike Baird, 280 Enclaves Court, addressed the Council concerning the proposed ordinance regarding citizen items on Council meeting agendas. CONSENT AGENDA 10. Consider approval of the following items: Consider approval of minutes: October 13, 1998. B. Consider approval of a Resolution amending the Election Order for the Special City Officers' Election on November 3, 1998, and authorizing the Mayor to sign. C. Consider approval of canceling the second City Council meeting for the months of November and December, being November 24 and December 22. D. Consider approval of waiving the sign ordinance provisions as they might otherwise apply to the Coppell Trade Fair. -- E. Consider appointment of Marian Moseley as Municipal Judge and Terry Landwehr and Kim Nesbitt as Alternate CM102795 Page 8 of 7 Judges of the Coppell Municipal Court No. 1 pursuant to the provisions of Section 4.06(B) and Section 4.06(D) of the City of Coppell Home Rule Charter and City Ordinances for a term of two (2) years and authorizing the City Manager to negotiate contracts. F. Consider approval of the renewal of the Cigna Medical and Dental Care Insurance contract for the City employees for the period of November 1, 1998 through October 31, 1999, and authorizing the City Manager to sign. Item D -- Mayor Pro Tern Tunnell asked to have this item pulled for individual consideration. Items A, B, C, E and F -- Mayor Pro Tem Tunnell moved to approve Consent Agenda Items A, B carrying Resolution No. 102798.1, C, E and F. Couneilmember York seconded the motion; the motion carried 6-0 with Mayor Pro Tern Tunnell and Couneilmembers Garcia, Keenan, Stover, Wheeler and York voting in favor of the motion. Item D -- Mayor Pro Tem Tunnell asked for clarification of the nature of the waiver of the sign ordinance. City Manager Jim Witt addressed the issue. Mayor Pro Tem Tunnell moved to approve Consent Agenda Item D. Councilmember York seconded the motion; the motion carried 6-0 with Mayor Pro Tern Tunnell and Counc-ilmembers Garda, Keenan, Stover, Wheeler and York voting in favor of the motion. 11. A. Consider approval of accepting the resignation of Karen S. Turner from the Planning and Zoning Commission. B. Consider appointing a member to the Planning and Zoning Commission to fill the unexpired term of Karen S. Turner CM102798 Page 4 of 7 Mayor Pro Tern Tunnell moved to accept the resignation of Karen S. Turner from the Planning and Zoning Commission and appoint Greg McGahey to fill the unexpired term. Couneilmember Wheeler seconded the motion; the motion carried 5-1 with Mayor Pro Tern Tunnell and Councilmembers Garcia, Keenan, Stover, Wheeler snd York voting in favor of the motion. 12. Presentation by Ed Caldwell. Mayor Sheehan snnounced that this item was requested by Mr. Caldwell and asked Mr. Caldwell to respect the City staff and officials and make no personal attacks during his presentation. Mayor Sheehan advised that Mr. Caldwell would be given ten minutes to speak. Ed Caldwell, 601 Shadowcrest, made a presentation to the Council concerning his complsint of continuing problems with the Coppell Police Department. 13. Necessary action resulting from Executive Session. There was no action under this item. 14. City Manager's Report. There was no report under this item. 15. Mayor's Report. A. Mayor Sheehan announced the special cslled City Council Meeting on November 6th at 6:00 p.m. to canvass the election and urged everyone to vote on November 3rd. B. Mayor Sheehan advised that the City was taking applications to vacancies on the Keep Coppell Beautiful Committee and the Library Board. C. Mayor Sheehan reviewed the Open Records procedures and changes that have been made concerning requests of Attorney General's opinions and redaction of information that is not considered open records. D. Mayor Sheehan discussed the Denton Creek project and commended City Engineer Ken Griffin on this issue. CM102795 Page & of 7 E. Mayor Sheehan advised that the Trade Fair would be November 7th and ..... invited the public to attend. F. Mayor Sheehan announced that the IBM gr_a_nd opening and ribbon cutting would be held November 10th at 10:00 a.m. G. Mayor Sheehan stated the Barbara Bush Middle School ribbon cutting would be November 16th. H. Mayor Sheehan advised that the Substance Abuse Community Forum would be held at the Coppell Middle School West. I. Mayor Pro Tern Tunnell stated that the Coppell Police Department had received a 95% approval rating from Coppell citizens in the last Turco Survey. J. Councilmember York commended the Coppell Police Department for their outstanding service. K. Councilmember York congratulated the Gold Star recipients and expressed his appreciation for all their hard work. L. Councilmember York advised that an open house had been held at the Justice Center last week and it was very informative. M. Councilmember York stated IBM had already outgrown their new facility in the city. N. Councilmember York advised that councilmembers would be attending Texas Municipal League seminars later in the week. O. Councilmember York thanked the Coppell Jaycees and high school students for putting on an outstanding Homecoming Parade. P. Councilmember York congratulated the Coppell High School football team for their win at the Homecoming g_sme. Q. Counc. ilmember York announced that CMS East 8th grade football defeated CMS North. R. Coun~.ilmember York encouraged everyone to have a safe Halloween. S. Mayor Sheehsn expressed her support for the Coppell Police Department and .... the new chief. CM102798 Page 6 of 7 T. Couneilmember Garcia advised that the new Police Chief was moving toward tomorrow and urged everyone to give him a chance to make a difference. U. Couneilmember Stover announced that the City of Coppell had achieved the Certficate of Achievement of Excellence in Financial Reporting and he congratulated Jennifer Armstrong, Finance Director, and her staff for a job well done.
