RE 03-09-81 RESOLUTION NO. a /. ~. 9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, REQUESTING FINANCIAL ASSISTANCE FROM THE TEXAS WATER DEVELOPMENT BOARD, AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR FINANCIAL ASSIS- TANCE AND DESIGNATING AN OFFICIAL REPRESENTATIVE THE ST ATE OF TEXAS COUNTY OF DALLAS CITY OF COPPELL ~ ~ ~ WHEREAS, the City Council is empowered pursuant to Article 1015, Section 30, Vernon's Ann.Civ.St. to provide, or cause to be provided, the City with water; and WHEREAS, the City Council has determined and hereby does determine that in order to provide adequate water services to the inhabitants of the City, improvements and extensions to the City's waterworks system are necessary; and WHEREAS, the City of Coppell, Texas, is authorized to issue bonds to finance the cost of the said improvements and extensions pursuant to Vernon's Ann.Civ.St., Article 1111-1118, as amended and supplemented; and WHEREAS, the City Council has determined and hereby does determine that the City cannot reasonably finance the cost of said improvements and extensions without financial assistance from the Texas Water Development Board in the amount requested in its Application for Financial Assistance for Waterworks Improvements to the Texas Water Development Board; NOW, THEREFORE,' BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: 1. That each and everyone of the recitals, financings and deter- minations contained in the preamble of this resolution are hereby repeated and incorporated herein as due, proper, final and formal findings and determinations of this City Council. 2. That the City of Coppell, Texas (the "City"), hereby requests financial assistance from the Texas Water Development Board (the "Board"), in the amount of $1,200,000 through the purchase of the City's bonds issued for the purpose of extending, constructing, improving and repairing the City's waterworks system. 3. That the submission of the Application for Financial Assistance for Construction of Waterworks Improvements to the Texas Water Development Board be and hereby is authorized. 4. That the City Administrator be and hereby is directed to execute said application on behalf of the City and the City Administrator is hereby designated the official representative of the City for executing said application and appearing before the Board along with First Southwest Company, Financial Advisors to the City, Messrs. Hutchison Price Boyle & Brooks, Bond Counsel for the City, and Hogan & Rasor, Inc., Project Engineers. 5. That the City has determined that it cannot reasonably finance the. aforementioned extensions and improvements to its waterworks system without assistance from the Texas Water Development Board in the amount of $1,200,000. Whereupon,l among ot er usme s the ollowing was transacted at said Meeting: A Resolution Requesting Financial Assistance from the Texas Water Development Board, Authorizing the Submission of an Application for Financial Assistance, Designating an Official Representative The Resolution a full, true and correct copy of which is attached hereto, was read and reviewed by the City Council. Thereupon, it Wt1Jll:it, by Couneilmember ~ and seconded by Councilmember that the Resolution be passed. The Mayor put the motion to a vote of the members of the City Council and the Resolution was passed by the following vote: A YES: All members shown present above voted "Aye." NOES: None. The Mayor then declared the Resolution passed, and signed and approved the same in the presence of the City Council. ATTEST: Texas [SEAL] NOTICE OF INTENTION TO ISSUE GENERAL OBLIGATION CERTIFICATES OF OBLIGATION THE STATE OF TEXAS COUNTY OF DALLAS CITY OF COPPELL ) ) ) NOTICE is hereby given that on the 26th day of October, 1982, the City of Coppell, Texas, at a regular meeting of the City Council to be held at the Administration Building, 1201 Wrangler Drive in the City of Coppell, the regular meeting place of the City Council, intends to pass an ordinance authorizing the issuance of General Obligation Certificates of Obligation, for the purpose of purchasing land for a municipal services center for said City, and for the payment of the contractual obligations for professional services of attorneys and financial advisors in connection therewith. Said Certificates shall be issued in an amount not to exceed Five Hundred Thousand Dollars ($500,000); they shall bear interest at a rate not to exceed Fifteen Per Cent (15%) per annum, and shall have a maximum maturity date of not later than Forty (40) years after their date. Said Certificates shall be payable from the levy of a direct and continuing annual ad valorem tax against all taxable property within said City sufficient to pay the interest on this series of Certificates as due and to provide for the principal thereof as the same matures, as authorized by Article 2368a.l, V.A.T.C.S., as amended and supplemented.
