RE 09-27-77 I I I RESOLUTION AUTHORIZING THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS TO PURCHASE A HIGHSPEED LANDLINE COMMUNICATIONS TERMINAL AND SYSTEM IN BEHALF OF THE CITY OF COPPELL WHEREAS, highspeed telecommunications equipment in the city of Coppell is presently nonexistant or inadequate; and WHEREAS, the structure of the statewide highspeed teletype system has been determined and development of regional systems will continue on the basis of the statewide concept established by the Texas Criminal Justice Division, Office of the Governor, State of Texas; and WHEREAS, the Texas Criminal Justice Information Users Group in conjunction with the Texas Criminal Justice Division has submitted bidding specifications to prospective vendors, and after considering the bids, has determined the low compliant bidder; and WHEREAS, it is the opinion of this City Council that the best interest of the citizens of the City of Coppell will be served by partici- pating in this cooperative program; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL THAT: 1. The city of Coppell desires to participate in the highspeed teletype network expansion by acquiring a highspeed terminal and adjunct equipment. 2. The City of Coppell is eligible to participate in the High- speed Teletype Network Expansion by virtue of compliance with the Criminal Justice Divisionis established funding criteria, namely, that this agency has 24 hour, 7 days per week, dis- patching. 3. The North Central Texas Council of Governments is authorized to enter into binding contract with the low compliant vendor and to purchase telecommunications equipment in behalf of the 4. City of Coppell. This City understands that the Texas Criminal Justice Division is providing 85% funding and that the amount of $1, 546 is our matching share for the purchase of the equipment and the ad- ministrative cost of the project. This City understands and accepts the special conditions placed by the Texas Criminal Justice Division and the Law Enforcement Assistance Administration on the receipt of 6. government funds for telecommunications equipment. To indicate the City's desire to participate in this program, a copy of this resolution will be forwarded to the North Central Texas Council of Governments. 7. No other equipment owned by this agency is available for the project. 2. Grant funds will not be used to provide reimbursement for the purchase price of equipment already owned by this agency except through permis- sible depreciation or use allowance actually charged to this agency. 3. If equipment is used for purposes other than this project, the appro- priate proration of costs to each activity involved will be effected. 4. Allowability of the cost of equipment purchased with federal funds will be reduced to the extent of resale or recovery value where use of such equipment for carrying out the purposes of the grant project is dis- continued (during the life of the project) or use for law enforcement purposes is discontinued (after completion of the project) unless all credit relating to such contingencies as set forth in Section C3 of Circular A-87, "Applicable Credit", are applied to offset or reduce grant charges. Circular A-87 is reprinted in the Appendices section of the Texas Criminal Justice Division publication "Policies and proce- dures and Governing Action Grants." 5. In compliance with the requirement that federal funds made available under Part C, Title 1, Public Law 90-351, as amended, be used so as "not to supplant state or local funds", this is to certify that the below described recipient of federal funds under Part C, Title 1, Public Law 90-351, as amended, will use such funds to increase state or local funds that would, in the absence of such federal aid, be made available for law enforcement purposes. 6. This law enforcement agency agrees to participate in an intensive joint evaluation of radio, landline, and information systems in Texas. The evaluation will be under the direction of a State Agency. 7. This law enforcement agency agrees to participate in the DPS Uniform Crime Reporting Program and will comply with all of the Program's re- porting procedures. 8. This law enforcement agency agrees to comply with all federal and state legislation, regulations, guidelines, and procedures relating to the security and privacy, accuracy, completeness, and timeliness of crim- inal information. 9. This agency will continue the terminal maintenance after the first funded year of operation expires. 10. This agency will insure that new operators will be trained in terminal operating procedures before being assigned the duties of terminal operator. 11.
