ORDINANCE NO. 2007-1185
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, DESIGNATING
REINVESTMENT ZONE NO. 55 (CH REALTY IV/BETHEL, L.P.);
PROVIDING ELIGIBILITY OF THE ZONE FOR COMMERCIAL-
INDUSTRIAL TAX ABATEMENT; CONTAINING FINDINGS THAT THE
AREA QUALIFIES TO BE DESIGNATED AS A REINVESTMENT ZONE
AND THE IMPROVEMENTS SOUGHT ARE FEASIBLE AND
PRACTICABLE AND OF BENEFIT TO THE LAND AND THE CITY;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS
, the City Council of the City of Coppell, Texas, has caused notice to be
published in a newspaper having general circulation in the City and has delivered such notice to the
presiding officer of the governing body of each taxing unit that includes in its boundaries real
property described herein; and
WHEREAS
, the City Council of the City of Coppell, Texas, has conducted a public hearing
on the designation of the area described herein as a reinvestment zone;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COPPELL, DALLAS COUNTY, TEXAS THAT:
SECTION 1:
That the City Council of the City of Coppell, Texas finds that the area
described herein will, if designated as a reinvestment zone, be reasonably likely to contribute to the
retention or expansion of primary employment, or to attract major investment in the zone that will
be of benefit to the property and contribute to the economic development of the City. The City
Council further finds that the improvements sought are feasible and practicable and would be of
benefit to the land to be included in the zone and to the City after the expiration of a tax abatement
agreement.
SECTION 2.
That pursuant to the provisions of Section 312.201 of the Texas Tax Code,
the property described in Exhibit “A” attached hereto and made a part hereof for all purposes is
hereby designated as a reinvestment zone and for identification is assigned the name “Reinvestment
Zone No. 55 CH REALTY IV/BETHEL, L.P..).”

SECTION 3. That the property within Reinvestment Zone No. 55 IS eligible for
commercial-industrial tax abatement effective on January 1, 2008.
SECTION 4. If any article, paragraph or subdivision, clause or provision of this ordinance
shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this
ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or
unconstitutional.
SECTION 5. That all provisions of ordinances of the City of Coppell, Texas, in conflict
with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions
not in conflict with the provisions of this ordinance shall remain in full force and effect.
SECTION 6. This ordinance shall take effect immediately from and after its passage, as
the law and charter in such cases provide.

WHEREAS WALTER HOGG PARTNERS, a Texas General Partnership is the owner of
a tract ofland situated in the William K. Payne Survey, Abstract No. 1140, City of
Coppell, Dallas County, Texas, being described in deed to Walter Hogg Partners,
recorded in Volume 90085, Page 1687, Deed Records, Dallas County, Texas (DRDCT),
and being more particularly described as follows:
BEGINNING at a W' rebar with a yellow plastic cap stamped "Pacheco-Koch" found at
the northeast comer of said Walter Hogg Partners tract and the northwest comer of Lot 1,
Cici's Addition No. I, an addition to the City ofCoppell, Dallas County, Texas as
recorded in Volume 99124, Page 170, DRDCT, said point being a reentrant comer of
Freeport North, an addition to the City of Coppell, Dallas County, Texas as recorded in
Volume 84203, Page 1835, DRDCT and lying in the south line of Lot I, Block A of Lot
I, Lot 2, Lot 3, Block A, Freeport North (hereinafter referred to as Freeport North
Replat), an addition to the City ofCoppell, Dallas County, Texas as recorded in Volume
2000102, Page 4826, DRDCT;
THENCE South 0039'01" E, departing the south line of said Freeport North Replat,
along the east line of said Walter Hogg Partners tract and the west line of said Cici' s
addition, at a distance of 431.14 feet (Plat 431.29 feet) passing an angle point in the north
line of Bethel Road (adjoining R.O.W. per Volume 99124, Page 170, DRDCT), at a
distance of 432.14 feet passing a 5/8" rebar with a plastic cap stamped "Transystems
Corporation" found at the northeast comer of a permanent right of way to the City of
Coppell for Bethel Road (adjoining R.O.W. per Volume 2004224, Page 12423, DRDCT),
continuing a total distance of 463.59 feet (Walter Hogg Partners Deed 459.17 feet,
R.O.W. Deed 463.74 feet) to a W' rebar with yellow plastic cap stamped "Goodwin &
Marshall" set (hereinafter referred to as 1/" rebar capped set) at the southeast comer of
said Walter Hogg Partners tract and said City of Coppell permanent right of way;
THENCE S 8g44' 24" W, along the south line of said Walter Hogg Partners tract and
said City ofCoppell permanent right of way, a distance of 1095.68 feet (Walter Hogg

right of way, said point lying in the east line of a remainder portion of a tract ofland as

east line of a six (6) varas wide remainder portion of said J. T. Thweatt tract, at a distance
