The City Council has determined that there are stmclures within Old Town Coppell developed in the nineteen-thirties, nineteen-forties and nineteen-fifties, styled in single story wood frame homes and businesses that have historical significance; and in attempt to preserve this 'historically unique site of the original town, the City Council has deemed ~ area as historically significant and enacts this ordinance to preserve this unique area. SECTION 2. That the .Comprehensive Zoning Ordinance and Map of the City of Coppeil, Texas, duly passed by the governing body of the City of Coppelk Texas, as heretofore amend~ be and the same is hereby amended by amending Section 3 in part to read as follows: "SECrION 3 ZONING DISTRICTS ESTABI,I,~I~.D 3-1 The City of Coppel[, Texas, is hereby divided into twenty-three (23) zoning distr/cts. This district shnll be used for farming, rnnching, foresU% nM mining uses not haznrdous by reasons of odors, dust, fumes, noise or v~ttio~ single-family dwell~s; nnd is considered the proper classification for large areas of undeveloped land or newly annexed land in the City. SF-ED - Single-Fnmily Residential Estnte District. This district is intended to be con,.po~ed of single-fnmily detached dwellings on lots not less than one ncre (43,560 square feet) in nre~ SF-12 - Single-Family Residential District. This district is intended to be composed of single- family detached dwellings on lots not less than twelve thousand (12,000) squnre feet in area. SF-9 - Single-Fnm~y Residential District~ This district is intended to be composed of single- fam~ detached dwellings on lots not less than nine thousand (9,000) square feet in aren. SF-7 - Single-Family Residential District. This district is intended to be compo~l of single' family detnched dwellings on lots not less than seven thousand (7,000) square feet in nre~ 2F-9-Two-FamilyResidentialDistrict. This district provide~ a low. density dwelling classification in the form of two-family or duplex dwellings to facilitate individual ownership of each unit. 8S10331 TH-1 - Town House Residential District-1. This district is intended to be composed of singlo- family attached dwellings, provided that no more than six (6) units are attached, and that no dwelling unit is constructed above another unit. The minimum lot area is 3,000 square feet per dwelling unit. TH-2 - Town House Residential District-2. This district is intended to be composed of single- family attached dwellings, provided that no more than six (6) units are attached, and that no dwelling unit is constructed above another unit. The minimum lot area is 2,5000 square feet MF-1 - Multli-Family Residential District-1. This district is intended to be comprised of attached dwelling for more than two families. The maximum density is 16.units per acre. MF-2 - Multi-Family Residential District-2. This district is intended to be comprised of attached dwelling for more than two fiunilies. The maximum density is 22 units per acre. maintenance of a Manufactured Home Park, recreational building, swimming pool, private club, laundry and storage facih'ties for use of the residents of the manufactured'home park. O - Office District. This district is intended to be composed of professional and administrative offices and medical services activities and related supporting services. R- Retail District. This district provides for areas of convenience shopping and other residential service oriented businesses. HC - Highway Commercial District. This district is intended ~ as a high intensity area permitting a mixed~use for office, commercial-retail, and highway oriented uses, such as hotels, 4 8810331 restaumn~ and low and mid-rise offices, and should be located generally along high-volume thoroughfares. C - Commercial District. This district conc.~trates business, warehouse and service activities normally locating within retail service centers. TC - Town Center District. This district is intended to provide & mixture of res/dential and compatible non-res/denfial uses, creating a center of identity for the community. LI - Light Industrial District. This district permits those industries and manufacturing plants that are predominately fight in character, have their operations conducted wholl~, within buildings, are more compatible than heavy manufacturing uses, and do not emit noxious odors, noises, dust, smoke, and w'orations as do the heavy mamfacturing processes. HI - Heavy Industrial District~ This district provides for the location of enterprises that tend to emit odors, noises, dust and v~'orations and that are least compatible with other uses. PD - Planned Development District. This district provides flem'o'dity in planning and development through the combination of uses. Fl' - Flood Plain - Prefix. When added to any of the afore, listed ~ the prefix spedfies a sub-district subject to the provisions of Section 28. HO - Historic Overlay District. When added as a prefix to any of the dore, listed districts, the prefix specifies property within the mb-district subject to the provisions of Section 28A. SUP - Special Use Permit. When added as a prefix to any of the residential or non-residenti_'al zoning dassific, ations, this prefix specifies that a permit has been granted to allow a special use, provided certain conditions are met, as specified in the ordinance adopted by the City Council granting the Special Use Permit zoning dassi/icafion." That the Comprehensive Zoning Ordinance and Map of the City of Coppell, Texas, duly passed by the governing body ~f the City of CopPell, Texas, as heretofore amended, be, and the same are hereby amended in part by adding Section 28A to read as follows: "SECTION 2~A "HO" - I~I~TORIC OVERLAY DISTRICT General Purpose and Description: The I~stodc Overlay District '~HO" prefix is intended to provide special development standards compat~ole with the unique character of Old Town Coppell, as defined herein. 28A-1 Use Regulations: A building or premise shall be used only for the following purposes: 1. Any use permitted in the underlying zoning district dassitic~or~ 2. Asphalt pavement in lieu of concrete pavement when authorized by a special use permit granted under Section 30. 3. Wood or similar siding for up to one hundred percent of exterior construction when authorized by a special use permit under Section 30. 28A-2 Special Use Permit Conditions: In granting Special Use Permits, the City Council shall take into consideration the historic character of the overlay district, as follows: 1. SECTION 5. That all provisions of the Comprehensive Zoning Ordinance of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force SECTION 6. That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Comprehens/ve Zoning Ordinance as a whole. SECTION 7. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Comprehensive Zoning Ordinance, as amended, in eft'eot when the offense was committed and the former law is continued in effect for this purpose. SECTION 8. That any person, firm or corporation violating any of the provis/ons or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of Coppelk as heretofore amended, and upon conviction sl~ be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; ~ each and every day such violation shall continue shall be deemed to constitute a separate offense. SECTION 9.
