AN ORDINANCE OF THE CITY OF COPPELL, TEXAS CANVASSING THE
RETURNS AND DECLARING THE RESULT OF AN ELECTION ON THE
ADOPTION OF AN ADDITIONAL ONE-HALF OF ONE PERCENT SALES
AND USE TAX FOR THE COSTS OF FACILITIES SUITABLE FOR
PROJECTS AUTHORIZED BY SECTION 4B (a)(2)(A) OF VERNON'S
ANN.CIV.ST., ART. 5190.6. THE DEVELOPMENT CORPORATION ACT OF
1979: AND ESTABLISHING AN EFFECTIVE DATE.
BE IT REMEMBERED THAT on this the/~, --day of August, 1994. at a meeting of
the City Council of the City of CoppelL Texas, a quorum being present, the meeting was called
to order and the following business was transacted.
Upon motion of Councilmember cfiF~-%q,C~ ~ ~ ~ and seconded by
Councilmember f~ ~-~a ~ it ~as unanimously ordered that the City
Council consider the official returns of an election held in the City on the above mentioned date
on the question of the adoption of an additional one-half of one percent sales and use tax for the
costs of facilities suitable for projects authorized by Section 4b (a)(2)(A) of Vernon's
Ann. Civ. St., Art. 5190.6. the Development Corporation Act of 1979, as amended.
WHEREUPON said official returns were opened, examined, canvassed ~d the results
declared as follows:
CANVASS OF RETURNS AND DECLARATION OF RESULTS
WHEREAS, an election was held in the City of Coppell, Texas, on August 13, 1994, on
the question of the adoption of an additional one-half of one percent sales and use tax for the
costs of facilities suitable for projects authorized by Section 4b (a)(2)(A) of Vernon's
Ann. Civ. St.. Art. 5190.6, the Development Corporation Act of 1979: and
WHEREAS, immediately after said election the Presiding Judge and other officials
holding said election made their roturns of the results thereof to the City Council as follows. and
said roturns being made according to law, and duly authenticated, and it being shown that written
notice of said election was posted li>r the time and in the manner provided by law, and all other
proceedings pertaining to said election having been shown to have been done and performed at
and within the manner provided by law, and all papers pertaining thereto having been returned
and filed with the City Council and it appearing that said election was in all respects legally held
and that said returns were duly and legally made and that there were cast at said election 1447
votes of which number 675 votes were cast "FOR" the adoption of the additional one-half of one
percent sales and use tax, and 772 votes were cast "AGAINST" the adoption of the additional
one-half of one percent sales and use tax~ and said proposition having been disapproved by 97
votes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COPPELL, TEXAS:
SECTION 1. That after examining said returns and opening and canvassing the votes of
said election, that the result of said election is as follows:
The majority of the qualified voters having voted AGAINST "the adoption of an
additional one-half of one percent sales and use tax for the costs of facilities suitable for projects
authorized by Section 4b (a)(2)(A) of Vernon's Ann.Civ. St.. Art. 5190.6. the Development
Corporation Act of 1979, as amended. including parks, auditoriums. learning centers. open space
improvements. athletic. exposition facilities. joint projects with the local school district such as
a natatorium, and other related improvements as well as maintenance and operating costs of the
publicly owned and operated projects," the said tax is not imposed in said City.
SECTION 2. That this canvass and declaration of results of said election be entered in
the Minutes of the City Council.
SECTION 3. This ordinance shall take effect immediately upon its passage as provided
by the charter of this City and the laws of the State of Texas.
PASSED. APPROVED AND ADOPTED by the City Council of the City of Coppell,
