AND " C" (LIGHT INDUSTRIAL, SPECIAL USE PERMIT AND COMMERCIAL) TO · LI-S.U.P. AND C-S.U.P" (LIGHT INDUSTRIAL, SPECIAL USE PERMIT AND COMMERCIAL, SPECIAL USE PERMIT), FOR MINI-WAREHOUSE USE TO ALLOW THE EXPANSION OF THE EXSISTING SELF-STORAGE FACILITY, LOCATED ON PROPERTY ON THE EAST SIDE OF DENTON TAP ROAD, SOUTH OF THE ST. LOUIS & SOUTHWESTERN RAILROAD, COPPELL, DALLAS COUNTY, TEXAS, SAID PROPERTY BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO;. PROVIDING FOR SPECIAL CONDITIONS; PROVIDING FOR THE APPROVAL OF THE SITE PLAN AND LANDSCAPE PLAN ATTACHED HERETO AS EXHIBITS "B" AND "C" RESPECTIVELY; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABIIJTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. Wl]~.EAS, the City Planning and Zoning Commission and the governing body of the City of Coppell, Texas, in ~ with the laws of the State of Texas and pursuant to the Compreheradve Zcming Ordinance of the City of ~, have give~ requisite notices by publication and o~erwise, and after ~lmlding due hearings and affording a full and fair hearing and in the vicinity thereof, the said governing body is of the opinion that Zoning Case No. S- I 102 should be approved, ami in the exercise of legislative disomion have concluded that the Comprehensive Zoning Ordhumce and Map should be amended. NOW, TII~B~IrORE, BE iT ORDAINED BY THE CITY COUNCIL OF TUE CITY OF COPPELL, TEXAS: SF_L~ON 1. That the Comprehensive Zoohig Ordinance and Map of the City of Coppell, Texas, duly passed by the governing body of the City of Coppell, Texas, as l'~'etofore ameoded, be, and the same is hereby amended to grant a change in zoning from "LI-S.U.P. and C" (Light Industrial, Special Use Permit ami Commercial) to "LI-S.U.P. and C-S.U.P.~ (Light Industrial, Special Use Permit and Commercial, Special Use Permit) for mini-warehouse use to allow the expansion of the existing self-storage facih'ty, located on the east side of Denton Tap Road, south of the St. Louis & Sonthm~zrn Railroad, Coppell, Dallas County, Texas, and being more particularly described in Exhibit 'A' attached hereto and made a part hereof for all purposes. SECTION 2. That the above change in zoning for Special Use Permit for mini- warehouse uae to allow expansion of the existing meJf-~e facility is hereby granted subject to the following special conditions: (A) The building elevations and building materials shall be as shown on Exhibit 'B' with face brick of commercial ~rade no lighter than Boral 3205 Doeskin and no darla~r than Boral 3605 Red Brown, with the excep6on of acc~mt bands which (C) The pimic in~rts on the exi~ing attached signage shall be redesigned to coordinate with the color of eximting building materials and the building materials allowed herein with elimination of the reader board. The existing monument sign mhall be rede.reigned to eliminate backtit plastic and reader board. (D) The brick pavers shall be installed in the new driveway as shown on the attached Landscape Plan, Exhibit 'C', to align with the sidewalk. A sidewalk mb. SECTION 3. That the Site Plan, ~d La,Mkape Plan, aUacl~ hereto as Exhibits 'B' and 'C' respectively, and made a lXUt hereof for all purposes, be, and the same are hereby approved. SECTION 4. That the above ~ mhall be used only in the manner and for the purpose provided for by the Comprehensive Zoning Ordinance of the City of Coppell, SECTION $. That all provisions of the Comprehensive Zoning Ordinance of the City of C~, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealS, and all other provisions not in conflict with the provisions of this ordinance shall remain in fi~ force and effect. SECTION 6. That mhould any sentence, paragm~, subdivision, clause, phrase or section of ~ ordimmce be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of th_ia ordinance as a whole, or any pm or provision thereof validit~ of th~ Com~v~ 2c~ing Ordinance as a whole. SECTION 7. That an offense committed before the effective date of this ordinance is governed by the prior law and the provisions of the Comprehensive Zoning Ordinance, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 8. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of ~, as hereto mended, and upon conviction gall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and every day such violation shall continue shall be deemed to constitute a separate offense. SECTION 9. That this ordinance shall take effect immediately from and after its passage and the publicatio~ of its capti~, as the hw and charier in such cases provide.
