RE 10-26-99.2 A RESOLUTION OF THE CITY OF COPPELL, TEXAS RESOLUTION NO. 102699.2 A RESOLUTION OF THE CITY OF COPPELL, TEXAS, ADOPTING THE TEXAS GENERAL SERVICES COMMISSION GUIDELINES FOR ALLOWABLE FEES FOR INSPECTION AND COPYING OF INFORMATION PURSUANT TO THE TEXAS PUBLIC INFORMATION ACT AS SET FORTH IN EXHIBIT "A"; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Coppell is a home nde municipality in the State of Texas; and WHEREAS, the City Council of the City of Coppell desires to, in all respects, comply with the requirements of the Texas Public Information Act; and WHEREAS, the City Council of the City of Coppell desires to, in all respects, comply with Section 552.001, et seq. of the Texas Government Code; and WHEREAS, according to Subchapter F, Section 552.261, et seq., of the Texas Government Code establishes the cost of inspection, retrieval and copying of public information; and WHEREAS, the Texas General Services Commission (GSC) has been statutorily delegated the duty to adopt roles for use by municipalities to charge for such services; and WHEREAS, the City Council of the City of Coppell, Texas, previously adopted Resolution No. 010996.3 to provide for general and special fees and charges to be assessed and · collected by the City, as authorized by the Code of Ordinances and other applicable codes, ord'mances, resolutions, and laws; and WHEREAS, the City Council of the City of Coppe11 desires to amend certain fees as set forth therein and to add others as authorized by law; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That Resoliation No. 010996.3 of the City of Coppell, Texas, be, and the same is hereby, amended in part, to adopt the current guidelines set forth by the Texas General Services Commission to establish fees for inspection and copying of information pursuant to the Public Information Act, Subchapter F, Section 552.261, et seq., of the Texas Government Code, to read as follows: "Public Information Fees The following is a summary of the charges for copies of public information that have been adopted by the City: Services Rendered Charge 1. Standard paper copy $0.10 per pg. 2. Nonstandard-size copy: (a) Diskette $1.00 each (b) Magnetic tape: (i) 4 mm $13.50 each (ii) 8 mm $12.00 each (iii) 9-track $11.00 each (c) Data cartridge: (i) 2000 Series $17.50 each (ii) 3000 Series $20.00 each (iii) 6000 Series $25.00 each (iv) 9000 Series $35.00 each (v) 600A $20.00 each (d) Tape cartridge: (i) 250 MB $38.00 each (ii) 525 MB $45.00 each (e) VI-IS video cassette $2.50 each (f) Audio cassette $1.00 each (g) Oversized paper copy $0.50 each (h) Mylar (36-in.,42-in.,48-in.) No Sales Tax shall be applied to copies of public information. 14. As allowed by the Public Information Act, the officer for public information or the officer's agent may require a deposit or bond for payment of anticipated costs relative to creating access to and/or providing copies of public information, if the charge for providing the copy of the public information specifically requested by the requestor of One Hundred Dollars ($100). 15. The officer for public information or the officer's agent may not require a deposit or bond be paid as a down payment for copies of public information that requestor may request in the future. 16. The charge for providing a copy made by a municipal court clerk shall be the charge as provided by other ordinances governing Court of Record. 17. If any cost of inspection, processing, creating access to, or copying is not covered by this Resolution, then the public information officer shall promptly seek the opinion of the GSC in determining the appropriate fee." SECTION 2. That nothing in this Resolution is intended to be, nor should it be construed as, a waiver of any other provisions of the Texas Public Information Act or any other law, and the City expressly reserves any and all fights and remedies available to it under the Texas Public Information Act or otherwise at law. SECTION 3. That all provisions of the resolutions of the City of Coppell, Texas, in conflict with the provisions of this Resolution, except as noted herein, be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this Resolution shall remain in full force and effect. SECTION 4. That should any word, phrase, paragraph, or section of this Resolution be held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this Resolution as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Resolution as a whole. SECTION 5. That this Resolution shall take effect immediately from and after its passage as the law and charter in such cases provide. 4 DULY PASSED by the City Council of the City of Coppell, Texas, this the of~ 1999.
