OR 94-657 Prohibits 1.5-ton trucks to stop, park or stand within non-residential area AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 94657 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES TO ADD SECTION 8-3-6, TRUCK PARKING, TO MAKE IT UNLAWFUL FOR ANY PERSON TO STOP, PARK, OR STAND ANY TRUCK-TRACTOR, ROAD TRACTOR, SEMI-TRAILER, BUS, TRAILER, OR TRUCK WITH A RATED CAPACITY IN EXCESS OF ONE AND ONE-HALF TONS ACCORDING TO THE MANUFACTURER'S CLASSIFICATION, LIPON ANY STREET OR ALLEY WITHIN ANY NON-RESIDENTIAL AREA OF THE CITY FOR A PERIOD LONGER THAN FOUR (4) HOURS; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1: That the Code of Ordinances of the City of Coppell, Texas, be, and the same is hereby, amended by amending Chapter 8, in part, to add Section 8-3-6, Truck Parking, to read as follows: "SEC. 8-3-6 TRUCK PARKING A. A person commits an offense if he stops, parks, or stands a truck-tractor, road tractor, semi-trailer, bus, trailer, or truck with a rated capacity in excess of one and one-haft tons, according to the manufacturer's classification, upon any street or alley within any non-residential area of the City for a period longer than four (4) hours. B. A person commits an offense if he leaves standing or parked an unattended truck-tractor, road tractor, semi-trailer, bus, trailer, or truck with a rated capacity in excess of one and one-half tons according to the manufacturer's classification, or any other private property upon any public street, alley or other public place within any non-residential area of the City." SECTION 2: That all provisions of the Code of Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3: That should any word, phrase, paragraph, section or portion of this ordinance or of the Code of Ordinances, as amended hereby, be held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or of the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 4. That any person, firm or corporation violating any of the provisions or terms of this ordinance or of the Code of Ordinances, as amended hereby, shall be guilty of a misdemeanor and upon conviction in the Municipal Court of the City of Coppell, Texas, shall be subject to a fine not to exceed the sum of Two Hundred Dollars ($200.00) Dollars for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 5: That this ordinance shall become effective from and after its passage and the publication of the caption, as the law and charter in such cases provide.
