OR 91-500-A-052 Zoning change to Single Family at south side of Parkway Bld, & 3/4 mile east of Denton Tap Rd AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 91500A52 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND MAP OF THE CITY OF COPPELL, TEXAS, AS HERETOFORE AMENDED, BY GRANTING A CHANGE IN ZONING FROM "MF-2" (MULTI-FAMILY) TO "SF-7" (SINGLE FAMILY) ON A 8.15 ACRE TRACT OF LAND LOCATED ALONG THE SOUTH SIDE OF PARKWAY BOULEVARD, APPROXIMATELY THREE-FOURTHS MILE EAST OF DENTON TAP ROAD, AND BEING MORE PARTIC~Y DESCRIBED IN EXHIBIT "A" ATTACHED HERETO; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Planning and Zoning Commission and the governing body of the City of Coppell, Texas, in compliance with thc laws of the State of Texas and pursuant to the Comprehensive Zoning Ordinance of the City of Coppell, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, and to all persons interested and situated in the affected area and in the vicinity thereof, the said governing body is of the opinion that Zoning Case No. ZC-558 (CH) should be approved, and in the exercise of legislative discretion have concluded that the Comprehensive Zoning Ordinance should be amended. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1: That the Comprehensive Zoning Ordinance and Map of the City of Coppell, Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be and the same is hereby amended to grant a change in zoning from "MF-2" (Multi-Family) to "SF-7" (Single Family) on a 8.15 acre tract of land located along the south side of Parkway Boulevard, three-fourths mile east of Denton Tap Road, and being more particularly described in Exhibit "A" attached hereto and made a part hereof for all purposes. SECTION 2. That the above property shall be used only in the manner and for the purpose provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and as amended herein. SECTION 3. REPEALING CLAUSE That all provisions of the Comprehensive Zoning Ordinance of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 4. SEVERABILITY CLAUSE That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. PENALTY CLAUSE That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and every day such violation shall continue shall be deemed to constitute 2 a separate offense. SECTION 6. SAVINGS CLAUSE An offense committed before the effective date of this ordinance is governed by the prior law and the provisions of the Comprehensive Zoning Ordinance, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 7. EFFECTIVE DATE That this ordinance shall take effect immediately from and after its passage and the publication of its caption, as the law and charter in such cases provide. SMITH, CITY ATTORNEY 3 BEING part of a tract of land known as TRACT 3 in the CLARINDA SQUIRES SURVEY, ABSTRACT NO. 1327 as recorded in Volume 88103, Page 2339 of the Deed Records of Dallas County, Texas and being more particularly described by metes and bounds as follows: BEGINNING at a point in the South right-of-way of Parkway Boulevard as described in said TRACT 3, said point being the Northeast corner of the PARKS OF COPPELL, SECTION ONE, as recorded in Volume 93093, Page 1531; THENCE northeasterly along a curve of the South right-of-way of Parkway Boulevard, said curve having a central angle of 14' 05' 00", a radius of 2156.00 feet, a chord bearing of North 82' 11' 49.5" East, a chord distance of 528.62 feet, and an arc length of 529.95 feet to a point for comer common to the Northeast comer of said TRACT 3 and the Northwest corner of PARKVIEW ADDITION as recorded in Volume 88081, Page 1944; THENCE following the common line between said TRACT 3 and PARKVIEW ADDITION, South 00° 56' 25" East, a distance of 646.78 feet passing through the Southwest comer of PARKVIEW ADDITION and leaving the boundary of TRACT 3, continuing a distance of 50.00 feet, for a total distance of 696.78 feet to a point common to the aforementioned TRACT 3 and the North line of PECAN HOLLOW as recorded in Volume 90139, Page 2914; THENCE along the North line of PECAN HOLLOW, South 89 ° 03' 35" West, a distance of 525.42 feet to a point common to the boundary of TRACT 3, the North line of PECAN HOLLOW, and the Southeast corner of the aforementioned PARKS OF COPPELL, SECTION ONE; THENCE along the easterly line of the PARKS OF COPPELL, SECTION ONE, North 00° 52' 32" West, a distance of 633.65 feet to the POINT OF BEGINNING and containing 8.15 acres of land, more or less.
