ORDINANCE NO. 94652
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ANNEXING
TO THE CITY OF COPPELL, TEXAS, A 3.79 ACRE TRACT OF LAND
LOCATED ALONG THE NORTH SIDE OF EAST BELTLINE ROAD IN
CLOSE PROXIMITY OF THE EXISTING EASTERN CITY LIMIT LINE,
AND BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"
ATTACHED HERETO, AND EXTENDING THE BOUNDARY LINES OF
SAID CITY SO AS TO INCLUDE THE SAID HEREINAFrER DESCRIBED
PROPERTY WITHIN THE CITY LIMITS; GRANTING TO ALL THE
INHABITANTS AND OWNERS OF PROPERTY ALL THE RIGHTS AND
PRIVILEGES OF OTHER CITIZENS AND BINDING INHABITANTS BY
ALL THE ACTS, ORDINANCES AND REGULATIONS OF SAID CITY;
APPROVING A SERVICE PLAN FOR SUCH TERRITORY; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Coppell, Texas, finds that the hereinafter
described territory is contiguous and adjacent to the corporate limits of the City of Coppell;

WHEREAS, after development and presentation of a service plan for the territory
attached hereto as Exhibit "B", and after holding due hearings required under the provisions
of the Local Government Code of the State of Texas; and
WHEREAS, after notice was duly given, public hearings on the proposed annexation
were held by the City Council all in compliance with V.T.C.A., Local Government Code,
Chapter 43; and
WHEREAS, the City Council has concluded that such area should be annexed into
and made a part of the City of Coppell, Texas; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION 1. That a 3.79 acre tract of land along the north side of Beltline
Road and in close proximity to the existing eastern City Limit line, and being more
particularly described in Exhibit "A" attached hereto and made a part hereof for all
purposes, be and the same is hereby, annexed to the City of Coppell, Texas, and the
boundary limits of the City of Coppell be, and the same are hereby extended to include said
territory within the city limits of the City of Coppell, and the same shall hereafter be
included within the territory limits, and the inhabitants thereof shall hereafter be entitled
to all the rights and privileges of other citizens of the City of Coppell, and shall be bound
by the acts, ordinances, resolutions and regulations of said City.
SECTION 2. That it is not the intention of the City to Coppell to annex any
territory not legally subject to being annexed by the said City, and should any portion of the
territory described in the attached Exhibit "A" not be subject to legal annexation by the City
of Coppell, such fact will not prevent the City from annexing such territory as described in
said Exhibit "A" which is subject to legal annexation by the City, and it is the intention of
the City of Coppell to annex only such territory as may be legally annexed by it within the
limits of the territory described in Exhibit "A".
SECTION 3. That the service plan for the territory being annexed is attached
hereto and marked as Exhibit "B" and is made a part hereof for all purposes.
SECTION 4. That this ordinance shall take effect immediately from and after
its passage as the law and charter in such cases provide.

Being the remainder of a tract of land situated in the City of CoppelI, Dallas County, Texas,
out of the SINGLETON THOMPSON SURVEY, ABSTRACT 1493, as recorded in Volume
79215, Page 1350 and being more particularly described by metes and bounds as follows:
COMMENCING at a steel rod in the North line of a 16.48 acre tract as described in the
aforementioned Volume 79215, Page 1350, being South 80' 38' West, a distance of 612.30
feet from the Northeast comer of said SINGLETON THOiVlPSON SURVEY, ABSTRACT
1493, said point being also the Northwest corner of a 4.50 acre tract of land out of said
Volume 79215, Page 1350 as recorded in Volume 83139, Page 3247;
THENCE North 89' 38' East along the North line of said 16.48 acre tract, a disace of
358.82 feet to the POINT OF BEGINNING;
THENCE along the East line of said 4.50 acre tract, South, a distance of 641.01 feet to a
point for corner common to the Southeast corner of said 4.50 acre tract of land, the southerly
line of the tract of land as recorded in Volume 79215, Page 1350, and the North right-of-
way line of the St. Louis and Southwestern Railroad;
THENCE following the North right-of-way line of said rallroad, South 85 ° 50' East, a
distance of 254.20 feet to a point for comer in the East line of the SINGLETON
THOMPSON SURVEY, ABSTRACT 1493,
THENCE with the East line of said Thompson Survey, North, a distance of 662.00 feet to a
point for comer, said point being common to the Northeast comer of said SINGLETON
THOMPSON SURVEY, ABSTRACT 1493, the Northwest comer of the J.M. KENNEDY
SURVEY, ABSTRACT 741 and the Southwest comer of the P. WITr SURVEY,
ABSTRACT 1566;
THENCE along the North line of the aforementioned 16.48 acre tract, South 89' 28' West, a
distance of 253.53 feet to the POINT OF BEGINNING and containing 3.793 acres of land,
more or less.

SERVICE PLAN FOR PROPOSED ANNEXED AREAS
Municipal Services to the areas described above shall be furnished by or on behalf
of the City of Coppell, Texas, at the following levels and in accordance with the following
schedule:
A. Police Services
(1) Patrolling, responses to calls, and other routine police services, within
the limits of existing personnel and equipment, will be provided beginning on the
effective date of annexation.
B. Fire Services
(1) Fire protection by the present personnel and the present equipment
of the Fire Department, within the limitations of available water and distances from
existing fire stations, will be provided to this area beginning on the effective date
of the Annexation Ordinance.
C. Environmental Health and Sanitation and Code Enforcement Services
(1) Enforcement of the City's environmental health and sanitation
ordinances and regulations, including but not limited to weed and brush
ordinances, junked and abandoned vehicle ordinances, food service ordinances
and animal control ordinances, shall be provided within this area on the effective
date of the Annexation Ordinance. These ordinances and regulations will be
enforced through the use of existing personnel.
Complaints of ordinance or regulation violations within this area will be
answered and investigated by existing personnel beginning with the effective date
of the Annexation Ordinance.
(2) The City's building, plumbing, electrical, sign, heating and air
conditioning and all other construction codes will be enforced within this area
beginning with the effective date of the Annexation Ordinance. Existing personnel
will be used to provide these services.

(3) The City's zoning, subdivision, and other ordinances shall be
enforced in this area beginning on the effective date of the Annexation Ordinance.
(4) All inspection services furnished by the City, but not mentioned
above, will be provided to this area beginning on the effective date of the
Annexation Ordinance.
(5) As development and construction commence within this area,
sufficient personnel will be provided to furnish this area the same level of
environmental health and sanitation and code enforcement services as are
furnished throughout the City.
D. Planning and Zoning Services
(1) The planning and zoning jurisdiction of the City will extend to this
area on the effective date of the Annexation Ordinance. City planning will
thereafter encompass this property, and it shall be entitled to consideration for
zoning in accordance with the City's Comprehensive Zoning Ordinance and
Comprehensive Plan.
E. Recreation and Leisure Services
(1) Residents of this property may utilize all existing recreational and
leisure services facilities and sites throughout the City, beginning with the effective
date of this Ordinance.
(2) Additional facilities and sites to serve this property and its residents
will be acquired, developed and maintained at locations and times provided by
applicable plans, policies and programs and decisions of the City of Coppell. This
property will be included in all plans for providing recreation and leisure services
to the City. The same level of recreation and leisure services shall be furnished on
this property as is furnished throughout the City.
(3) Existing parks, playgrounds, swimming pools, and other recreation
and leisure facilities within this property shall, upon dedication to and acceptance
by the City, be maintained and operated by the City.
F. Solid Waste Collection
(1) Solid waste collection shall be provided to the property in accordance
with existing City policies, beginning with the effective date of the Annexation
Ordinance.

G. Streets
(1) The City's existing policies with regard to street maintenance,
applicable throughout the entire City, shall apply to this property beginning with the
effective date of the Annexation Ordinance.
(2) As development, improvement or construction of streets to City
standards commences within this property, the policies of the City of Coppell with
regard to participation in the costs thereof, acceptance upon completion, and
maintenance after completion, shall apply.
(3) The same level of maintenance shall be provided to streets within this
property which have been accepted as public streets as is provided to City streets
throughout the City.
(4) Street lighting installed on streets improved to City standards shall be
maintained by Texas Utilities in accordance with current City policies. Other street
lighting shall not be maintained by the City.
H. Water and Sanitary Sewer Services
(1) Connection to existing City water and sanitary sewer mains for water
and sewer service for domestic, commercial, and industrial use within this property
will be provided in accordance with existing city policies. Upon connection to
existing mains, water and sewer services will be provided at rates established by
City ordinances for such services throughout the City.
(2) As development and construction of subdivisions commence within
this property, water and sanitary sewer mains of the City will be extended by the
developer in accordance with provisions of the Subdivision Ordinance, Water and
Sewer Ordinance, and other applicable ordinances and regulations. City
participation in the costs of these extensions shall be in accordance with applicable
City ordinances and regulations. Such extensions will be commenced within two
years from the effective date of the Annexation Ordinance, or upon
commencement of development of a subdivision within the property, whichever
occurs later, and substantially completed within four and one-half years after that
date.
J. Miscellaneous
(1) Any facility or building located within the annexed areas and utilized
by the City of Coppell in providing services to the area will be maintained by the
City commencing upon the date of use or the effective date of the Annexation
Ordinance, whichever occurs later.

(2) General municipal administration and administrative services of the
City shall be available to the annexed area beginning with the effective date of the
Annexation Ordinance.
