OR 94-651 Annexes 1.06 acre strip west side of Denton Tap AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 94651 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ANNEXING TO THE CITY OF COPPELL, TEXAS, A 1.06 ACRE STRIP OF LAND LOCATED ALONG THE WEST SIDE OF DENTON TAP ROAD AND GENERALLY NORTH OF HIGHLAND ROAD (IN LEWISVILLE), AND BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATYACHED HERETO, AND EXTENDING THE BOUNDARY LINES OF SMD CITY SO AS TO INCLUDE THE SAID HEREINAFrER DESCRIBED PROPERTY WITHIN THE CITY LIMITS; GRANTING TO ALL THE INHABITANTS AND OWNERS OF PROPERTY ALL THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING INHABITANTS BY ALL THE ACTS, ORDINANCES AND REGULATIONS OF SAID CITY; APPROVING A SERVICE PLAN FOR SUCH TERRITORY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Coppell has made certain boundary adjustmems with the City of Lewisville in order to provide for certain right-of-way improvements, and WHEREAS, the City of Coppell has determined that the making of certain boundary adjustments would protect the public health, safety and general welfare of its inhabitants; and WHEREAS, after development and presentation of a service plan for the territory herein described, and after holding due hearings required under the provisions of the Local Government Code of the State of Texas; and WHEREAS, the City of Coppell, Texas finds that the hereinafier described territory is contiguous and adjacent to the corporate limits of the City of Coppell; and WHEREAS, the City Council has concluded that such area should be annexed imo and made a part of the City of Coppell, Texas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That a 1.06 acre strip of land along the west side of Demon Tap Road and generally north of Highland Road (in Lewisville), and being more particularly described in Exhibit "A" attached hereto and made a part hereof for all purposes, be and the same is hereby, annexed to the City of Coppell, Texas, and the boundary limits of the City of Coppell be, and the same are hereby extended to include said territory within the city limits of the City of Coppell, and the same shall hereafter be included within the territory limits, and the inhabitants thereof shall hereafter be entitled to all the rights and privileges of other citizens of the City of Coppell, and shall be bound by the acts, ordinances, resolutions and regulations of said City. SECTION 2. That it is not the intention of the City to Coppell to annex any territory not legally subject to being annexed by the said City, and should any portion of the territory described in the attached Exhibit "A" not be subject to legal annexation by the City of Coppell, such fact will not prevent the City from annexing such territory as described in said Exhibit "A" which is subject to legal annexation by the City, and it is the intention of the City of Coppell to annex only such territory as may be legally annexed by it within the limits of the territory described in Exhibit "A". SECTION 3. That the service plan for the territory being annexed is attached hereto and marked as Exhibit "B" and is made a part hereof for all purposes. SECTION 4. That this ordinance shall take effect immediately from and after its passage as the law and charter in such cases provide. Thompson Survey Abstract No. 1274; THENCE S 00029'40" W, a distance of 1,535.5i' along the "common boundary line" to a point for corner; THENCE N 89o30'20" E, a distance of 33.0' to a point for corner~ said point being 11.5' west of the centerline of Denton Tap Road; THENCE N 00o15'23" E, 853.17' to a point for corner; said line being parallel and I1.5' west of the centerline of Denton Tap Road; THENCE N 00o26'40" E, 682.33' to a point for corner; said line being parallel and 11.5' west of the centerline of Denton Tap Road; THENCE N 89°33'20'' W, 28.5' to the point of beginning and containing 46,279 square feet or 1.0624 acres of land, more or less (said tract also being shown on Exhibit 'A', attached). ~HIBIT EXHIBIT "A" CITY OF COPPELL, DALLAS AND DENTON COUNTIES, TEXAS SERVICE PLAN FOR PROPOSEO ANNEXED AREAS Municipal Services to the areas described above shall be furnished by or on behalf of the City of Coppell, Texas, at the following levels and in accordance with the following schedule: A. Police Services (1) Patrolling, responses to calls, and other routine police services, within the limits of existing personnel and equipment, will be provided beginning on the effective date of annexation. B. Fire Services (1) Fire protection by the present personnel and the present equipment of the Fire Department, within the limitations of available water and distances from existing fire stations, will be provided to this area beginning on the effective date of the Annexation Ordinance. C. EnvirOnmental Health and Sanitation and Code Enforcement Services (1) Enforcement of the City's environmental health and sanitation ordinances and regulations, including but not limited to weed and brush ordinances, junked and abandoned vehicle ordinances, food service ordinances and animal control ordinances, shall be provided within this area on the effective date of the Annexation Ordinance. These ordinances and regulations will be enforced through the use of existing personnel. Complaints of ordinance or regulation violations within this area will be answered and investigated by existing personnel beginning with the effective date of the Annexation Ordinance. (2) The City's building, plumbing, electrical, sign, heating and air conditioning and all other construction codes will be enforced within this area beginning with the effective date of the Annexation Ordinance. Existing personnel will be used to provide these services. EXHIBIT AGGO4482 ~E~ "' (3) The City's zoning, subdivision, and other ordinances shall be enforced in this area beginning on the effective date of the Annexation Ordinance. (4) All inspection services furnished by the City, but not mentioned above, will be provided to this area beginning on the effective date of the Annexation Ordinance. (5) As development and construction commence within this area, sufficient personnel will be provided to furnish this area the same level of environmental health and sanitation and code enforcement services as are furnished throughout the City. D. Planning and Zoninc] Services (1) The planning and zoning jurisdiction of the City will extend to this area on the effective date of the Annexation Ordinance. City planning will thereafter encompass this property, and it shall be entitled to consideration for zoning in accordance with the City's Comprehensive Zoning Ordinance and Comprehensive Plan. E. Recreation and Leisure Services (1) Residents of this property may utilize all existing recreational and leisure services facilities and sites throughout the City, beginning with the effective date of this Ordinance. (2) Additional facilities and sites to serve this property and its residents will be acquired, developed and maintained at locations and times provided by applicable plans, policies and programs and decisions of the City of Coppell. This property will be included in all plans for providing recreation and leisure services to the City. The same level of recreation and leisure services shall be furnished on this property as is furnished throughout the City. (3) Existing parks, playgrounds, swimming pools, and other recreation and leisure facilities within this property shall, upon dedication to and acceptance by the City, be maintained and operated by the City. F. Solid Waste Collection (1) Solid waste collection shall be provided to the property in accordance with existing City policies, beginning with the effective date of the Annexation Ordinance. AGG04482 G. Streets (1) The City's existing policies with regard to street maintenance, applicable throughout the entire City, shall apply to this property beginning with the effective date of the Annexation Ordinance. (2) As development, improvement or construction of streets to City standards commences within this property, the policies of the City of Coppell with regard to pa~icipation in the costs thereof, acceptance upon completion, and maintenance after completion, shall apply. (3) The same level of maintenance shall be provided to streets within this property which have been accepted as public streets as is provided to City streets throughout the City. (4) Street lighting installed on streets improved to City standards shall be maintained by Texas Utilities in accordance with current City policies. Other street lighting shall not be maintained by the City. H. Water and Sanitary Sewer Services (1) Connection to existing City water and sanitary sewer mains for water and sewer service for domestic, commercial, and industrial use within this property will be provided in accordance with existing city policies. Upon connection to existing mains, water and sewer services will be provided at rates established by City ordinances for such services throughout the City. (2) As development and construction of subdivisions commence within this property, water and sanitary sewer mains of the City will be extended by the developer in accordance with provisions of the Subdivision Ordinance, Water and Sewer Ordinance, and other applicable ordinances and regulations. City participation in the costs of these extensions shall be in accordance with applicable City ordinances and regulations. Such extensions will be commenced within two years from the effective date of the Annexation Ordinance, or upon commencement of development of a subdivision within the propert'y, whichever occurs later, and substantially completed within four and one-half years after that date. J. Miscellaneous (1) Any facility or building located within the annexed areas and utilized by the City of Coppell in providing services to the area will be maintained by the City commencing upon the date of use or the effective date of the Annexation Ordinance, whichever occurs later.
