AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 91500A87 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND MAP OF THE CITY OF COPPELL, TEXAS, AS HERETOFORE AMENDED, BY GRANTING A CHANGE IN ZONING FROM "R" (RETAIL) AND TH-2 (TOWN HOUSE 2) TO "SF 7" (SINGLE FAMILY 7) ON A 16.208 ACRE TRACT OF LAND LOCATED AT THE NORTHEAST INTERSECTION OF THWEAT AND COPPELL ROADS, COPPELL, DALLAS COUNTY, TEXAS, AND BEING MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Planning and Zoning Commission and the governing body of the City of Coppell, Texas, in compliance with the laws of the State of Texas and pursuant to the Comprehensive Zoning Ordinance of the City of Coppell, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, and to all persons interested and situated in the affected area and in the vicinity thereof, the said governing body is of the opinion that Zoning Application No. ZC-563 (CH) should be approved, and in the exercise of legislative discretion have concluded that the Comprehensive Zoning Ordinance and Map should be amended. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of Coppell, Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be and the same is hereby amended to grant a change in zoning from "R" (Retail) and "TH-2 (Town House 2) to "SF 7" (Single Family 7) on a 16.208 acre tract of land located at the northeastern intersection of Thweat and Coppell Roads, Coppell, Dallas County, Texas, and being more particularly described in Exhibit "A" attached hereto and made a part hereof for all purposes. AGG069DC SECTION 2. That the above property shall be used only in the manner and for the purpose provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and as amended herein. SECTION 3. That all provisions of the Comprehensive Zoning Ordinance of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 4. That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Comprehensive Zoning Ordinance,as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 6. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and every day such violation shall continue shall be deemed to constitute a separate offense. Holland Survey, Abstract No. 624, Dallas County, Texas, and being a portion of the tract of land conveyed to Jim Sowell Construction Co., Inc., a Texas Corporation, according to the deed recorded in Volume 91252, page 6746 of the Deed Records of Dallas County, Texas. Said 16.208 acres of land being more particularly described by metes and bounds, as follows: BEGINNING at an "X" cut in a concrete gutter at the intersection of the south right-of-way line of Minyard Lane (a 60 foot right-of-way dedicated by the plat recorded in Volume 85237, Page 5014 of the Deed Records of Dallas County, Texas, and the existing East right-of-way line of Coppell Road (a 50 foot right-of-way); THENCE along the South right-of-way line of said Minyard Lane, as follows: 1. S 89° 54' 57" E 39.85 feet to a 1/2" iron rod set at the beginning of a curve to the Left; 2. NORTHEASTERLY 18.74 feet along said curve to the Left, having a radius of 258.00 feet, a central angle of 04° 09' 45" and a chord bearing N 88° 00' 09" E 18.74 feet to a 1/2" iron rod at the end of said curve and the beginning of a curve to the Right; 3. NORTHEASTERLY 36.33 feet along said curve to the Right, having a radius of 500.00 feet, a central angle of 04° 09' 46" and a chord beating N 88° 00' 09" E 36.32 feet to a 1/2" iron rod at the end of said curve; 4. S 89© 54' 57" E 195.17 feet to a 1/2" iron rod found in the Northwest corner of the plat of VILLAGE AT COTTONWOOD CREEK, Section Ill, recorded in Volume 86028, Page 5833 of the Deed Records of Dallas County, Texas.
