OR 94-647 Revising daily water use during May 15 to September 15 of each year AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 94647 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 3, SECTION 3-1-12 (E) OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL; REVISING THE DAILY WATER USE PLAN; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That Chapter 3, Section 3-1-12 (E) of the Code of Ordinances of the City of Coppell, Texas, is hereby amended in part by revising Subsection E to read as follows: E. DAILY WATER USE PLAN 1. All persons using water for lawn watering, garden watering, or irrigation during the period of May 15 to September 15 of each year shall do so in the following manner. a) All water customers with street addresses that begin with 1, 5, 7, 8, and 9 must conduct all lawn watering, garden watering, or irrigation on Sundays, Tuesdays, and Fridays. b) All water customers with street addresses that begin with 2, 3, 4, and 6 must conduct lawn watering, garden watering, or irrigation on Mondays, Thursdays, and Saturdays. c) All irrigation of the center medians of streets or street rights-of-way, maintained by a homeowner's association, that are south of Sandy Lake Road, must be conducted on Sundays, Tuesdays, and Fridays. No watering will be allowed on Wednesdays. d) All irrigation of the center medians of streets or street rights-of-way, maintained by a homeowner's association, that are north of Sandy Lake Road must be conducted on Mondays, Thursdays, and Saturdays. No watering will be allowed on Wednesdays. e) Nursery (garden and landscape) businesses are not restricted when watering business inventory; however, they must comply with garden watering or irrigation for the landscaping associated with the building. f) Variances shall be granted to persons establishing new lawns or landscaping. All variances must be submitted in writing. A variance may be revoked by the Director of Public Works if the terms of the agreement are violated. g) Water customers tied to the Coppell water supply not within the City limits shall conform to the same watering requirements of this ordinance. SECTION 2. All ordinances or parts of ordinances inconsistent with or in conflict with the provision of this ordinance are hereby repealed. SECTION 3. If any article, paragraph, or subdivision, clause, or provision of this ordinance shall be adjudged invalid or held unconstitutional, it shall not effect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 4. Any person, firm, or corporation violating any of the provisions of this ordinance or of the Code of Ordinances, as amended herein, shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished by a penalty of fine not to exceed the sum of Five Hundred Dollars ($500.00) for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 5. This ordinance shall take effect immediately from and after the publication of its caption, as the law and charter in such cases provide.
