RESOLUTION NO. 2009-0811.3
A RESOLUTION; AUTHORIZING THE CITY MANAGER TO PREP ARE A POLICY
FOR CITY FACILITY RENTAL AND USE, UPON CERTAIN CONDITIONS IN
CONFORMITY WITH THIS RESOLUTION; SAID POLICY SHALL ESTABLISH
REQUIREMENTS FOR FEES FOR RENTALS OF CERTAIN FACILITIES,
ACCEPT ABLE USES, SECURITY MEASURES, CITY AND RENTER
RESPONSIBILITIES, AND RULES REGARDING THE SERVICE AND
CONSUPTION OF ALCOHOLIC BEVERAGES; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Coppell ("City") is the owner of several facilities that are
desirable for usage and rental by various organizations and individuals in the community;
WHEREAS, the City Council finds that it is in the public interest to place
restrictions and allowances to guide the rental of these facilities;
WHEREAS, the City Council finds that there is a benefit to certain organizations
in the community to be able to offer alcohol at function for which they may rent a city
facility; and
WHEREAS, the city has recommended guidelines from which a policy will be
formulated that are included in this resolution; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF COPPELL HEREBY RESOLVES:
SECTION 1. The City Manager is authorized to prepare a FACILITY
RESERVATION POLICY, which includes the following stipulations:
1. City facilities will be available for rental for social, civic, educational,
cultural, recreational or charitable purposes;
2. City shall charge a reasonable fee for each rental space, dependant upon the
size of space and length of rental;
3. Damage deposits will be required as stipulated based on the use of the facility;
4. No city facility shall be used for money-raising activities, unless renter
receives specific written approval by the city;
5. City reserves the right to determine the requirement for security personnel;
renter shall be responsible for obtaining required security;
SECTION 2. The POLICY shall allow the service and consumption of alcoholic
beverages at city facilities given the following restrictions:
1. The renter shall be responsible to obtain any license and permit for selling
alcoholic beverages as required by appropriate state agency;
2. Only TABC certified individuals shall be allowed to distribute alcoholic
beverages;
3. Only TABC certified individuals shall be allowed to bring alcohol to, or take
alcohol away from a city facility; all alcohol shall be accounted for;
4. Alcohol shall not be served during normal facility operating hours;
5. Alcohol shall only be served from an open, formal bar or a designated bar
area;
6. The renter shall provide general comprehensive liability insurance from a
responsible carrier, with the City as an additional insured, in the amount of
$1,000,000.00;
7. The renter agrees to indemnify the City of Coppell against any liability
incident to the distribution of alcoholic beverages at the city facility.
SECTION 3. The City Manager or his designee is authorized to approve
RESERVATION APPLICATIONS based on the resulting policies in conformity with
this resolution.
SECTION 4. This resolution shall become effective immediately upon its
passage and approval.
