ORDINANCE NO. 297A82
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF COPPELL, TEXAS, AS
HERETOFORE AMENDED, TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED
PROPERTY TO THE NEW ZONING CLASSIFICATION HEREIN STATED; PROVIDING A
REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES
FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF ONE THOUSAND
DOLLARS ($1,000.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Zoning Commission and the Governing Body of the City of
Coppell, Texas, in compliance with the laws of the State of Texas with reference to
the granting of zoning changes under the zoning ordinance and zoning map, have given
requisite notices by publication and otherwise, and after holding due hearings and
affording a full and fair hearing to all property owners generally, the said Governing
Body is of the opinion that said change of zoning, which is on application of Rick
Shelton, No. PD-112, should be granted and the Comprehensive Zoning Ordinance of the
City of Coppell should be amended in the exercise of its legislative discretion.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance of the City of Coppell,
Texas, be and the same is hereby amended by amending the Zoning Map of the City
of Coppell, to give the hereinafter described property a new zoning district classification,
to-wit:
"PI)-SF-0" Planned Development District Classification governed by the
Development Plan attached hereto as Exhibit 1 and the Use Restrictions attached
hereto as Exhibit 2.
Said property being described as follows:
BEING a tract of land containing 8.8937 acres, more or less, at the
southwest corner of Parkway Boulevard and Mac Arthur Boulevard, City
of Coppell, Dallas County, Texas, and described by meetes and bounds in
Exhibit 3 attached hereto and made a part hereof.
SECTION 2. That all parts of ordinances of the City in conflict with the
provisions of this ordinance be, and the same are hereby, repealed and all other
ordinances of the City not in conflict with the provisions of this ordinance shah remain
in full force and effect.
SECTION 3. That the above described property shall be used only in the manner
and for the purposes provided for in the Comprehensive Zoning Ordinance of the City,
as amended herein by the granting of this zoning classification.
SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or
section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid,
the same shall not affect the validity of this ordinance as a whole or any part or
provision thereof other than the part so decided to be invalid, illegal or unconstitutional
and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole.
SECTION 5. That any person, firm or corporation violating any of the provisions
or terms of this ordinance shah be subject to the same penalty as provided for in the
Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction
shall be punished by fine not to exceed the sum of One Thousand Dollars ($1,000.00)
for each offense, and that each day such violation shall continue to exist shall constitute
a separate offense.
SECTION 6. It is necessary to give the property described herein the above
mentioned zoning classification in order to permit its proper development and in order
to protect the public interest, comfort and general welfare of the City. Therefore,
this ordinance shall take effect immediately from and after its passage and publication
of its caption, as the law in such eases provides.

USE RESTRICTIONS
SINGLE FAMILY RESIDENTIAL
Use Regulations: A building or premise shall be used only for
the following purposes:
1, Detached single family structures
2. Common open space, as approved on the final plat, homeowners
association rules and by-laws, shall be approved'by the City
Planning Commission and City Council.
5. Such uses as may be permitted under the provisions of
Specific Use Permits. Section 29.6.
Height Regulations: No building shall exceed thirty-five (35)
feet or two and one-half stories in height.
Area Regulations:
1. Size of Yards
(a) Front Yard: There shall be a front yard having a depth
of not less than fifteen (15) feet; however, a twenty
(20) foot building line shall be observed for the
structure or portion of a structure accommodating the
required off-street parking spaces when the structure
'or portion of a structure faces onto and has vehicular
access from a dedicated street.
(b) Side Yard: A minimum side yard of five (5) feet is
required, and a minimum of ten (10) feet separation is
required between structures.
A side yard adjacent to a street shall not be less than
fifteen (15) feet. No side yard for allowable non-
residential uses shall be less than twenty-five (25)
feet.
Any required off-street parking space within a side
yard area on a corner lot shall observe a twenty (20)
foot side building line.

(c) Rear Yard: There shall be a rear yard, a depth of not
less than five (5) feet; however, a twenty (20) foot
rear building line shall be observed for the structure,
or portion of a structure, accommodating the required
off-street parking spaces, when the structure or
portion of a structure faces onto and has vehicular
access from a dedicated or private alley.
2. Size of Lot
(a) Lot Area: No structure shall be constructed on any
lot less than four thousand five hundred (4500) square
feet.
(b) Lot Width: The width of the lot shall be not less than
ten (10) feet at the building line with an average
width of sixty (60) feet.
(¢) Lot Depth: The depth of a lot shall not be less than
seventy .(70) feet at any point.
3. Minimum Dwelling size: The minimum floor area of any
dwelling unit shall be fourteen hundred (1400) square feet
exclusive of garage, breezeways, and porches.
4. Lot Coverage: In no case shall more than seventy (70%) per
cent of the total lot area be covered by the combined area
of main buildings and accessory buildings.
Parking Regulations - Two enclosed off-street parking spaces
shall be provided behind the front building line for each unit in
accordance with the requirements in Section 30.
Type of Exterior Construction: At least eighty (80%) per cent of
the exterior walls of the first floor of all structures shall be
of masonry construction exclusive of doors, windows, and the area
above the top plate line. Each story above the first floor of a
straight wall structure shall be at least eighty (80%) per cent
masonry exclusive of doors, windows and the area above the top
plate line. Stucco type construction is permitted only by a
specific use permit.
Being a 8.8937 Acre tract of land situated in the B.B,B. & C.R.R. Survey, Abstrac~
No. 199, City of Coppell, Dallas County, Texas, being all of a tract of land conveyed
by Special Warranty Deed to Graton Corporation, Richard G. Hanon, Trustee, as
recorded in Volume 86056, Page 3488, Deed Records, Dallas County, Texas and being
more particularly described as follows:
BEGINNING at an "x" cut fcr corner at the intersection of the west right-of-way line
of MacArthur Boulevard, a dedicated right-of-way (100' width) as recorded in Volume
85210, Page 0635, Deed Records, Dallas County, Texas, said corner being on a circular
curve to the right having a central angle of 08°48'13'' and a radial bearing and
distance of South 64°19'35'' West 2,770.00 feet;
THENCE along said circular curve to the right and witl~ said west right-of-way line an
arc distance of 425.62 feet and a chord bearing and distance of South 21°16'18'' East
426.20 feet to a 1/2 inch iron rod set for corner;

an arc distance of 620.52 feet and a chord bearing and distance of North 79°56'48''
East 616.79 feet to a 5/8 inch "capped" iron rod found for the point of tange~cy;
THENCE North 69o28'24'' East continuing along said south right-of-way line a distance
of 165.39 feet to the POINT OF BEGINNING and CONTAINING 8.8937 acres of 387,408
square feet of land.
