COMMISSIONERS:
The Planning and Zoning Commission of the City of Coppell met in pre -session at 6:00 p.m.,
and in regular session at 6:30 p.m., on Thursday, December 17, 2009, in the Council
Chambers of Coppell Town Center, 255 Parkway Boulevard, Coppell, Texas. The following
Commissioners were present:

Commissioner Haas arrived at the meeting at 6:45 p.m.
Also present was Planning Director, Gary Sieb; Assistant Planning Director, Marcie Diamond;
City Planner, Matt Steer; Graduate Engineer, Michael Garza; Chief Building Official, Michael
Arellano and Planning Secretary, Juanita Miles.

Chairman Frnka called the meeting to order.
Consider approval of minutes: September 17 & November 19, 2009.
Commissioner Jett made a motion to approve
November 19, 2009, as written. Commissioner
carried (6-0) with Commissioners Jett, Tankersley,
Kittrell voting in favor. None opposed.

Consider approval of Case No. PD -245-R. Barnes at Riverview, zoning change
request from R (Retail) to PD-245-R(Planned Development -245 -Retail) to attach a
Detail Site Plan allowing two office/ medical office/retail buildings (totaling 9,175
square feet) with a 300 -square -foot restaurant, on approximately one acre of
property located at the southeast corner of Sandy Lake Road and Riverview
Drive, at the request of Ray Barnes, being represented by Robert Schneeberg,
Gonzalez and Schneeberg Engineers and Surveyors, Inc.

Presentation:
Assistant Planning Director, Marcie Diamond introduced this case to the Commission
showing exhibits, elevations, color renderings and color board. She mentioned that 18
notices were mailed to property owners within 200 feet of this request. One returned
in opposition to the type of restaurant proposed and none returned in favor. She
stated that staff is recommending approval subject to conditions, which she read into
the record.
Robert Schneeberg, Gonzalez & Schneeberg, 660 N. Central Expwy., Suite 250,
Plano, Texas was present to represent this case before the Commission, to address
any questions and stated that he was in agreement with staff's recommendation.
Public Hearing:
Chairman Frnka opened the Public Hearing, asking for people who wanted to speak in
either favor or opposition or wanted to comment on this request to come forward. The
following people spoke:
IN FAVOR
Ron Brown, Prizm Architects, 580 Decker Drive, Suite 170, Irving, Texas, spoke
in favor and addressed the Commission's concerns with proposed reduction in
side yard setback if the church on the adjacent lot expands, prohibition of
parking in the alley, details for crush granite adjacent to curb, and meeting with
adjacent homeowners.
OPPOSED
Travis & Angela Olthoff, 1420 Grapevine Creek Drive, Coppell, Texas, spoke in
opposition with concerns about the restaurant's location, trash issues around
the restaurant, the landscape buffer instead of a wall separating the restaurant
from the subdivision, a meeting with the adjacent homeowners and the
applicant to discuss what and how the proposal will affect them.
Ray Barnes, Owner/Applicant, 1267 Bradford Drive, Coppell, Texas, addressed
the homeowner's concerns with sanitary issues around the restaurant.
Chairman Frnka closed the Public Hearing.
Action:
After review and discussion, Vice Chairman Haas made a motion to approve Case No.
PD -245-R, Barnes at Riverview, zoning change request from R (Retail) to PD-245-
R(Planned Development -245 -Retail) to attach a Detail Site Plan allowing two office/
medical office/retail buildings (totaling 9,175 square feet) with a 300 -square -foot
restaurant subject to the following revised conditions:
1. Submission of minor site plan amendment and plat for Metrocrest Community
Church to establish the fire lane and mutual access easement.
2. Submission of the shared dumpster agreement.
3. Approval of the restaurant (sno balls plus) subject to the floor plan, sign plan
and hours of operation as provided in the PD.
4. Increasing the size of the landscaping materials for screening purposes
consisting of eight -foot Nellie R. Stevens and 3.5"cal. Bald Cypress.

5. Clarification on the detail sheet that crushed granite will be used adjacent to
curb.
6. An effort shall be made to meet with the adjacent homeowners about the
proposal.
*Commissioner Jett left and was not present for the rest of the meeting.
Commissioner Kittrell seconded; motion carried (6-0) with Commissioners Tankersley,
Haas, Frnka, Sangerhausen, Duncan and Kittrell voting in favor. None opposed.
5. Consider approval of the Barnes at Riverview Addition, Lot 1, Block A. Minor
Plat, being a minor plat to establish setbacks, fire lanes and mutual access and
utility easements to allow the construction of two office/ medical office/retail
buildings, with a 300 square foot restaurant, on approximately one acre of
property located at the southeast corner of Sandy Lake Road and Riverview
Drive, at the request of Ray Barnes, being represented by Robert Schneeberg,
Gonzalez and Schneeberg Engineers and Surveyors, Inc.

Presentation:
Assistant Director of Planning, Marcie Diamond introduced this companion case to the
Commission showing exhibits. She stated staff's recommendation for approval
subject to one condition, which she read into the record.

Plano Texas was present to represent this case before the Commission, to address
any questions and stated that he was in agreement with staff's recommendation.
Action:
Commissioner Sangerhausen made a motion to approve the Barnes at Riverview
Addition, Lot 1, Block A. Minor Plat, subject to submission and approval of a minor
site plan amendment for the Metrocrest Community Church prior to the recordation of
this minor plat. Vice Chairman Haas seconded; motion carried (6-0) with
Commissioners Tankersley, Haas, Frnka, Sangerhausen, Duncan and Kittrell voting in
favor. None opposed.
6. PUBLIC HEARING:
Consider approval of the Park West Commerce Center, Lot 1, Block 3R, Replat,
being a replat of Blocks 3 and 4, of the Park West Commerce Addition into one
lot to allow the abandonment of various street rights-of-way, utility and railroad
easements and provide for the dedication of necessary easements onsite and
rights-of-way for Southwestern Boulevard and Freeport Parkway, on 47.64 acres
of property located at the southeast corner of Southwestern Boulevard and
Freeport Parkway, at the request of Jorge Rodriguez, Halff Associates, Inc.

stated that staff is recommending approval with no conditions.

present to represent this case before the Commission, to address any questions and
stated that he was in agreement with staff's recommendation.

Action:
Commissioner Kittrell made a motion to approve the Park West Commerce Center,
Lot 1, Block 3R, Replat, a replat of Blocks 3 and 4, of the Park West Commerce
Addition into one lot to allow the abandonment of various street rights-of-way, utility
and railroad easements and provide for the dedication of necessary easements onsite
and rights-of-way for Southwestern Boulevard and Freeport Parkway with no
conditions. Commissioner Sangerhausen seconded; motion carried (6-0) with
Commissioners Tankersley, Haas, Frnka, Sangerhausen, Duncan and Kittrell voting in
favor. None opposed.
7. PUBLIC HEARING:
Consider approval of text amendments to the Code of Ordinances — Chapter 12 -
Zoning, to add Section 12-32B. - "Small Wind Energy Systems", to establish
regulations for small scale wind turbines within the City of Coppell and to
amend Section 12-30 to permit this use by Special Use Permit.

Presentation:
City Planner, Matt Steer introduced this text amendment to the Code of Ordinances,
Chapter 12 - Zoning to add Section 12-32B. - "Small Wind Energy Systems", to
the Commission showing exhibits. Mr. Steer also addressed some questions from the
Commission concerning potential locations of wind turbines, setback requirements,
height and types of small scale wind turbines. Chief Building Official, Michael
Arellano, was present to address questions about permitting and structural
requirements.

Action:
Vice Chairman Haas made a motion to hold the text amendment to the Code of
Ordinances — Chapter 12 -Zoning, to add Section 12-32B., "Small Wind Energy
Systems, under advisement until the January 21, 2010 meeting, so that staff can
bring back a draft copy of the ordinance considering the Commission's concerns with
the following issues:
1. Distinction between commercial and residential height standards.
2. Side yard setbacks should include an exclusionary statement for roof -mounted
systems.
3. Consideration of FAA Standards for non -reflective material.
4. Liability issues with owner agreements related to setbacks.
5. Visual clutter restrictions.
Commissioner Sangerhausen seconded; motion carried (6-0) with Commissioners
Tankersley, Haas, Frnka, Sangerhausen, Duncan and Kittrell voting in favor. None
opposed.
8A. Update on Council action for planning agenda items on December 8, 2009:
1. - Case No. PD-244-TH-2, Willow Park, a zoning change request from C
(Commercial) to PD-244-TH-2 (Planned Development -244 -Townhouse -2) to
allow 24 detached townhouse units and to amend the Land Use Plan of
the 1996 Comprehensive Plan on property located east of S.H. 121 along
the north side of Coppell Road.
2. Willow Park, Preliminary Plat, to establish the street and lot layout for 24
townhouse lots on property located east of S.H. 121 along the north side
of Coppell Road.
3. Case No. PD -236R -SF -12, Bethel Road Manor, a zoning change request
from PD -236 -SF -12 (Planned Development -236 -Single Family -12) to PD -
236R -SF -12 (Planned Development -236 Revised -Single Family -12)
amending the Detail Site Plan to allow a cabana (containing a 90 -square -
foot air conditioned bathroom and outdoor living and kitchen areas), an
arbor structure, an in -ground pool in the rear yard of the property;
relocating a decorative screening wall with gates along the front property
line, adding a guard rail to the culvert and construction of stone veneer
facing the headwall and culverts on property located at 234 W. Bethel
Road.
4. St. Andrews Estates, Lot 19R, Block 1, Replat, a replat of Lots 19 and 20 of
St. Andrews Estates, into one lot to allow one single-family home on land
located at the southwest corner of Inglenook Court and Stonewick Lane.
5. Bethel Road Estates, Lot 2R, Block 1, Replat, a replat of Lot 2, Block 1, of
Bethel Road Estates to relocate the platted 100 -year flood plain line on
property located at 256 West Bethel Road.
6. Ordinance for Case No. PD -222R3 -LI, Duke Lesley Addition (Point West
VII), Lot 2, Block A, a zoning change from PD -222R2 -LI (Planned
Development -222 Revision 2 -Light Industrial) to PD -222113-1-I (Planned
Development -222 Revision 3 -Light Industrial), to revise the Detail Site Plan

to allow 91 additional parking spaces in the truck court area and 13 new
parking spaces in the front yard on property located at 240 Dividend Drive.
7. Ordinance for Case No. PD -222114-1-I, Duke Lesley Addition (Point West
VII), Lot 3, Block A, a zoning change from PD -222 -LI (Planned
Development -222 - Light Industrial) to PD -222R4 -LI (Planned Development -
222 Revision 4 -Light Industrial), to establish a Detail Site Plan to allow a
shared parking area (253 parking spaces) on property located on the north
side of Dividend Drive, west of South Belt Line Road.
8. Ordinance for Case No. S-1 108R4 -SF -9, Verizon, a zoning change from S -
1108R -SF -9 (Special Use Permit -1108 Revised - Single Family -9) to S -
1108R4 -SF -9 (Special Use Permit -1108 Revision 4 - Single Family -9), to
replace an existing 80 -square -foot accessory cabinet with a 190 -square -
foot cabinet at the base of the tower on 750 square feet of lease area
located north of East Belt Line Road within the electric transmission line
easement.
During the Pre -Session, Director of Planning, Gary Sieb advised the Commission of
Council's actions on December 8, 2009, mentioning that Council approved all above-
mentioned items.
8B. Director's Comments.
Director of Planning, Gary Sieb presented to the Commission a draft agenda and

• August 20, 2009, the Planning Commission approves revisions to the Open
Storage Ordinance
• September 8, 2009, the City Council approves revisions to the Open
Storage Ordinance as amended by the Planning Commission (Screening)
