OR 297-A-21 Terra Land Development Co.-Riverchase AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 297A21 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COMPREHENSIVE ZONING OROINANCE OF THE CITY OF COPPELL, TEXAS, AS HERETOFORE AMENDED, TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICATION HEREIN STATED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Zoning Commission and the Governing Body of the City of Coppell, Texas, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordinance and zoning map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, the said Governing Body is of the opinion that said change of zoning on on applieation of TERRA LAND DEVELOPMENT COMPANY - RIVERCHASE should be granted and the Comprehensive Zoning Ordinance of the City of Coppell should be amended in the exercise of its legislative discretion: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas, be and the same is hereby amended by amending the Zoning Map of the City of Coppell, to give the hereinafter described property a new zoning district classification, to-wit: Tract 1. Attached hereto as Exhibit "B" is the letter of Terra Land Development Co., applicant, dated February 25, 1985, listing the items which were volunteered by applicant in connection with this zoning change. That the above described property shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the granting of this zoning classification. SECTION 5. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 6. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of One Thousand Dollars ($1,000.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 7. It is necessary to give the property described herein the above mentioned zoning classification in order to permit its proper development and in order to protect the public interest, comfort and general welfare of the City. We at Terra Land Development Co. have concluded that it is very important for us to establish Riverchase as a fine quality master planned community as the highest and best use of the property. To be able to accomplish this, we have volunteered a number of things to assure the development will be a unique facility we can all be proud of. Please let this letter confirm the items that we are volun- teering and that we feel are important to our master planned community. Terra will deed restrict the property to ensure: 1) Creation of a green belt linear park with paved hike and bike trails and exercise stations under the existing electric power lines; 2) Reclamation of the floodway/floodplain areas to permit the uses in our development plan; 3) Minimum size of SF-0 units to be 1,400 square feet; 4) Screening walls along MacArthur Boulevard at the SF-9 and MF tracts; and 5) Landscaping along interior loop street. To assure that Riverchase will be created and maintained as a fine master planned community no matter who the owner or owners may be we also volunteer the following: 1) No building permits will be issued for construction on the portion of the property east of MacArthur Blvd. until approval by the voters of Dallas County of the bonds for improvement of Belt Line Road south of the property, completion of the reclamation of the property in accordance with the reclamation plan approved by the U. S. Army Corps of Engineers, and approval of the rail- road crossing for MacArthur Blvd. by the St. Louis and Southwestern Railroad. If the railroad fails to approve the crossing for MacArthur Blvd. and the City of Coppell undertakes condemnation proceedings for such purpose, Terra Land Development Co. will reimburse the City for its expenses and attorneys fees in connection with such condemnation. 2) Building permits will be issued for no more than 25% of allowable structures east of MacArthur Blvd. prior to completion of the golf course construction. 3) Terra will add a second access road to Belt Line Road from the property to be located east of MacArthur Boule- vard as soon as approval for such crossing is obtained from the St. Louis and Southwestern Railroad. 4) Height and size of buildings on the MF-1 Tract fronting on Sandy Lake Road would be limited to single story duplex for the first 80 feet from the drainage ditch and to one story quadraplex for the next 120 feet. 5) Terra Land Development Co. will install traffic signals at its expense at the intersection of Belt Line Road and MacArthur Blvd. upon completion of the construction of the new intersection.
