Akard Street Dallas, Texas 75201 RE: Request for Legal Opinion CEDC Dear Bob: Recently the Coppell Education Development Corporation (CEDC) began to review its baseline requirements for grants to public institutions for the upcoming year. One of the requirements set forth in the Corporation's Bylaws is that, and I quote from Article IV, Section 8B of said Bylaws: "In order to be eligible for grants during a calendar year, enrollment figures must be submitted by the February 1 deadline." The question posed to you for a legal opinion is as follows. If a publicly funded educational institution fails to submit its enrollment figures by February 1 of each calendar year, is it ineligible for a grant that year or may it rollover its allocation if it submits an enrollment figure to the CEDC at any time during the calendar year? This approach was taken in order to ensure that a proper allocation of estimated, and eventually actual funds, were provided to each participating institution. There are other areas of concern and questions related to this. I would be more than happy to visit with you about it at your convenience. We would appreciate receiving this opinion by the end of the first week in March.
