AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 297A4 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING ]'fiE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF COPPELL, TEXAS, AS HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING ON THE HEREINAFTER DESCRIBED PROPERTY TO THE NEW ZONING CLASSIFICATION HEREIN STATED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Zoning Commission and the Governing Body of the City of CoppeI1, Texas, in compliance with the laws of the State of Texas with reference to the granting of zoning changes under the zoning ordinance and zoning map, have given requisite notices by publication and otherwise, and after holding due hearings and affording a full and fair hearing to all property owners generally, the said Governing Body is of the opinion that said change of zoning which is on application of Pat Musgrave et. al. should be granted and the Comprehensive Zoning Ordinance of the City of Coppell should be amended in the exercise of its legislative discretion: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas, be and the same is hereby amended by amending the Zoning [~lap of the City of Coppell, to give the hereinafter described property a new zoning district classification, to-wit: "C" Commercial District Classification Said property being described as follows: TRACT 1. BEING a tract of land situated in the JOHN C. READ SURVEY, ABSTRACT NO. 1183, Dallas County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at an iron rod for corner in the East line of Coppell Road, same being North 103.00 feet from the North line of a tract of land conveyed to Altha L. Cribbs by deed filed December 16, 1942, in the Deed Records of Dallas County, Texas, and the South line of a tract of land conveyed to Mattie Esther Parrish by deed recorded in Volume 3051 at page 459 of the Deed Records of Dallas County, Texas, and being more particularly described by metes and bounds as follows: THENCE North along the said East line of Coppell Road for a distance of 70.00 feet to a point for corner; THENCE South 88 degrees 00 minutes 00 seconds East for a distance of 150.00 feet to a point for corner; THENCE South for a distance of 70.00 feet to a point for corner; THENCE North 88 degrees 00 minutes 00 seconds West for a distance of 150.00 feet to the POINT OF BEGINNING. CONTAINING 0.24 acres of land. TRACT 2. BEING a tract of land situated in the JOHN C. READ SURVEY, ABSTRACT NO. 1183, Dallas County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at an iron rod for corner in the East line of Coppell Road, same being North 86.50 feet from the North line of a tract of land conveyed to A]tha L. Cribbs by deed filed December 16, 1942, in the Deed Records of Dallas County, Texas, and the South line of a tract of land conveyed to Mattie Esther Parrish by deed recorded in Volume 3051 at page 459 of the Deed Records of Dallas County, Texas, and being more particularly described by metes and bounds as follows: THENCE North along the said East line of Coppell Road for a distance of 16.50 feet to a point for corner; THENCE South 88 degrees 00 minutes 00 seconds East for a distance of 150.00 feet to a point for corner; THENCE North for a distance of 70.00 feet to a point for corner; THENCE South 88 degrees 00 minutes 00 seconds East for a distance of 94.00 feet to a point for corner; THENCE South for a distance of 86.50 feet to a point for corner; THENCE South 88 degrees 00 minutes 00 seconds East for a distance of 244.00 feet to the POINT OF BEGINNING. ANDERSON SURVEY, ABSTRACT NO. 18, Dallas County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at an iron rod for corner in the East line of Coppell Road, same being in the North line of a tract of land conveyed to Altha L. Cribbs by deed filed December 16, 1942, in the Deed Records of Dallas County, Texas, and in the South line of a tract of land conveyed to Mattie Esther Parrish by deed recorded in Volume 3051 at page 459 of the Deed Records of Dallas County, Texas, and being more particularly described by metes and bounds as follows: THENCE South 88 degrees 00 minutes 00 seconds East for a distance of 150.00 feet to a point for corner; THENCE South for a distance of 100.00 feet to a point for corner; THENCE North 88 degrees 00 minutes 00 seconds West for a distance of 150.00 feet to a point for corner in the East line of Coppell Road; THENCE North along the said East line of Coppell Road for a distance of 100.00 feet to the POINT OF BEGINNING. Parrish to Lois Jarrell and husband, Lonnie Jarrell, by deed dated June 15, 1953, recorded in Volume 3871, Page 119, Deed Records of Dallas County, Texas, and being more particularly described as follows: BEGINNING at a point in the center of Belt Line Road 273 feet North of the southwest corner of a 13 acre tract of land conveyed by Deed dated October 7, 1911 from W. T. Kirby to J. O. Thompson; THENCE East 180 feet to point for corner; THENCE South 70 feet to point for corner; THENCE West 180 feet to point for corner in centerline of Belt Line Road; THENCE North along the centerline of said Road 70 feet to the PLACE OF BEGINNING. TRACT 5. BEING a tract of land situated in the J. W. ANDERSON SURVEY, ABSTRACT NO. 18, Dallas County, Texas, and being part of a 13 acre tract conveyed by W. T. Kirby and wife to J. O. Thompson by deed dated October 7, 1911, recorded in Volume 487 at page 418 of the Deed Records of Dallas County, Texas, and being part of the land conveyed by Mrs. E. Leon Thompson et al to Mattie Esther Parrish by deed dated November 8, 1947, recorded in Volume 3051 at page 459 of the Deed Records of Dallas County, Texas and being more particularly described by metes and bounds as follows: BEGINNING at an iron rod found for corner in the East line of Coppell Road (a 60 foot wide road - formerly Belt Line Road), same being in the North line of a tract of land conveyed to Altha L. Cribbs by deed filed December 16, 1942, and in the South line of the above mentioned Mattie Esther Parrish tract; THENCE North along the said East line of Coppell Road for a distance of 86.50 feet to an iron rod found for corner; THENCE South 88 degrees 00 minutes 00 seconds East, parallel with the North line of said Parrish tract, for a distance of 244.00 feet to an iron rod for corner in the East line of said Parrish tract; THENCE South along the said East line of Parrish tract for a distance of 186.50 feet to an iron rod for corner, same being the Southeast corner of said Parrish tract; THENCE North 88 degrees 00 minutes 00 seconds West along the most Southerly South line of said Parrish tract for a distance of 94.00 feet to an iron rod for corner, same being the most Southerly Southwest corner of said Parrish tract; THENCE North along the most Easterly West line of said Parrish tract for a distance of 100.00 feet to an iron rod for corner, same being an interior corner of said Parrish tract; THENCE North 88 degrees 00 minutes 00 seconds West for a distance of 150.00 feet to the POINT OF BEGINNING. CONTAINING 30,487,4165 square feet or 0.6998 acres of land. SECTION 2. That the above described property, shall be used only in the manner and for the purposes provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the granting of this zoning classification. SECTION 3. That all ordinances of the City in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 4. That should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance shah be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon conviction shall be punished by fine not to exceed the sum of two hundred dollars ($200.00) for each offense, and that each day such violation shall continue to exist shall constitute a separate offense. SECTION 6. It is necessary to give the property described herein the above mentioned zoning classification in order to permit its proper development and in order to protect the public interest, comfort and general welfare of the City. Therefore, this ordinance shall take effect immediately from and after its passage and publication of its caption, as the law in such cases provides.
