WITNESSETH: WHEREAS, the CITY is authorized by TEX. LOC. Gov'T CODE § 379A to provide educational development grants to publicly funded institutions through the CEDC for the promotion of literacy, foreign language and career technology for a skilled workforce; and WHEREAS, the CITY seeks to support programs for promoting literacy, foreign language and career technology for a skilled workforce; and WHEREAS, the LISD has submitted a grant application No. 2009 -T01 to provide funding for technology at Lewisville High School (the PROJECT); and WHEREAS, the LISD has developed the PROJECT in order to purchase licenses for test preparation software for Lewisville High School in the amount of Nine Thousand Seven Hundred Fifty -four Dollars and no cents ($9,754.00); and WHEREAS, LISD is in need of funding for the technology and the assistance of the CEDC; and WHEREAS, the CITY has determined that making an education development grant to the LISD in accordance with this Agreement will further the objectives of the CITY, will benefit the CITY and the CITY's inhabitants and will promote literacy in the CITY; NOW THEREFORE, in consideration of the foregoing, and other valuable consideration the receipt and sufficiency of which are hereby acknowledged on the terms and conditions hereinafter set forth, the parties agree as follows: 1. Subject to availability of funds collected from the 379A sales tax, the CITY agrees to provide the LISD an education development grant (the "GRANT ") in an amount not to exceed Nine Thousand Seven Hundred Fifty -Four Dollars and no cents ($9,754.00). 2. LISD agrees to utilize the GRANT to fund the purchase of licenses for test preparation woftware for Lewisville High School within the LISD. COPPELL EDUCATION DEVELOPMENT GRANT Page 1 GENERAL PROVISIONS 3. CITY agrees to provide the GRANT of Nine Thousand Seven Hundred Fifty -four Dollars and no cents ($9,754.00) funds payable in February 2009. Funds to be expended in accordance with the budget categories set forth in the GRANT application. 4. No later than May 15, 2009 the LISD shall submit the receipts for purchases for this GRANT to the CEDC. The detailed expenditures shall include, but not be limited to, copies of invoices. 5. In the event the LISD breaches any of the terms of this AGREEMENT or fails to use the GRANT for the purposes set forth herein, then the LISD, after expiration of the notice and cure period described herein, shall be in default of this AGREEMENT. As liquidated damages in the event of such default, the LISD shall, within thirty (30) days after demand, repay to the CITY, the GRANT with interest at the rate of eight percent (8 %) per annum from the date of receipt of the GRANT until paid. The parties acknowledge that actual damages in the event of default would be speculative and difficult to determine. Upon breach by LISD of any obligations under this AGREEMENT, the CITY shall notify the LISD in writing, who shall have thirty (30) days from receipt of the notice in which to cure such default. If LISD fails to cure the default within the time provided herein, or, as such time period may be extended, then the CITY at its sole option, shall have the right to terminate this AGREEMENT without further notice to the LISD. 6. The terms and conditions of this AGREEMENT are binding upon the successors and assigns of all parties hereto. This AGREEMENT may not be assigned without the express written consent of CITY and CEDC. 7. It is understood and agreed between the parties that LISD, in the use of the GRANT and in satisfying the conditions of this AGREEMENT, is acting independently, and that the CITY and /or the CEDC assumes no responsibilities or liabilities to third parties in connection with these actions. LISD agrees to indemnify and hold harmless the CITY and the CEDC from all such claims, suits, and causes of action, liabilities and expenses, including reasonable attorney's fees, of any nature whatsoever arising out of the LISD'S performance of the conditions under this AGREEMENT. 8. Any notice required or permitted to be delivered hereunder shall be deemed received when sent by United States mail, postage pre -paid, certified mail, return receipt requested, addressed to the party at the address set forth opposite the signature of the party. 9. This AGREEMENT shall be governed by the laws of the State of Texas; and venue for any action concerning this AGREEMENT shall be in the State District Court of Dallas County, Texas. 10. In the event any one or more of the provisions contained in this AGREEMENT shall for any reason be held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not effect the other provisions, and the AGREEMENT shall be construed as if such invalid, illegal, or unenforceable provision had never been contained in it. The campus had 2784 students enrolled, as of September 19, 2008. As of 1/16/08, the campus served 11 Coppell residents among its population. LHS' CEDC initiative will purchase licenses for test preparation software and certification test software to allow students in LHS' Business Computer Information Systems (BCIS) courses I and II to prepare for and obtain Internet and Computing Core Certification (IC and Microsoft Office Specialist (MOS) certifications. This initiative falls under the category of Career Technology for a Skilled Workforce. The program will be delivered by BCIS teachers. The initiative is designed to assist students from LHS' at -risk population to graduate with marketable technology skills, whether they intend to enter directly into the workforce after graduation, pursue post - secondary education, or advanced technical training. The proposed technology will cost $9,754. Participants will include all students enrolled in BCIS I and II during the 2008 -09 school year. With 240 BCIS I and II students potentially benefitting from the initiative, approximate cost per student will be $40.64. II. Description of Proposal and Nature of Request Lewisville High School (LHS) proposes to purchase Internet and Computing Core Certification (IC and Microsoft Office Specialist (MOS) test preparation and certification software to support career technology for a skilled workforce. LHS is a 10 -12 grade campus (though there are some 9th graders, since students repeating 9th grade from the 9th grade campus move on to LHS the following year), serving a portion of Lewisville characterized by a dramatically increasing minority, limited English proficient (LEP), and economically disadvantaged population over the past 10 years. The Lewisville school district has seen a 66% population growth between 1995 and 2005, 55% increase in African- American enrollment, 78% increase in Hispanic enrollment, 114% increase in LEP, and 137% increase in economically disadvantaged students. A substantial concentration of those changes have been within LHS's feeder system; at present, LHS's 300 LEP students represent 43% of all LEP high school students within LISD (though there are 5 comprehensive high schools); 53% minority population; and 25% mobility rate. These are among the most at -risk students in the district (see Dropout data, below). There is as much as a 40 percentage point gap between student groups in math and science TAKS passing: 2006 -07 math, White 91%, African- American 70 %, Hispanic 66 %, EcoDis 65 %, LEP 51 %, Overall Campus 80 %, district 90 %; 2006 -07 science, White 88 %, African- American 62 %, Hispanic 62 %, EcoDis 54 %, LEP 31%, Overall Campus 75 %, District 84 %. LHS' high -risk population shows an increased dropout rate relative to similar high schools in Texas, and LISD as a whole (LHS 2.7 %, similar Texas high schools 2.0 %, LISD 1.2 %). In addition, dramatic dropout differences among student groups (White 1.2 %, African- American 2.3 %, Hispanic 5.6 %, economically disadvantaged 4.4 %, limited English proficient LHS 3 7.3 %) vividly demonstrates a need for strategies to increase student interest, academic engagement, and prevent dropping out of school. Providing students with career technology skills needed to succeed in the workforce is one way to increase students' academic interest and engagement, and their likelihood of graduating from high school. Students at LHS often go straight from high school to the work force. For those of our students who do go on to higher education, many of them have to work while attending college. Consequently, any program we can provide that strengthens the employability and technological skills of our students would be extremely beneficial. This is consistent with US Department of Labor's (2005) projections that the demand for jobs in "professional, scientific, and technical services will grow by 28.4 percent and add 1.9 million new jobs by 2014. Employment in computer systems design and related services will grow by 39.5 percent and add almost one- fourth of all new jobs in professional, scientific, and technical services" (http: / /stat.bls.gov loco /ocos268. , retrieved 9/25/08). We propose to provide software skills certifications to our students. There are a variety of certifications available. After researching these, two certifications in particular align well with our current curriculum. The first certification we will offer our students with grant funding is the IC certification, for students enrolled in our Business Computer Information Systems (BCIS) I class. According to the website of the company that offers IC certification, Certiport, this certification "helps you learn and demonstrate Internet and digital literacy through a worldwide industry standard. To become IC certified, you must pass the following three exams: computing fundamentals, key applications, and living online." The cost to take the exams is prohibitive for many of our students, and is beyond the campus' current budget capacity without Coppell grant funding. The majority of the concepts tested on the IC are currently covered in our BCIS I and LHS 4 BCIS II classes. Purchasing IC test prep software for this test will allow all students enrolled in the course who desire to do so to complete test preparation. Not all students have indicated an interest in obtaining IC cert but the tests will be made available. The software will be loaded on ten computers in three different BCIS I labs. Students will be given class time throughout the eighteen -week course to take practice tests. The second certification is the Microsoft Office Specialist Certification (MOS). According to Microsoft's official website, "Offering Office Specialist certification to your students provides an opportunity for them to achieve a portable, globally recognized credential that proves their abilities as productive Microsoft Office users" (retrieved 9/25/08 from http: / /www.rnicrosoft.com/ learning/ mcp /officespecialist /default.mspx ). In order to attain MOS certification, students must pass four different tests covering Word, Excel, PowerPoint, and Access. These four software programs are currently included in our Business Computer Information Systems course curricula (BCIS I and BCIS II). Again, for many of our students at Lewisville High School certification costs would be cost prohibitive. Grant funding will allow us to offer students valuable career technology competencies and credentials to add to their resumes. This certification will be offered by the BCIS II teacher to students in BCIS II with an 80 or above average. The test will be taken during the last week of the eighteen week course. To ensure students are prepared for the certification tests, we will purchase test preparation software, which will be loaded on ten computers in the BCIS II lab. Students will be given class time throughout the eighteen weeks to take practice tests. In order to effectively prepare our students to pass the certification tests, the teachers who teach BCIS I and BCIS II will also need to become certified. Thus, all eight business teachers teaching BCIS I and II will need to take and pass the exams. Again, this is beyond LHS' current LHS 5 budget. Grant funding will be used to pay for these tests and teachers. With the approval of administration, teachers will use an in- service day to take the test. Detailed Budget The project manager will be Pam Ball, business teacher at LHS. The project manager will follow accepted accounting procedures for expenditures and record keeping. Project activities will be closely coordinated with the district's Purchasing and Finance offices. The district grant writer will be available for consultation on an as- needed basis. IV. Project Measurements and Evaluation Grant funding will allow us to meet the following objectives: • Train and certify 8 BCIS teachers in both MOS and IC by May 2009, as measured by number obtaining IC and MOS certification • At least 150 BCIS I students will complete IC test - preparation software modules by June 4, 2009, as measured by lesson plans and teacher observations • At least 10 BCIS II students will complete MOS test preparation software modules by June 4, 2009, as measured by lesson plans and teacher observations • At least 70 (makes total of 240 students) BCIS I students will successfully obtain IC certification by taking and passing each of the following competence tests by June 4, 2009: Computing Fundamentals, Key Applications, and Living Online by June 4, 2009, as measured by certification test results • 10 BCIS II students will successfully obtain MOS certification by taking and passing each of the following competence tests by June 4, 2009: Microsoft Word, Excel, PowerPoint, and Access (with one Access retake build in, due to high failure rate reported by Certiport), as measured by certification test results • BCIS I and BCIS II students will report in an end -of- course survey that IC and MOS certifications will be helpful to their future marketability in the workplace • BCIS I and II students will report in an end -of- course survey that they wish for IC and MOS certifications to be available to their peers in the future • BCIS I and II students will report increased interest in pursuing technology careers as a result of participation in IC and MOS preparation, as measured by end -of- course surveys The instructional technology for which we have requested grant funding is anticipated to be compatible with technology currently in use on our campus, and has been reviewed and recommended by our campus technology facilitator. It is possible that software upgrades may be necessary at some point, however, we anticipate department budgets will accommodate those needs. Training in use of the additional instructional technology will be provided by campus technology staff. The numbers of students that will benefit from the proposed initiative are as follows: • BCIS I. 28 sections of up to 25 students each, per year = 700, with 150 students projected to complete test preparation software and 10 students to successfully obtain IC certification. • BCIS II. 1 section of 25 students per year, with all 25 students projected to complete test preparation and 10 students to successfully obtain MOS certification. • Thus, 175 students are projected to directly benefit from purchasing the software during 2008 -09. • Total cost for this initiative = $9,754.
