LISD Grant No. 2006-L01
STATE OF TEXAS § COPPELL EDUCATION DEVELOPMENT CORPORATION COUNTY OF DALLAS § GRANT AGREEMENT This Educational Development Grant Agreement ( "Agreement ") is made by and between the city of Coppell, Texas ( "CITY "), Coppell Education Development Corporation ( "CEDC ") and the Lewisville Independent School District (the "LISD "), acting by and through their respective authorized officers. WITNESSETH: WHEREAS, the CITY is authorized by TEX. LOC. Gov'T CODE § 379A to provide educational development grants to publicly funded institutions through the CEDC for the promotion of literacy, foreign language and career technology for a skilled workforce; and WHEREAS, the CITY seeks to support programs for promoting literacy, foreign language and career technology for a skilled workforce; and WHEREAS, the LISD has submitted a grant application No. 2006 -L01 to provide funding for literacy and foreign language at Rockbrook Elementary and career technology at Durham Middle School (the PROJECT); and WHEREAS, the LISD has developed the PROJECT in order to purchase books and videos for the Rockbrook Elementary Library in the amount of Fourteen Thousand Dollars and no cents ($14,000.00) and to purchase hardware, software, literature and other Spanish teaching supplies in the amount of One Thousand Nine Hundred Ninety -seven Dollars and Thirty -six Cents ($1,997.36). The PROJECT also includes purchase of a digital projector and replacement bulb for Durham Middle School in the amount of Thirteen Thousand Six Hundred Ninety -six Dollars and no cents ($13,696.00); and WHEREAS, LISD is in need of funding for the videos, books, computer programs, teaching supplies, digital projector and bulb, and seeks the assistance of the CEDC; and WHEREAS, the CITY has determined that making an education development grant to the LISD in accordance with this Agreement will further the objectives of the CITY, will benefit the CITY and the CITY's inhabitants and will promote literacy in the CITY; NOW THEREFORE, in consideration of the foregoing, and other valuable consideration the receipt and sufficiency of which are hereby acknowledged on the terms and conditions hereinafter set forth, the parties agree as follows: COPPELL EDUCATION DEVELOPMENT GRANT Page 1 GENERAL PROVISIONS 1. Subject to availability of funds collected from the 379A sales tax, the CITY agrees to provide the LISD an education development grant (the "GRANT ") in an amount not to exceed Twenty -nine Thousand Six Hundred Ninety -three Dollars and Thirty -six Cents ($29,693.36). 2. LISD agrees to utilize the GRANT to fund books, videos, hardware, software, and other Spanish teaching supplies for Rockbrook Elementary and a digital projector and bulb for Durham Middle School within the LISD. 3. CITY agrees to provide the GRANT of Twenty -nine Thousand Six Hundred Ninety - three Dollars and Thirty -six Cents ($29,693.36) funds payable on a quarterly basis with the first payment due in February 2006. Funds to be expended in accordance with the budget categories set forth in the GRANT application. 4. No later than May 15, 2006 the LISD shall submit the receipts for purchases for this GRANT to the CEDC. The detailed expenditures shall include, but not be limited to, copies of invoices. 5. In the event the LISD breaches any of the terms of this AGREEMENT or fails to use the GRANT for the purposes set forth herein, then the LISD, after expiration of the notice and cure period described herein, shall be in default of this AGREEMENT. As liquidated damages in the event of such default, the LISD shall, within thirty (30) days after demand, repay to the CITY, the GRANT with interest at the rate of eight percent (8 %) per annum from the date of receipt of the GRANT until paid. The parties acknowledge that actual damages in the event of default would be speculative and difficult to determine. Upon breach by LISD of any obligations under this AGREEMENT, the CITY shall notify the LISD in writing, who shall have thirty (30) days from receipt of the notice in which to cure such default. If LISD fails to cure the default within the time provided herein, or, as such time period may be extended, then the CITY at its sole option, shall have the right to terminate this AGREEMENT without further notice to the LISD. 6. The terms and conditions of this AGREEMENT are binding upon the successors and assigns of all parties hereto. This AGREEMENT may not be assigned without the express written consent of CITY and CEDC. 7. It is understood and agreed between the parties that LISD, in the use of the GRANT and in satisfying the conditions of this AGREEMENT, is acting independently, and that the CITY and/or the CEDC assumes no responsibilities or liabilities to third parties in connection with these actions. LISD agrees to indemnify and hold harmless the CITY and the CEDC from all such claims, suits, and causes of action, liabilities and expenses, including reasonable attorney's fees, of any nature whatsoever arising out of the LISD'S performance of the conditions under this AGREEMENT. 8. Any notice required or permitted to be delivered hereunder shall be deemed received when sent by United States mail, postage pre -paid, certified mail, return receipt requested, addressed to the party at the address set forth opposite the signature of the party. This AGREEMENT shall be governed by the laws of the State of Texas; and venue for any action concerning this AGREEMENT shall be in the State District Court of Dallas County, Texas. 10. In the event any one or more of the provisions contained in this AGREEMENT shall for any reason be held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not effect the other provisions, and the AGREEMENT shall be construed as if such invalid, illegal, or unenforceable provision had never been contained in it. The proposed projects funded through the Coppell Education Development Corporation (CEDC) will serve two campuses in Lewisville Independent School District, Rockbrook Elementary and Marshall Durham Middle School. Each campus serves a portion of Coppell residents, and the funding from CEDC will be divided between the two campuses. The rationale for the project at Rockbrook Elementary is to both extend the foreign language project begun last year with CEDC funding and add a literacy initiative. The total cost of the Rockbrook project is $16,000.00, and the grant project will be co- implemented by the campus' foreign language instructor, Elizabeth Lennox, and librarian, Harriet Webb. The participants in the project will encompass the entire student population of 675. Literacy materials purchased with the CEDC monies will be available in the library and will follow customary loan processes and procedures. The additional foreign language materials will be used through the Spanish as a Foreign Language specials rotation offered once a week to all 675 Rockbrook students. The rationale for the project at Marshal Durham Middle School (MDMS) project is to further increase students' reading comprehension and will be accomplished by supplementing additional technology into classroom instruction. The technology needed for this project consists of digital projectors for the classroom. It is estimated that this technology initiative will cost approximately $14,000.00 and will be implemented school -wide. Participation in the project will include all 793 students, grades 6 -8, and the projectors purchased with CEDC funds will be available to all students on a rotating basis throughout the school year. 1 SECTION II: DESCRIPTION OF PROPOSAL AND NATURE OF REQUEST The proposal for Rockbrook Elementary is a two prong project: 1) a continuation of the acquisition of Spanish as a Foreign Language instructional materials, and 2) a literacy initiative that supports cultural and linguistic diversity at Rockbrook. Thanks to the 2004 CEDC Grant, the Rockbrook Elementary Foreign Language Program has been very successful. The following portion of the funding request is submitted with a goal of subsidizing foreign language materials previously purchased with a CEDC Grant. These new items will help provide enrichment and authentic instructional materials for the current Spanish program. As a solid investment for both current and future elementary students, these materials will play a vital role in expanding the Spanish program at Rockbrook. The instructional materials will include, but are not limited to, the following: books, puppets, Leap Pad cartridges, headphones, Idiom software and authentic costuming. These instructional materials will supplement the current Spanish teacher's curriculum. Through use of the 2004 CEDC items, the teacher has identified a need for the suggested supplemental materials. The addition of these materials will ensure that the program is solid and sustainable for years to come. The computer - based Idiom software will provide not only interactive learning but also immediate feedback for students in the older grades. Students will enjoy learning vocabulary and figuring out challenges found in the game. The addition of authentic student costumes will foster pride and hard work among students as they perform special events showcasing the cultural diversity of Rockbrook. 2 The foreign language project is an existing initiative seeded with CEDC monies in 2004 -05, and the proposed project will expand the current foreign language initiative. The schedule for implementing the project expansion is as follows: • All students will receive instruction school -wide (grades K -5) on a six -day rotation throughout the school year. • Students will visit the computer lab each semester and use the Idiom software to reinforce classroom instruction. At the teacher's discretion, students will also be given time in the regular classroom to use the computer program. • Kindergarten and First Grade students will continue to use the Leap Pad Systems to reinforce their reading skills while learning Spanish. • All students will have the opportunity to participate, as appropriate, in traditional, authentic dance performances. The teacher is currently enrolled in cultural dance to enhance her knowledge and ability to teach her students. To enrich the elementary school culture and environment with authentic foreign language materials embraces the linguistic and cultural differences represented at Rockbrook. The literacy initiative is supported by the following funding request as part of the CEDC proposal It is submitted with a project goal of expanding the Rockbrook Elementary Media Center /Library Program and enhancing literacy education at Rockbrook. The long -term, campus project goal is to add 4,000 plus books to the current collection in order to raise the library status to an Exemplary rating as determined by the National Library Standards. The additional collections would include a multilingual and multicultural collection, a section dedicated to Texas, and biographies that support the instructional components of the Texas Essential Knowledge and Skills (TEKS). 3 Grant assistance would allow Rockbrook to build a multilingual and multicultural section within the existing library. Rockbrook Elementary has a very diverse student population with significant differences in socioeconomic and cultural backgrounds. With slightly more than thirty -five (35 %) percent of the student population being economically disadvantaged, Rockbrook meets the requirements of being a school -wide Title I campus under the Elementary and Secondary Education Act (ESEA). Further evidence of the diversity present at Rockbrook is demonstrated by the cultural and linguistic differences that comprise the student population. At least seventeen (17) languages /dialects are represented among the Rockbrook family of students. Other than English, the primary languages spoken by Rockbrook students are Spanish and Korean, and these two languages would be the main focus for this section of the library. However, additional materials would be extended to include Chinese, Portuguese, and Telugu (an Indian dialect). Parents who are not literate in English have a difficult time reading English print with their children. By providing a variety of multilingual (including dual language) and multicultural books, these parents would be able to be more involved in their children's literacy development. In addition to the multilingual/mukicultural section, a comprehensive collection about Texas would be acquired. Currently, Rockbrook has a few books about Texas; however, many more are needed. All fourth grade students study Texas as part of the comprehensive State Curriculum. At Rockbrook, sources are needed to supplement the studies and increase the students' interest and knowledge of this great state. Biographies provide a unique aspect of the library collection, as well. The biographies to be considered include and delineate the components of the TEKS. Purchasing biographies of people 4 in Texas history would supplement the expanding Texas collection. Receiving this grant and making these additions to the Rockbrook library collections would allow Rockbrook to effectively meet the needs of the diverse student population and further the goal of having an Exemplary library rating according to National Library Standards. Once grant assistance is received, the books and other related materials will be purchased and implemented upon receipt. The total number of students to be served by grade level for this project is as follows: • Kindergarten 127 • First 126 • Second 116 • Third 100 • Fourth 97 • Fifth 104 • Special Education 05 Whereas Fifth Graders use the library at the teacher's discretion, students in Kindergarten through Fourth Grade will be subject to a weekly library rotation. The availability of books to students will follow campus procedures and policies for loaning. The instructional methodology utilized in the library rotation for literacy materials will include, but is not limited to, teacher reading to students, student selection, games, puzzles, worksheets, hands -on activities and videos. The shifting demographics and concentrated diversity of Rockbrook provides project relevancy. The diversity and cultural understanding taught through the proposed projects is vital to daily 5 student and community interaction. The future for acquisition of teaching materials and curriculum at Rockbrook will be greatly enhanced and will be a true reflection of the cultural and linguistic community it serves. There are no staffing needs incorporated into this proposal, as all staffing needs are met by the District. However, the extensive nature of the proposed projects and initiatives preclude their funding through traditional sources. Outside of non - traditional funding, this grant proposal for Rockbrook will not be realized. This funding request is submitted with a goal of enhancing literacy and technology education at Marshall Durham Middle School (MDMS). Currently, MDMS has seventh period activity classes Monday, Wednesday, and Friday of each week. During this activity period, teachers focus instruction on targeted TAKS (Texas Assessment of Knowledge and Skills) objectives to ensure student success. All MDMS students receive this supplemental instruction time during the school day. The student population of MDMS is 793 with the following student population in each respective grade level: • Sixth Grade 271 • Seventh Grade 259 • Eighth Grade 263 In addition to the activity time, MDMS teachers also hold "Reading Camp" prior to the TAKS test in the spring. Students who are considered "at risk" or have failed the TAKS Reading test in the past are pulled during their 7t period class time for the two months prior to the TAKS Reading test and tutored based on specific areas of need. 6 Currently, students are reading high-interest passages and doing targeted comprehension questions independently. The proposal includes purchasing digital projectors. The ability to project passages and questions enables teachers to better guide class discussions and more effectively evaluate student comprehension of the targeted TAKS objectives. The cost of these tools is approximately $14,000.00. When students are actively involved in discussions and sharing strategies, the level of comprehension is increased, which will, in turn, increase test scores not only on the Reading TAKS but also on all parts of the TAKS test that involve reading comprehension. The proposed digital projectors will provide interactive learning opportunities for the students at MDMS. Additional forms of learning opportunities are critical to keeping middle school students interested and involved in the learning process. This tool also allows for many different varieties of curriculum and teaching tools to be integrated. Essentially, anything that can be done on a computer can be done with a digital projector, except the projector allows for the entire class to view and interact together. The timeline for utilizing the projectors would span the entire school year on Mondays, Wednesdays, and Fridays and during Reading Camp for the targeted students eight weeks prior to the TAKS Reading test. According to the 2004 -2005 TAKS results, areas of concern for MDMS are economically disadvantaged students and minority subgroups. The proposal is an expansion of the project funded by the CEDC in 2004 -05. Last year, four SmartBoards were purchased using both CEDC and campus monies. The SmartBoard/projector combination allows the teacher to scan or type any needed materials into the computer and show them life -size to the students. This combination of technology offers endless possibilities. However, the extensive nature of the proposed project precludes its funding through traditional sources. Additionally, there are no staffing needs incorporated into this proposal, as all staffing needs are met by the District. SECTION III: PROPOSED BUDGET The Rockbrook budget is proposed in two components: the foreign language program expansion and the literacy initiative. The following is the proposed budget for Marshall Durham Middle School. All items will be purchased immediately upon receipt of the grant monies from CEDC and the processes for monitoring and assessing the impact of the acquisitions will be instituted. The total amount requested from CEDC by the Lewisville ISD is $29,693.36. As school budgets become increasingly tight, the availability of outside funding becomes a necessary tool in our ability to provide academic and cultural enrichment. 10 SECTION IV: PROJECT MEASUREMENT AND EVALUATION The following is the measurement and evaluation portion for the expansion of the foreign language component of the Rockbrook project. Approximately 675 students will receive instruction school - wide (grades K -5) on a six-day rotation throughout the school year. Students should continue enjoying learning Spanish and learning to appreciate other cultures. The teacher will continue to acquire new skills to facilitate the cultural activities supported by the grant proposal. The goal is to have a special, cultural event at the end of the school year that includes a performance showcasing the authentic costumes. The staging of the performance will demonstrate the success of the additional cultural components supported by the grant assistance. The dollar amount per student proposed on the foreign language project is $2.96. Students will have the opportunity to rate the new materials acquired with CEDC assistance. The rating will take place in the spring 2006. The Spanish teacher will conduct an informal survey (verbal) with the students. The Spanish teacher will collect the data and organize it for reporting. The following is the measurement and evaluation portion for the literacy initiative for the Rockbrook project. Approximately 675 students (grades K -5) will have access to the school library throughout the school year. Grades Kindergarten through Fourth will have a designated rotation through the library and interaction with the Librarian. Standards of measurements that indicate success of the project will be the increased numbers of books on loan (circulation numbers), increased teacher loans to the classroom, and informal surveys of teachers and parents regarding the collection. Participation in special cultural events orchestrated by the library, showcasing the 11 diversity of the collection, will be recorded through a visitor's log and informal responses solicited from the participants. The dollar amount per student proposed for the literacy initiative is $20.74. The following is the measurement and evaluation portion for the Marshall Durham Middle School (MOMS) project. All MOMS students (793) will receive instruction school -wide (grades 6 -8) three times per week, utilizing the projectors on a rotating basis each Monday, Wednesday, and Friday throughout the school year. Based on current school enrollment, the approximate dollars per student on this proposed project is $17.27. Student TAKS (Texas Assessment of Knowledge and Skills) scores, which will be released in late May of 2005, will reflect the effectiveness of the program.
