AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING SECTION
8-5-3 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL PRESCRIBING
THE USE OF AND SPECIFICATIONS FOR TEMPORARY BARRICADES, ONE-WAY
STREET DESIGNATION SIGNS, AND OTHER TEMPORARY WARNING DEVICES, TO
MINIMIZE TRAFFIC CONGESTION DURING HOLIDAY SEASONS BECAUSE OF
CHRISTMAS OR OTHER HOLIDAY DECORATIONS AND DURING SPECIAL EVENTS
THAT INVOLVE PUBLIC STREETS; AUTHORIZING THE CITY ENGINEER TO
PRESCRIBE SUCH TRAFFIC CONTROL DEVICES; PROVIDING THAT THE CHIEF OF
POLICE IS AUTHORIZED TO INVESTIGATE THE PUBLIC STREETS WITHIN THE CITY
WHERE, BECAUSE OF CHRISTMAS OR HOLIDAY DECORATIONS OR ACTIVITIES
IN CONNECTION WITH SPECIAL EVENTS, PARTICULAR TRAFFIC HAZARDS AND
TRAFFIC CONGESTION MAY OCCUR; PROVIDING THAT THE CHIEF OF POLICE IS
AUTHORIZED TO PLACE AND MAINTAIN SUCH TEMPORARY TRAFFIC CONTROL
DEVICES CONFORMING TO THOSE PRESCRIBED BY THE CITY ENGINEER ON THE
PUBLIC ROADWAYS WITHIN THE CITY WHERE SUCH TRAFFIC HAZARDS AND
TRAFFIC CONGESTION MAY RESULT DURING HOLIDAY SEASONS OR IN
CONNECTION WITH SPECIAL EVENTS; PROVIDING THAT A PERSON COMMITS AN
OFFENSE IF HE FAILS TO COMPLY WITH SUCH TRAFFIC CONTROL DEVICES;
PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED
THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE; AND
PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1: AMENDING SECTION 8-5-3 OF CHAPTER 8 OF THE CODE
OF ORDINANCES OF THE CITY OF COPPELL
Section 8-5-3 of Chapter 8 of the Code of Ordinances of the City of Coppell is
hereby amended to read as follows:

"Sec. 8-5-3 ONE-WAY STREETS DURING CHRISTMAS OR OTHER HOLIDAY
SEASON
A. AUTHORITY TO PRESCRIBE
The City Engineer is authorized to prescribe for public streets within
the city, temporary barricade specifications, one-way street
designation signs, no parking signs and other warning devices,
conforming to the "Manual on Specifications" approved by the State
Highway Commission, necessary to minimize traffic hazards and
congestion during holiday seasons because of Christmas and other
holiday decorations and where special events are conducted under
the provisions of Adicle 6-5 of this code. Such traffic control devices
to be used to alert the public, reduce traffic hazards and control the
flow of traffic during the hours of the day or night when such devices
are installed or erected on the public streets of the city during such
holiday seasons or special event.
B. AUTHORITY TO INSTALL
1. Each year during the holiday season the Chief of Police is authorized
investigate the public streets within the City where because of
Christmas or holiday decorations, particular traffic hazards and traffic
congestion may occur and is further authorized to place and maintain
or cause to be placed or maintained, temporary barricades, one-way
street designation signs, no parking signs and other warning devices,
conforming to those prescribed by the City Engineer, on the public
streets and public roadways where such traffic hazards and traffic
congestion may result from traffic generated by viewers of the
holiday decorations.
2. In connection with the application for a Special Event Permit
pursuant to the provisions of Article 6-5 of this code the Chief of
police is authorized investigate the public streets within the City
where because of such special event temporary barricades, one-way
street designation signs, no parking signs and other warning devices,
will be needed and to cause such traffic control devices, conforming
to those prescribed by the City Engineer, to be erected and
temporarily maintained during the time of the Special Event.
C. FAILURE TO COMPLY AN OFFENSE
A person commits an offense if he, while driving a motor vehicle on
a public street within the city, fails to comply with the traffic

barricades, one-way street designation signs, or other warning
devices installed, occupying, or controlling, such public street
pursuant to the provisions of this section, during the hours such
traffic and control barricades, one-way street signs, no parking signs
or other warning devices, are erected.
D. AUTHORIZED INSTALLATION PRESUMED
In any prosecution for violation of this section the authorized
installation of a street barricade, one-way street sign or other
warning device or signal shall be presumed.
E. INTERFERENCE WITH BARRICADES, ONE-WAY
STREET SIGNS, AND OTHER WARNING DEVICES
A person commits an offense if, without lawful authority, he alters,
attempts to alter, defaces, injures, knocks down, or removes any
traffic control device, barricade, detour sign, warning sign, or one-
way street designation sign or no parking sign (whether permanent
or temporary)."
SECTION 2. REPEALING CLAUSE
All parts of ordinances inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance shall
be adjudged invalid or held unconstitutional, the same shall not affect the validity of this
ordinance as a whole or any part or provision thereof, other than the part so decided to
be invalid or unconstitutional.
SECTION 4. PENALTY CLAUSE
Any person, firm or corporation violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and, upon conviction shall be punished by a
penalty of fine not to exceed the sum of Five Hundred Dollars ($500.00) for each offense
and each and every day such offense is continued shall constitute a new and separate
offense.

SECTION 5. EFFECTIVE DATE
This ordinance shall take effect immediately from and after the publication of its
caption, as the law in such cases provides.
