BM 2010-03-18 PZMINUTES OF MARCH 18, 2010 CITY OF COPPELL PLANNING AND ZONING COMMISSION The Planning and Zoning Commission of the City of Coppell met in pre- session at 6:00 p.m., and in regular session at 6:30 p.m., on Thursday, March 18, 2010, in the Council Chambers of Coppell Town Center, 255 Parkway Boulevard, Coppell, Texas. The following Commissioners were present: COMMISSIONERS: GREGORY FRNKA CHAIR AARON DUNCAN CHARLES SANGERHAUSEN ANNA KITTRELL Also present was Planning Director, Gary Sieb; Assistant Planning Director, Marcie Diamond; Civil Engineer, George Marshall; Graduate Engineer, Michael Garza; Chief Building Official, Michael Arellano and Planning Secretary, Juanita Miles. Commissioners Haas, Tankersley and Jett were not present. PRE SESSION: (Open to Public) 1. Briefing on the Agenda. The Planning Commission was briefed on each posted agenda item in a Workshop Session. No vote was taken on any item discussed. REGULAR SESSION: (Open to Public) 2. Call to Order. Chairman Frnka called the meeting to order. 3. Consider approval of the minutes for February 18, 2010. Commissioner Sangerhausen made a motion to approve the minutes for February 18, 2010, as written. Commissioner Kittrell seconded; motion carried (4 -0) with Commissioners Frnka, Sangerhausen, Duncan and Kittrell voting in favor. None opposed. 4. CONTINUED PUBLIC HEARING: Consider approval of Case No. S- 1251- SF -12, St. Andrews Estates, Lot 5, Block 1, a zoning change request from SF -12 (Single Family -12) to S -1251- SF-12 (Special Use Permit 1251 Single Family -12), to allow 100% stucco finish in lieu of 80% masonry for the residence proposed to be constructed on approximately 0.33 of an acre of property located at 620 Inglenook Court, at the request of Terry Holmes, The Holmes Builders. STAFF REP.: Gary Sieb P82MINUTES 03182010 Page 1 of 7 Presentation: Director of Planning, Gary Sieb introduced this continued case from the meeting on February 18, 2010, to the Commission showing exhibits, color board, renderings and elevations. He mentioned that 16 notices were mailed to property owners within 200 feet of this request, two responses returned in favor and one in opposition. He stated staffs recommendation for approval subject to conditions modified by the Commission, which he read into the record. Terry Holmes, The Holmes Builders, 510 Country Lane, Coppell, Texas, was present to represent this case before the Commission, to address any questions and stated he was not in agreement to the first condition of revising the vault and shed roof forms; but he was in agreement to the second condition as staff recommended. Public Hearing: Chairman Frnka opened the Public Hearing, asking for people who wanted to speak in either favor or opposition or wanted to comment on this request to come forward. No one spoke. Chairman Frnka closed the public hearing. Action: Commissioner Kittrell made a motion to approve Case No. S 1251 SF 12, St. Andrews Estates, Lot 5, Block 1, a zoning change from SF -12 (Single Family 12) to S- 1251 -SF -12 (Special Use Permit 1251- Single Family -12), subject to the elimination of the condition to revise the vault and shed roof forms, adding a condition to replace front elevations with stone instead of stucco and keep the second condition to make necessary changes to the Elevations Sheet to correctly identify roofing materials and building facade material on all elevations. Commissioner Sangerhausen seconded; motion carried (4 -0) with Commissioners Frnka, Sangerhausen, Duncan and Kittrell voting in favor. None opposed. 5. PUBLIC HEARING: Consider approval of Case No. PD- 222R5 -LI, Duke Lesley Addition (Samsung), Lot 2, Block A, a zoning change request from PD- 222R3 -LI (Planned Development -222 Revision 3 -Light Industrial) to PD- 222R5 -LI (Planned Development -222 Revision 5 -Light Industrial), to revise the Detail Site Plan to allow additional fencing, two (2) guard houses, modification of existing parking configuration, a new driveway location and two compactors, one behind a screening wall on approximately 36.17 acres of property located on the north side of Dividend Drive, approximately 1,200 feet west of South Belt Line Road (240 Dividend Drive), at the request of Duke Realty, being represented by Robert Croysdale, GSR -Andre Architects. Chase Parker, GSR- Andrade Architects, 4121 Commerce Street, Ste. One, Dallas, Texas, and Adrian Kaufman, CB Richard Ellis, 1301 E. Lookout Drive, Richardson, Texas, were present to represent this case before the Commission, to address any questions and after discussion of more detail on how the parking is accommodated on the north end of the property, they stated agreement with staffs recommendations. Public Hearing: Chairman Frnka opened the Public Hearing, asking for people who wanted to speak in either favor or opposition or wanted to comment on this request to come forward. No one spoke. Chairman Frnka closed the public hearing. Action: Following review and discussion, Commissioner Sangerhausen made a motion to approve Case No. PD- 222R5 -LI, Duke Lesley Addition (Samsung), Lot 2, Block A. a zoning change from PD- 222R3 -LI (Planned Development -222 Revision 3 -Light Industrial) to PD- 222R5 -LI (Planned Development -222 Revision 5 -Light Industrial) subject to the following conditions: 1. Specify compactor size is two yards and specify width of compactor. 2. Provide more detail on how the parking is accommodated on the north end of property. 3. Indicate four compacters will be located on this site. Commissioner Duncan seconded; motion carried (4 -0) with Commissioners Frnka, Sangerhausen, Duncan and Kittrell voting in favor. None opposed. 6. PUBLIC HEARING: Consider approval of Case No. PD-171R2-HC, GTE Shared Services Addition (STMicroelectronics), Lot 1R2, Block 1, a zoning change request from PD-171R-HC (Planned Development -171 Revised Highway Commercial) to PD-171R2-HC (Planned Development -171 Revision 2- Highway Commercial), to revise the Detail Site Plan to allow a 3,300 square -foot screened mechanical yard along the southeast wall of the existing building on approximately 13.7 acres of property located at the southeast corner of S.H. 121 and Coppell Road (750 Canyon Drive), at the request of SP4 750 Canyon L.P., being represented by Jack Evans, Pacheco Koch Consulting Engineers. Central Expwy., Ste. 1000, Dallas, TX, was present to represent this case before the Commission, to address any questions and he stated agreement with staffs recommendations. Public Hearing: Chairman Frnka opened the Public Hearing, asking for people who wanted to speak in either favor or opposition or wanted to comment on this request to come forward. No one spoke. Action: Commissioner Kittrell made a motion to approve Case No. PD-171R2-HC, GTE Shared Services Addition (STMicroelectronics), Lot 1R2, Block 1, a zoning change request from PD -171 R -HC (Planned Development -171 Revised Highway Commercial) to PD-171R2-HC (Planned Development -171 Revision 2- Highway Commercial) as submitted. Commissioner Duncan seconded; motion carried (4 -0) with Commissioners Frnka, Sangerhausen, Duncan and Kittrell voting in favor. None opposed. 7. PUBLIC HEARING: Consider approval of Case No. S- 1252- SF -12, St. Andrews Estates, Lot 19R. Block 1, a zoning change request from SF -12 (Single Family -12) to S- 1252-SF-12 (Special Use Permit 1252 Single Family -12), to allow 100% stucco finish in lieu of 80% masonry for the residence proposed to be constructed on approximately 0.6 of an acre of property located at 617 Inglenook Court, at the request of Terry Holmes, The Holmes Builders. STAFF REP.: Marcie Diamond Presentation: Assistant Director of Planning, Marcie Diamond introduced this case to the Commission showing exhibits, color board, color renderings and black and white elevations. She stated staffs recommendation for approval subject to two conditions, which she read into the record. She also mentioned that 12 notices were mailed to property owners within 200 feet of this request, two responses returned in favor and none returned in opposition. Terry Holmes, The Holmes Builders, 510 Country Lane, Coppell, Texas, was present to represent this case before the Commission and to address any questions. He submitted written support from the homeowners within this subdivision, which satisfied the first condition and he stated agreement to the second condition as staff recommended. No one spoke. Chairman Frnka closed the public hearing. Action: Commissioner Sangerhausen made a motion to approve Case No. S- 1252 -SF- 12, St. Andrews Estates, Lot 19R, Block 1, a zoning change from SF -12 (Single Family 12) to S- 1252 -SF -12 (Special Use Permit 1252 Single Famil 12), subject to the following conditions: y 1. No significant written opposition being received from the property owners along Inglenook Court. 2. A notation added to the Elevation Sheet stating that "Stucco shall be cement plaster finished by hand troweling over wire lath Commissioner Kittrell seconded; motion carried (4 -0) with Commissioners Frnka, Sangerhausen, Duncan and Kittrell voting in favor. None opposed. 8. PUBLIC HEARING: Consider approval of text amendments to the Code of Ordinances Chapter 12- Zoning, ARTICLE 33. SCREENING STANDARDS Sec. 12-33-1.6, to revise to read as follows: "Refuse storage areas alley for all uses other than single family and duplex dwellings shall be visually screened by a six -foot high solid masonry fence enclosure on all sides except the side used for garbage pickup service, which shall have aates of solid s reenin material. These gates shall remain closed at all times when not in use," STAFF REP.: Marcie Diamond Presentation: Assistant Director of Planning, Marcie Diamond introduced this case to the Commission showing exhibits, and stated staffs recommendation for approval of this text amendment which she read into the record. Public Hearing: Chairman Frnka opened the Public Hearing, asking for people who wanted to speak in either favor or opposition or wanted to comment on this request to come forward. The following person spoke: Michael Arellano, City of Coppell Building Inspections, 500 Southwestern Blvd, Coppell, TX, made a presentation and stated concerns with enforcement of the provision that the gates remain closed when not in use. Chairman Frnka closed the public hearing. P&ZMINUTES 03182010 Page 5 of 7 Action: Commissioner Kittrell made a motion to approve the text amendments to the Code of Ordinances Chapter 12- Zoning, ARTICLE 33. SCREENING STANDARDS Sec. 12- 33 -1.6, to read as follows: "Refuse storage areas for all uses other than single family and duplex dwellings shall be visually screened by a six -foot high solid masonry enclosure on all sides except the side used for garbage pickup service, which shall have gates of solid screening material. These gates shall remain closed at all times when not in use." Commissioner Duncan seconded; motion carried (4 -0) with Commissioners Frnka, Sangerhausen, Duncan and Kittrell voting in favor. None opposed. 9A. Update on Council action for planning agenda items on February 23, 2010: 1. A text amendment to the Code of Ordinances Chapter 12- Zoning, to add Section 12 -32B., "Small Wind Energy Systems to establish regulations for small scale wind turbines within the City of Coppell and to amend Section 12 -30 to permit this use by Special Use Permit. 9B. Update on Council action for planning agenda items on March 9, 2010: 1. Case No. S- 1023R -R Chevron, a zoning change from S- 1023 -R (Special Use Permit 1023 Retail) to S- 1023R- Retail (Special Use Permit 1023 Revised Retail), to allow a change in use of the existing Car Wash building to a State Vehicle Inspection Station located at 101 E. Belt Line Road being the southeast corner of S. Belt Line and E. Belt Line Roads. 2. Case No., S- 1197R- PD- 133R2 -HC, Pizza Hut, a zoning change from S- 1197- PD- 133R2 -HC (Special Use Permit 1197 Planned Development -133 Revision 2- Highway Commercial) to S- 1197R -PD- 133R2-HC (Special Use Permit -1197 Revised Planned Development 133 Revision 2- Highway Commercial), to allow a restaurant (take -out and delivery only) to be located at 651 N. Denton Tap Road, Suite #130. 3. Wagon Wheel Park, Tennis Center Expansion, a site plan amendment to allow the addition of four regular -size and three half size tennis courts, an expansion to the existing pro shop to include tennis equipment sales, two bleacher shade canopies, a storage building, a pavilion and additional walkways located at 950 Creekview Drive. 4. An Ordinance for Case No. S- 1250 -PD- 228 -HC, Subway, a zoning change from PD- 228 -HC (Planned Development- 228 Highway Commercial) to S- 1250 -PD- 228 -HC (Special Use Permit -1250- Planned Development- 228 Highway Commercial), to allow a restaurant with drive -thru, located at 760 N. Denton Tap Road, Suite #100. P &ZMINUTES 03182010 Page 6 of 7 9C. Director's Comments. Planning Director, Gary Sieb advised the Commission of the following Council actions: On February 23, 2010: Council denied the Small Wind Energy System text amendment. On March 9, 2010: Council held over Case No. S- 1023R -R, Chevron to the May 26, 2010 meeting because a vote was not met. Council approved all the other above mentioned cases. Planning Director, Gary Sieb finally mentioned that there will be no meeting in April due to lack of cases submitted. ADJOURNMENT 5. An Ordinance for Case No. S- 1033R3- SF -12, Manara Academy, a zoning change from S- 1033R2 -SF -12 (Special Use Permit -1033 Revision 2- Single Family -12) to S- 1033R3 -SF -12 (Special Use Permit -1033 Revision 3- Single Family -12), to allow a Charter School for Grades K -8, with an enrollment capacity of 500, to continue to occupy this building through the 2014 school year, located at 140 S.
