BM 2010-05-20 PZMINUTES OF MAY 20, 2010 The Planning and Zoning Commission of the City of Coppell met in Pre Session at 6:00 p.m., and in Regular Session at 6:30 p.m., on Thursday, May 20, 2010, in the Council Chambers of Coppell Town Center, 255 Parkway Boulevard, Coppell, Texas. The following Commissioners were present: Gregory Frnka Chair Edmund Haas Vice Chair Anna Kittrell Charles Sangerhausen Consuelo Tankersley Derek Jett Commissioner Duncan was absent. Also present were Planning Director, Gary Sieb; Assistant Planning Director, Marcie Diamond; Civil Engineer, George Marshall; Graduate Engineer, Michael Garza and Planning Secretary, Juanita Miles. PRE SESSION: (Open to the Public) 1. Briefing on the Agenda. The Planning Commission was briefed on each posted agenda item in the Workshop Session. No vote was taken on any item discussed. REGULAR SESSION: (Open to the Public) 2. Call to Order. Chairman Frnka called the meeting to order. 3. Consider approval of the minutes for March 18, 2010. Action: Commissioner Sangerhausen made a motion to approve the minutes for March 18, 2010, as written. Commissioner Kittrell seconded; motion carried (6 -0) with Commissioners Jett, Tankersley, Haas, Frnka, Sangerhausen, and Kittrell voting in favor. None opposed. 4. PUBLIC HEARING: Consider approval of Case No. PD- 209R3 -C, TownOaks Centre, a zoning change request from PD -209 -C (Planned Development- 209 Commercial) to PD- 209R3 -C (Planned Development -209 Revision 3- Commercial), to allow covered parking spaces and an enhanced entrance in the rear of the building on 8.6 acres of property located at the southeast corner of Sandy Lake Road and Denton Tap Road, at the request of Alen Hinckley, Coppell Village, Ltd. STAFF REP.: Marcie Diamond min052010 Page 1 of 5 Presentation: Assistant Planning Director, Marcie Diamond introduced this case to the Commission showing exhibits. She stated staffs recommendation for approval subject to conditions, which she read into the record. She also mentioned that 25 notices were mailed to property owners within 200 feet of this request, no responses returned in favor or in opposition. Alen Hinckley, Coppell Village, LTD, 12201 Merit Drive, Suite 170, Dallas, Texas, made his presentation before the Commission, answered questions and he agreed with all of staffs recommendations except revising the roofing material from metal to standing seam. He requested a similar roofing material in the photo exhibit presented to the Commission. Public Hearing: Chairman Frnka opened the Public Hearing, asking for people who wanted to speak in either favor or opposition or wanted to comment on this request to come forward. No one spoke. Chairman Frnka closed the public hearing. Action: Commissioner Jett made a motion to approve Case No. PD- 209R3 -C, TownOaks Centre, a zoning change request from PD -209 -C (Planned Development-209- Commercial) to PD- 209R3 -C (Planned Development -209 Revision 3- Commercial), to allow covered parking spaces and an enhanced entrance in the rear of the building on 8.6 acres of property located at the southeast corner of Sandy Lake Road and Denton Tap Road subject to the following conditions: A. Revision to the Carport Sections (Types A, B and C) to revise the labels of the roofing material from "metal" to "5V Crimp," or similar to the roofing material in the photo exhibit presented to the Commission. B. Revision to the site plan to add the note "restripe parking as indicated" to the parking area in the northwest portion of the parking lot. C. The development of these improvements shall be in accordance with the site plan, elevations, carport sections and floor plan of the rear door, as herein revised, which shall be made part of the Ordinance. Commissioner Haas seconded; motion carried (6 -0) with Commissioners Jett, Tankersley, Haas, Frnka, Sangerhausen, and Kittrell voting in favor. None opposed. 5. Consider approval of the Willow Park, Final Plat, a final plat to establish the street names, development pattern and lot layout for 24 townhouse units and three (3) common area lots on 3.81 acres of property located approximately 337 feet east of S.H. 121 along the north side of Coppell Road, at the request of Haas /Rose at Lost Creek, LLC. STAFF REP.: Gary Sieb Presentation: Planning Director, Gary Sieb introduced this case to the Commission showing exhibits and elevations. He stated staffs recommendation for approval subject to conditions, which he read into the record. min052010 Page 2 of 5 Action: Mark Haas, Haas Rose at Lost Creek, LLC, 141 Dickens Drive, Coppell, Texas, was present to represent this case before the Commission, to address any questions and he agreed with staffs recommendation; and expressed the same concerns about the two proposed street names as the Commissioners did. Commissioner Jett made a motion to approve the Willow Park, Final Plat, a final plat to establish the street names, development pattern and lot layout for 24 townhouse units and three (3) common area lots on 3.81 acres of property located approximately 337 feet east of S.H. 121 along the north side of Coppell Road subject to the following conditions: A. Define exact dimensions of 15 -foot water easement between lots 10 -11 and lots 17 -18. Show dimension on each lot. B. Show and label the 466 -foot contour line as the 100 year flood plain. C. Place a note on the plat that states wall maintenance and monument sign easements will be the responsibility of the HOA along with all common areas. D. A tree removal permit will be required prior to construction. E. Change the street names on the final plat check with Tim Oates with the Fire Department the Planning Department first before resubmittal on Wednesday, May 26, 2010. Commissioner Haas seconded; motion carried (6 -0) with Commissioners Jett, Tankersley, Haas, Frnka, Sangerhausen, and Kittrell voting in favor. None opposed. 6. Planning Director, Gary Sieb advised the Commission of the following Council actions on April 13, 2010 and May 11, 2010: A. Planning agenda items on April 13, 2010: a. Case No. PD-171R2-HC, GTE Shared Services Addition STMicroelectronics, Lot 1R2, Block 1, a zoning change from PD- 171R-HC to PD-171R2-HC, to allow a 3,300- square -foot screened mechanical yard along the southeast wall of the existing building on property located at the southeast corner of S.H. 121 and Coppell Road at 750 Canyon Drive. b. Case No. PD- 222R5 -LI, Duke Lesley Addition Samsung, Lot 2, Block A, a zoning change from PD- 222R3 -LI to PD- 222R5 -LI, to allow additional fencing, two (2) guard houses, modification of existing parking configuration, a new driveway location and two compactors, one behind a screening wall on property located at 240 Dividend Drive. c. Case No. S- 1251- SF -12, St. Andrews Estates, Lot 5, Block 1, a zoning change from SF -12 (Single Family -12) to S- 1251 -SF -12 (Special Use Permit 1251 Single Family -12), to allow stucco finish in lieu of 80% masonry for the residence to be constructed on property located at 620 Inglenook Court. d. Case No. S- 1252- SF -12, St. Andrews Estates, Lot 19R, Block 1, a zoning change request from SF -12 (Single Family -12) to S- 1252 -SF- min052010 Page 3 of 5 12 (Special Use Permit 1252 Single Family -12), to allow 100% stucco finish in lieu of 80% masonry for the residence to be constructed on property located at 617 Inglenook Court. e. A text amendment to Chapter 12, of the Zoning Ordinance, ARTICLE 33. SCREENING STANDARDS Sec. 12- 33 -1.6, to revise to read as follows: "Refuse storage areas for all uses other than single family and duplex dwellings shall be visually screened by a six -foot high solid masonry enclosure on all sides except the side used for garbage pickup service, which shall have gates of solid screening material. These gates shall remain closed at all times when not in Of use. f. An Ordinance for Case No., S- 1023R -R Chevron, a zoning change from S- 1023 -R to S- 1023R -R, to allow a change in use of the existing Car Wash building to a State Vehicle Inspection Station located at 101 E. Belt Line Road. g. An Ordinance for Case No., S- 1197R- PD- 133R2 -HC, Pizza Hut, a zoning change from S- 1197- PD- 133R2 -HC to S- 1197R- PD- 133R2 -HC, to allow a restaurant (take -out and delivery only) to be located at 651 N. Denton Tap Road, Suite #130. B. Planning agenda items on Mav 11, 2010: a. An Ordinance for Case No. PD-171R2-HC, GTE Shared Service Addition (STMicroelectronics), Lot 1R2, Block 1, a zoning change from PD-171R-HC to PD-171R2-HC, to allow a 3,300- square -foot screened mechanical yard along the southeast wall of the existing building located at 750 Canyon Drive. b. An Ordinance for Case No. PD- 222R5 -LI, Duke Lesley Addition Samsung, Lot 2, Block A, a zoning change from PD- 222R3 -LI to PD- 222R5-LI, to allow additional fencing, two (2) guard houses, modification of existing parking configuration, a new driveway location and two sets of compactors, with one set behind a screening wall, on property located at 240 Dividend Drive. c. An Ordinance for Case No. S- 1251- SF -12, St. Andrews Estates, Lot 5, Block 1, a zoning change from SF -12 to S- 1251- SF -12, to allow stucco finish in lieu of 80% masonry for the residence to be constructed at 620 Inglenook Court. d. An Ordinance for Case No. S- 1252- SF -12, St. Andrews Estates, Lot 19R, Block 1, a zoning change from SF -12 to S- 1252- SF -12, to allow 100% stucco finish in lieu of 80% masonry for the residence to be constructed at 617 Inglenook Court. e. An Ordinance for a text amendment amending Chapter 12, of the Zoning Ordinance, Article 33 Screening Standards, Section 1, Location of Required Screening, by repealing and replacing Subsection 6, Refuse Storage Areas, in its entirety; by moving the provisions currently provided in Subsection 6(A) and 6(B) to a new Subsection 7(A) and 7(B), to provide for screening of ground and wall mounted mechanical and utility equipment and roof mounted min052010 Page 4 of 5 utility and mechanical equipment; and by moving the current Subsection 7 to Subsection 9 to provide for screening in subdivisions wherein the rear yards of Single Family, Two Family, or Townhouse Residential Lots is adjacent to dedicated roadway or separated from a roadway by an alley or service road. f. An Ordinance for a text amendment amending Chapter 12, of the Zoning Ordinance, No. 91500 Articles 20, 21, 22, 23, 24, and 27, by adding Sections 12 -20 -7, 12 -21 -7, 12 -22 -7, 12 -23 -7, 12 -24 -7 and 12- 27-7, to regulate Outside Storage and Display in the respective zoning districts; by amending Article 42 Special Definitions by repealing and replacing the definition of Outside Storage Display, Retail Stores Shops. g. An Ordinance for a text amendment amending Chapter 2, of the Code of Ordinances, "Boards and Commissions Article 2 -1, "Library Board Section 2 -1 -3, "Officers and Article 2 -2, "Parks and Recreation Board Section 2 -2 -3, "Officers by amending subsection A in each article by repealing the provision limiting the holding of office for two consecutive terms and allowing one term to elapse to be eligible for re- election for the officers of said Boards and Commissions; by amending Article 2-4, "Planning and Zoning Commission Section 2-4 -3, "Officers by repealing subsection B in its entirety and renumbering accordingly.
