BM 2010-06-17 PZMINUTES OF JUNE 17, 2010 The Planning and Zoning Commission of the City of Coppell met in Pre -Session at 6:00 p.m., and in Regular Session at 6:30 p.m., on Thursday, June 17, 2010, in the Council Chambers of Coppell Town Center, 255 Parkway Boulevard, Coppell, Texas. The following Commissioners were present: Gregory Frnka — Chair Edmund Haas — Vice Chair Aaron Duncan Anna Kittrell Consuelo Tankersley Derek Jett Commissioner Sangerhausen was absent. Also present were Gary Sieb, Director of Planning; Marcie Diamond, Assistant Director of Planning; George Marshall, Civil Engineer; Michael Garza, Graduate Engineer; Tim Oates, Deputy Chief/Prevention and Juanita Miles, Planning Secretary. PRE -SESSION: (Open to the Public) 1. Briefing on the Agenda The Planning Commission was briefed on each posted agenda item in the Workshop Session. No vote was taken on any item discussed. REGULAR SESSION: (Open to the Public) 2. Call to Order. Chairman Frnka called the meeting to order. 3. Consider approval of the minutes for May 20, 2010. Action: Commissioner Haas made a motion to approve the minutes for May 20, 2010, as written. Commissioner Jett seconded; motion carried (6-0) with Commissioners Jett, Tankersley, Haas, Frnka, Duncan and Kittrell voting in favor. None opposed. 4. PUBLIC HEARING: Consider approval of Case No.S-1093R-C. Taco Bell, zoning change request from S -1093-C (Special Use Permit -1093 -Commercial) to S -1093R -C (Special Use Permit -1093 Revised — Commercial), to permit the addition of a drive-thru entry portal, an order point canopy and the replacement of the existing menu board on approximately one acre of property located at 115 North Denton Tap Road, at the request of Taco Bell of America, Inc., being represented by Rose Guarneri, Turner Sign Systems, Inc. STAFF REP.: Marcie Diamond min061710 Page 1 of 6 Presentation: Assistant Planning Director, Marcie Diamond introduced this case to the Commission showing exhibits. She stated staffs recommendation for approval is subject to one condition, which she read into the record. She also mentioned that ten notices were mailed to property owners within 200 feet of this request, no responses returned in favor or in opposition. Paul E. Stich, Taco Bell, 1210 O'Shannon Turner Sign Systems, 2830 Beach Street represent this case before the Commission, agreement with staffs recommendation. Public Hearing: Lane, Garland, Texas and Rose Guarneri, #2, Haltom City, Texas, were present to to address any questions and stated their Chairman Frnka opened the Public Hearing, asking for people who wanted to speak in either favor or opposition or wanted to comment on this request to come forward. No one spoke. Chairman Frnka closed the public hearing. Action: Commissioner Haas made a motion to approve Case No. S -1093R -C, Taco Bell, a zoning change request from S -1093-C (Special Use Permit -1093 -Commercial) to S - 1093R -C (Special Use Permit -1093 Revised — Commercial), to permit the addition of a drive-thru entry portal, an order point canopy and the replacement of the existing menu board located at 115 North Denton Tap Road, with the condition that the development of these improvements shall be in accordance with the Site Plan, Menu Board, Order Point Canopy and Entry Portal which shall be made part of the ordinance. Commissioner Kittrell seconded; motion carried (6-0) with Commissioners Jett, Tankersley, Haas, Frnka, Duncan and Kittrell voting in favor. None opposed. 5. PUBLIC HEARING: Consider approval of the residential replat of Lot 18, from 50 feet to 30 feet and acres of property located Jennifer Dempsey, being Brown. STAFF REP.: Gary Sieb Presentation: Carter Addition, Lot 18R, Block 1, Replat, being a Block 1, to allow a reduction of the front building line to grant a variance to the alley requirement on 0.743 at 509 East Bethel School Road, at the request of represented by John Margotta, Baird, Hampton & Planning Director, Gary Sieb introduced this case to the Commission showing exhibits. He mentioned that eight notices were mailed to property owners within 200 feet of this request, no responses returned in favor or in opposition. He stated staff's recommendation to deny the 30 -foot building line request for reasons which he read into the record. With regard to the alley elimination request, there are no alleys within this residential area, therefore, he stated staff would support the elimination of the alley requirement. min061710 Page 2 of 6 Mark Dempsey, 509 E. Bethel School Road, Coppell, Texas was present to represent this case and made a presentation before the Commission, addressed questions and stated he did not agree with staffs recommendation to deny the 30 -foot building line request. Public Hearing: Chairman Frnka opened the Public Hearing, asking for people who wanted to speak in either favor or opposition or wanted to comment on this request to come forward. No one spoke. Chairman Frnka closed the public hearing. Action: Commissioner Jett made a motion to deny the Carter Addition, Lot 18R, Block 1, Replat, as recommended by staff. Commissioner Haas seconded; motion carried (6-0) with Commissioners Jett, Tankersley, Haas, Frnka, Duncan and Kittrell voting in favor. None opposed. At the Commission's request, the processing fees will be waived upon the applicant's resubmittal of a revised replat document. 6. Consider approval of the Denton Creek (& Sandy Lake Addition, Lots 1 & 2, Block A. Minor Plat, a minor plat to allow the construction of a single-family home on Lot 1 and the future construction of an office building on Lot 2, on 2.36 acres of property located on the north side of Sandy Lake Road, approximately 600 feet west of Starleaf Road, at the request of Dheeraj & Kavita Akula being represented by Robert Schneeberg, Gonzalez & Schneeberg. STAFF REP.: Gary Sieb Presentation: Planning Director, Gary Sieb introduced this case to the Commission showing exhibits. He stated staffs recommendation for approval subject to conditions, which he read into the record. Robert Schneeberg, Gonzalez & Schneeberg, 660 N. Central Expwy., Ste. 250, Plano, Texas, was present to represent this case, to address any questions and he agreed with staffs recommendations. Action: Commissioner Jett made a motion to approve the Denton Creek Cad Sandy Lake Addition, Lots 1 & 2, Block A. Minor Plat, a minor plat to allow the construction of a single-family home and the future construction of an office building located on the north side of Sandy Lake Road, approximately 600 feet west of Starleaf Road, with the following conditions: 1. Provide a 15 -foot wide stamped concrete paver band at entrance to the residential lot. (This condition will be reduced to an eight -foot paver band at Council) 2. Applicant understands a revised Planned Development for Lot 2 will be required, as well as a replat, before any construction can begin on this Lot. min061710 Page 3 of 6 Commissioner Haas seconded; motion carried (6-0) with Commissioners Jett, Tankersley, Haas, Frnka, Duncan and Kittrell voting in favor. PUBLIC HEARING: Consider approval of Case No. S -1220R -TC, Verizon Wireless, zoning change request from S -1220 -TC (Special Use Permit -1220 -Town Center) to S -1220R -TC (Special Use Permit -1220 Revised -Town Center), to allow the replacement of existing telecommunication antennae and the expansion of the equipment cabinet enclosure on property located at 363 North Denton Tap Road in Andy Brown West Park, at the request of Verizon Wireless, being represented by Bill Bauman, Bauman Consultants. STAFF REP.: Matt Steer Presentation: City Planner, Matt Steer introduced this case to the Commission showing exhibits and elevations. He mentioned that 23 notices were mailed to property owners within 200 feet of this request, no responses returned in favor or in opposition. He stated staffs recommendation is for approval subject to conditions, which he read into the record. Bill Bauman, 2300 Springmere Drive, Arlington, Texas, was present to represent this case, to address any questions and he agreed with staffs recommendations. Public Hearing: Chairman Frnka opened the Public Hearing, asking for people who wanted to speak in either favor or opposition or wanted to comment on this request to come forward. No one spoke. Chairman Frnka closed the public hearing. Action: Commissioner Haas made a motion to approve Case No. S -1220R -TC, Verizon Wireless, a zoning change request from S -1220 -TC (Special Use Permit -1220 -Town Center) to S -1220R -TC (Special Use Permit -1220 Revised -Town Center), to allow the replacement of existing telecommunication antennae and the expansion of the equipment cabinet enclosure located at 363 North Denton Tap Road in Andy Brown West Park, with the following conditions: 1. Coordinate with the Parks Department for the scheduling of construction times and the replacement of the Red Bud tree and portion of the irrigation system affected by the proposed change. 2. Label the proposed gate and brick color on the elevation sheets as "to match the existing brick". Commissioner Duncan seconded; motion carried (6-0) with Commissioners Jett, Tankersley, Haas, Frnka, Duncan and Kittrell voting in favor. None opposed. 8. PUBLIC HEARING: Consider approval of Case No. PD -237R -HC, QuikTrip, a zoning change request from A (Agriculture) to PD -237R -HC (Planned Development -237 Revised -Highway Commercial) to attach a detail site plan to allow a 4,900 -square -foot convenience min061710 Page 4 of 6 store with eight gas pump islands on 2.03 acres of land located at the northeast corner of South Belt Line Road and the proposed extension of Dividend Drive, at the request of QuikTrip, being represented by J.D. Dudley. STAFF REP.: Matt Steer Presentation: City Planner, Matt Steer introduced this case to the Commission showing exhibits and elevations. He stated staffs recommendation is to deny this request for reasons he read into the record. He mentioned that four notices were mailed to property owners within 200 feet of this request, no responses returned in favor; one response returned in opposition. The reason for opposition read into the record was, "I don't think that the land use fits the development plan for this area. There is a office building west of this site and we own land north and west of this site that will be office/commercial signed H. Billingsley". Kristy Eliott, QuikTrip, 1120 N. Industrial Blvd., Euless, Texas, made a presentation before the Commission, answered questions and stated she did not agree with all of staffs reasoning. Todd Jones, Republic Property Company, 314 Fairview Court, Coppell, Texas, was present to represent the property owner and addressed questions from the Commission. Public Hearing: Chairman Frnka opened the Public Hearing, asking for people who wanted to speak in either favor or opposition or wanted to comment on this request to come forward. No one spoke. Chairman Frnka closed the public hearing. Action: Commissioner Kittrell made a motion to deny Case No. PD -237R -HC, QuikTrip, a zoning change request from A (Agriculture) to PD -237R -HC (Planned Development -237 Revised -Highway Commercial), to allow a 4,900 -square -foot convenience store with eight gas pump islands. Commissioner Haas seconded; motion carried (5-1) with Commissioners Jett, Haas, Frnka, Duncan, and Kittrell voting in favor. Commissioner Tankersley opposed. 9. Update on Council actions for planning agenda items on June 8, 2010: A. Case No. PD -209R3 -C, TownOaks Centre, a zoning change request from PD -209-C to PD -209113-C, to allow covered parking spaces and an enhanced entrance in the rear of the building on property located at the southeast corner of Sandy Lake Road and Denton Tap Road. B. Willow Park Final Plat, to establish the street names, development pattern and lot layout for 24 townhouse units and three (3) common area lots on property located east of S.H. 121 along the north side of Coppell Road. During the Pre -Session, Planning Director, Gary Sieb advised the Commission of Council's actions on June 8, 2010 that both of the above-mentioned items were approved. min061710 Page 5 of 6 10. Director's Comments. Mr. Sieb mentioned the term expirations of three (3) Commissioners in December. Those wishing to apply, need to obtain a new application from the City Secretary's office.
