OR 99-877 Designates director of traffic control AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 99877 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 8, ARTICLE 8-2, SECTIONS 8-2-4, 8-2-5 AND 8-2- 10 OF THE CODE OF ORDINANCES; DESIGNATING THE DIRECTOR OF TRAFFIC CONTROL; REGULATING TRAFFIC CONTROL DEVICES; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Code of Ordinances of the City of Coppdl, Texas, be and the same is hereby amended by amending Section 8-2-4 to read as follows: "See. 8-2-4 DIRECTOR OF TRAFFIC CONTROL in absence of specific appointment, the City Engineer or his designee shall be the Director of Traffic Control." SECTION 2. That the Code of Ordinances of the City of Coppell, Texas, be and the same is hereby amended by ranending Section 8-2-5 to read as follows: "All traffic control devices erected. installed, and maimained within the City shall, pursuant to TEX. TRANS. CODE §544.001, confog with the Texas Manual on Uniform Traffic Control Devices for Streets and Highways. Volumes I and I1, as the same shall from time to time be amended (hereinafter called the Manual)." SECTION 3. That the Code of Ordinances of the City of CoppelL Texas, be and the same is hereby mended by andending Section 8-2-10 to read as follows: "See. 8-2-10 DUTY TO ERECT (a) The Director of Traffic Control shall determine the necessity for erecting, installing, and maintaining all traffic control devices within the City. Such determination shall be coasistent with the above-mentioned Manual (Texas Manual on Uniform Traffic Control Devices for Streets and Highways, Volumes I and 1[), Chapter 544 of the Texas Transportation Code. as amended. and based upon a traffic engineering investigation covering all Page - 1 - ss25476 relevant facts and in conformance with accepted engineering criteria. The Director of Traffic Control shall erect, install, and maintain all traffic control devices within the City, or cause the same to be done, in accordance with this Chapter and the Texas Transportation Code. Whenever the Director of Traffic Control has erected and installed an official traffic control device at any location within the City, or has caused the same to be done under his or her direction, he or she shall thereafter file a written report with the City Secretary stating the type of traffic control device, sign or signal, and when and where the same was erected and installed. The City Secretary shall file and maintain such report of the Director of Traffic Control as a part of the official papers of the office of the City Secretary. (b) The Director of Traffic Control may cause to be removed any traffic control device within the City which is determined by the Director of Traffic Control to no longer be needed for the safety or welfare of the citizens of the City. The Director of Traffic Control shall notify the City Secretary in writing of the removal of a traffic control device to cause the removal of the written report as provided herein. (c) All existing traffic control devices which have, previous to the enactment of this Ordinance, been erected, placed or installed, the City are deemed to comply with the provisions of this Chapter, as herein amended, and to be consistent with Chapter 544 of the Texas Transportation Code." SECTION4. That all provisions ofthe Code ofOrdinances ofthe City ofCoppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 5. That should any word, phrase, paragraph, section or phrase of this ordinance or of the Code of Ordinances, as amended hereby, be held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not aflbct the validity of the Code of Ordinances as a whole. That an oflbnse committed before the effective date of this ordinance is govemed by prior law and the provisions of the Code of Ordinances, as amended, in effect when the offense was committed and the former law is cominued in effect for this purpose. SECTION 7. That this ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and charter in such cases provide.
