The Planning and Zoning Commission of the City of Coppell met in Pre‐session at 6:00 p.m., and
in Regular session at 6:30 p.m., on Thursday, December 16, 2010, in the Council Chambers of
Coppell Town Center, 255 Parkway Boulevard, Coppell, Texas. The following Commissioners
were present:

Consuelo Rios‐Tankersley
Also present were Planning Director, Gary Sieb; Assistant Planning Director, Marcie Diamond;
Deputy Chief/Prevention, Tim Oates; Graduate Engineer, Michael Garza and Planning Secretary,
Juanita Miles.
Vice‐Chairman Haas and Commissioner Sangerhausen were absent.

1. Briefing on the Agenda
The Planning Commission was briefed on each posted agenda item in the Workshop
Session. No vote was taken on any item discussed.
REGULAR SESSION: (Open to the Public)
2. Call to Order.
Chairman Frnka called the meeting to order.
3. Consider approval of the minutes for November 18, 2010.
Commissioner Kittrell made a motion to approve the minutes for November 18, 2010,
as written. Commissioner Rios‐Tankersley seconded; motion carried (40), with
Commissioners Rios‐Tankersley, Frnka, Duncan and Kittrell voting in favor. None
opposed.
4. PUBLIC HEARING:
Consider approval of Case No. PD227R2TH1, Bellacere Addition, a zoning
change request from PD227RSF12 (Planned Development227 Revision
Single Family12) to PD227R2TH1 (Planned Development227 Revision 2
Townhouse1), to allow the construction of nine (9) singlefamily homes and
two common area lots on 1.961 acres of property, located along the north side of
Sandy Lake Road, approximately 150 feet east of Summer Place Drive, at the
request of Tom Whatley, Heritage Development Company.

Presentation:
Planning Director, Gary Sieb introduced this case to the Commission showing exhibits
and elevations. He stated staff’s recommendation for denial. He mentioned that 45
notices were mailed to property owners within 200 feet of this request; none returned
in favor, five (5) returned in opposition, one was undecided and fourteen (14) emails
were received in opposition.
David Kirch, NTS ARCHITECTS & PLANNERS, INC. (representing the applicant), 401
Business Pkwy., Richardson, Texas, presented this case before the Commission, and
addressed questions and concerns from the Commission. He was not in agreement
with staff’s recommendation.
Public Hearing:
Chairman Frnka opened the Public Hearing, asking for people who wanted to speak
either in favor or opposition or wanted to comment on this request to come forward.
The following people spoke:
Rupert Keeping, 440 Leisure Lane, Coppell, Texas, spoke in favor.
Waleed Obeid, 116 Summer Place, Coppell, Texas, spoke in opposition.
Chairman Frnka closed the public hearing.
Action:
Commissioner Kittrell made a motion to deny Case No. PD227R2TH1, Bellacere
Addition, a zoning change request from PD‐227R‐SF‐12 (Planned Development‐227
Revision‐Single Family‐12) to PD‐227R2‐TH‐1 (Planned Development‐227 Revision 2‐
Townhouse‐1), as submitted. Commissioner Rios‐Tankersley seconded; motion
carried (40), with Commissioners Rios‐Tankersley, Frnka, Duncan and Kittrell voting
in favor of denial. None opposed.
5. Consider approval of the Bellacere Addition, Preliminary Plat, to subdivide 1.96
acres of property into nine (9) singlefamily lots and two common area lots
located along the north side of Sandy Lake Road, approximately 150 feet east of
Summer Place Drive, at the request of Tom Whatley, Heritage Development
Company.

Tom Whatley, HERITAGE DEVELOPMENT (the applicant), 534 Mobley Way, Coppell,
Texas, was present to represent this case before the Commission and addressed
comments, questions and concerns from staff and the Commission. He was not in
agreement with staff’s recommendation.

Action:
Commissioner Kittrell made a motion to deny the Bellacere Addition, Preliminary
Plat. Commissioner Rios‐Tankersley seconded; motion carried (40), with
Commissioners Rios‐Tankersley, Frnka, Duncan and Kittrell voting in favor of denial.
None opposed.
6. PUBLIC HEARING:
Consider approval of Case No. PD249SF7, Royal Oaks, a zoning change request
from SF12 and O (Single Family12 and Office) to PD249SF7 (Planned
Development249Single Family7), to allow the construction of 24 singlefamily
homes on 5.16 acres of property located on the south side of Sandy Lake Road,
between Heartz Road and London Way, at the request of Tom Whatley, Heritage
Development Company.

Planning Director, Gary Sieb introduced this case to the Commission showing exhibits.
He mentioned that 45 notices were mailed to property owners within 200 feet of this
request; none returned in favor, two (2) returned in opposition, and one was
undecided. He stated staff’s recommendation for denial, but would support a revised
resubmittal in conformance with staff’s plan review statements.

(Planned Development‐249‐Single Family‐7), as submitted. Commissioner Duncan
seconded; motion carried (40), with Commissioners Rios‐Tankersley, Frnka, Duncan
and Kittrell voting in favor of denial. None opposed.
7. Consider approval of the Royal Oaks, Preliminary Plat, to subdivide 5.16 acres of
property into 24 singlefamily lots on property located on the south side of
Sandy Lake Road between Heartz Road and London Way, at the request of Tom
Whatley, Heritage Development Company.

Action:
Commissioner Kittrell made a motion to deny the Royal Oaks, Preliminary Plat.
Commissioner Duncan seconded; motion carried (40), with Commissioners Rios‐
Tankersley, Frnka, Duncan and Kittrell voting in favor of denial. None opposed.
8. Update on Council action for Planning agenda items heard on December 14,
2010:
A. Case No. PD248SF18 (CH) Carter Estates, zoning change from SF12 and
A to PD248SF18, to establish zoning which is reflective of the existing
development and lotting patterns within this 38 acres of property located
south of Bethel School Road, west of Moore Road and north of Belt Line
Road (DART ROW).
B. APPEALED Case No. PD247LI, Coppell Commerce Center Addition, Lot
3, Block 4, a zoning change request from LI to PD247LI, to allow site and
building modifications on land located at 815 S. Coppell Road.
C. APPEALED Case No. PD237R2HC, Lesley Retail, a zoning change request
from A to PD237R2HC, to attach a Concept Site Plan for hotel, office and
retail development on 28.14 acres of land located at the northeast corner
of Hackberry Drive and South Belt Line Road.
D. APPEALED Case No. PD237R3HC, QuikTrip, a zoning change request
from PD237R2HC to PD237R3HC, to attach a Detail Site Plan to allow a
4,900squarefoot convenience store with eight gas pump islands on land
located at the northeast corner of South Belt Line Road and the proposed
extension of Dividend Drive.
E. The adoption of the proposed 2030 Coppell Comprehensive Master Plan
update.
