BM 2011-03-24 PZ min032411 Page 1 of 5 MINUTES OF MARCH 24, 2011 The Planning and Zoning Commission of the City of Coppell met in Pre-session at 6:00 p.m., and in Regular session at 6:30 p.m., on Thursday, March 24, 2011, in the Council Chambers of Coppell Town Center, 255 Parkway Boulevard, Coppell, Texas. The following Commissioners were present: Gregory Frnka – Chairman Edmund Haas – Vice-Chairman Aaron Duncan Anna Kittrell Consuelo Rios-Tankersley Justin Goodale Commissioner Sangerhausen was not present. Also present were Planning Director, Gary Sieb; Assistant Planning Director, Marcie Diamond; City Planner, Matt Steer; Deputy Fire Chief/Prevention, Tim Oates; Civil Engineer, George Marshall; Graduate Engineer, Michael Garza; Economic Development Coordinator, Mindi Hurley and Secretary, Juanita Miles. ITEM # ITEM DESCRIPTION PRE-SESSION: (Open to the Public) 1. Briefing on the Agenda. The Planning Commission was briefed on each posted agenda item in the Workshop Session. No vote was taken on any item discussed. REGULAR SESSION: (Open to the Public) 2. Call to Order. Chairman Frnka called the meeting to order. 3. Consider approval of the minutes for February 17, 2011. Vice-Chairman Haas made a motion to approve the minutes for February 17, 2011, as written. Commissioner Kittrell seconded; motion carried (6-0), with Commissioners Goodale, Tankersley, Haas, Frnka, Duncan and Kittrell voting in favor. None opposed.   At this time, Vice-Chairman Haas recused himself due to a conflict of interest with the following case. 4. PUBLIC HEARING: Consider approval of Case No. PD-250-H, Old Town Addition (Main Street), a zoning change request from H (Historic) to PD-250-H (Planned Development-250- Historic), to establish a Conceptual Site/Landscape Plan for a mixed use development on 23.12 acres of property located south of Bethel Road, north of Burns Road between Hammond and South Coppell Roads, at the request of the City of Coppell, being represented by Mindi Hurley, Economic Development Coordinator. STAFF REP.: Matt Steer ITEM # ITEM DESCRIPTION   min032411 Page 2 of 5 Presentation: City Planner, Matt Steer introduced this case to the Commission with exhibits and color renderings. He stated that staff is recommending approval with no conditions. He mentioned 17 notices were mailed to property owners within 200 feet of this request, one returned in favor and none returned in opposition. Mindi Hurley, City of Coppell, 255 Parkway Blvd., Coppell Texas, was present to represent this case before the Commission, to address any questions and stated that she was in agreement with staff’s recommendation. Greg Yancey, Provident Company, Inc., Wynnpage Plaza II, 215 S. Denton Tap Rd., Coppell Texas, was present and addressed questions from the Commission. Public Hearing: Chairman Frnka opened the Public Hearing, asking for people who wanted to speak either in favor or opposition or wanted to comment on this request to come forward. No one spoke. Chairman Frnka closed the public hearing. Action: Commissioner Kittrell made a motion to approve Case No. PD-250-H, Old Town Addition (Main Street), a zoning change request from H (Historic) to PD-250-H (Planned Development-250-Historic), with no conditions. Commissioner Goodale seconded; motion carried (4-1), with Commissioners Goodale, Frnka, Duncan and Kittrell voting in favor. Commissioner Tankersley voted in opposition. Vice-Chairman Haas returned to the meeting. 5. PUBLIC HEARING: Consider approval of Case No. PD-227R3-TH-1, Bellacere Addition, a zoning change request from PD-227R-SF-12 (Planned Development-227 Revised-Single Family-12) to PD-227R3-TH-1 (Planned Development-227 Revision 3-Townhouse- 1), to allow the construction of eight (8) single-family homes and two (2) common area lots on 1.96 acres of property located along the north side of Sandy Lake Road, approximately 150 feet east of Summer Place Drive, at the request of Tommy Cansler, Timberland Creek Companies, Inc. STAFF REP.: Gary Sieb Presentation: Director of Planning, Gary Sieb introduced this case to the Commission with exhibits. He stated that staff is recommending denial based on concerns which he read into the record. He mentioned 47 notices were mailed to property owners within 200 feet of this request. One response returned in favor; two returned in opposition and one email was received in opposition prior to the meeting. ITEM # ITEM DESCRIPTION min032411 Page 3 of 5 Tommy Mann, 5400 Renaissance Tower, Dallas Texas, was present to represent the applicant for this case before the Commission, to address any questions and stated that the applicant was not in agreement with staff’s recommendation. David Kirch, NTS Architects & Planners, Inc., 698 S. Bowser, Richardson Texas, made a presentation and addressed questions and/or comments from the Commission. He also stated that he was not in agreement with staff’s recommendations. Public Hearing: Chairman Frnka opened the Public Hearing, asking for people who wanted to speak either in favor or opposition or wanted to comment on this request to come forward. The following person spoke: Tom Whatley, (Owner) Heritage Development, 530 Mobley Way, Coppell Texas spoke in favor. Chairman Frnka closed the public hearing. Action: After much discussion, Vice-Chairman Haas made a motion to leave this case open and continue the public hearing for Case No. PD-227R3-TH-1, Bellacere Addition, to the April 21, 2011, meeting. Commissioner Duncan seconded; motion carried (6-0), with Commissioners Goodale, Tankersley, Haas, Frnka, Duncan and Kittrell voting in favor. None opposed. As stated by several Commission members, the applicant was asked to consider revisions to the following:  Minimum square footage of lots (use actual minimum square footage in site summary)  Front, side and rear lots more in line with SF-7 guidelines (25 feet; 8 feet; 20 feet) 6. PUBLIC HEARING: Consider approval of the Bellacere Addition, Replat, to replat 1.96 acres of property into eight (8) single-family lots and two (2) common area lots located along the north side of Sandy Lake Road, approximately 150 feet east of Summer Place Drive, at the request of Tommy Cansler, Timberland Creek Companies, Inc. STAFF REP.: Gary Sieb Presentation: Director of Planning, Gary Sieb introduced this companion case to the Commission with exhibits. He stated that staff is recommending denial of this request. Since no action was taken on the companion zoning case, that was an additional reason for denial. Public Hearing: Chairman Frnka opened the Public Hearing, asking for people who wanted to speak either in favor or opposition or wanted to comment on this request to come forward. Gabriela Gutierrez, 840 Parkway Blvd., Coppell Texas, asked the Commission for clarification of the 30-Day Waiver. Chairman Frnka closed the public hearing. Action: Commissioner Kittrell made a motion to deny the Bellacere Addition, Replat. Commissioner Duncan seconded; motion carried (6-0), with Commissioners Goodale, Tankersley, Haas, Frnka, Duncan and Kittrell voting in favor of denial. None opposed. 7. Update on Council action for planning agenda items on March 8, 2011: A. Westfork Addition Replat, a replat of Lot 2R, Block A, to abandon an existing 15-foot wide utility easement located at 505 E. Bethel School Road. B. Case No. S-1173R, AT&T Mobility, a zoning change request from S-1173 to S-1173R, to allow the collocation of antenna on the existing monopole and additional cabinets at the base on property located at 1305 Wrangler Circle. C. Case No. PD-238R-HC, Coppell Office Village, a zoning change request from PD-238-HC to PD-238R-HC, to allow a 40-square-foot internally illuminated acrylic monument sign with a stone base on 2.02 acres of property located at 225 East S.H. 121. D. Case No. PD-249R-SF-7, Royal Oaks, a preliminary plat and zoning change request from SF-12 and O to PD-249R-SF-7, to allow the construction of 22 single-family homes located on the south side of Sandy Lake Road, between Heartz Road and London Way. E. Case No. PD-224R-HC, Northlake College, a zoning change request from PD-224-HC to PD-224R-HC, to permit a Valve Site located on the southeast side of S.H. 121, south of Sandy Lake Road. F. Carter Addition PH III, a preliminary plat, a replat of Lot 1, Block 1 of the Carter Addition and a final plat of the remaining unplatted property, to subdivide 20.28 acres of property into 24 single-family residential lots and two (2) common area lots located at 441 Carter Drive. G. Comprehensive Land Use Plan Ordinance. 8. Update on Council action for planning agenda items on March 22, 2011: A. Case No. PD-238R-HC, Coppell Office Village, a zoning change request from PD-238-HC to PD-238R-HC, to allow a 40-square-foot internally illuminated acrylic monument sign with a stone base on 2.02 acres of property located at 225 East S.H. 121. B. Comprehensive Land Use Plan Ordinance. During the Pre-Session, Planning Director, Gary Sieb advised the Commission of Council’s actions on March 8, 2011, Items A-B, and D-F were approved and Items C & G were postponed to the March 22, 2011 meeting. He advised the Commission of Council’s actions on March 22, 2011, Item A was postponed to the April 21, 2011, meeting and Item B was approved.
