BM 1992-10-15 PZMinutes of October 15, 1992 PLANNING AND ZONING COMMISSION The Planning and Zoning Commission of the City of Coppell met in pre -session at 7:00 p.m., and in regular session at 7:30 p.m., on Thursday, October 15, 1992, in the Coppell Town Center, 255 Parkway Boulevard, Coppell, Texas 75019. The following members were present: Chairman, Robert Green Commissioner, Don Meador Commissioner, Carl Thompson Commissioner, Marsha Tunnell Commissioner, Ray Hildebrand Vice -Chairman George Redford and Commissioner Melvin Gross were absent. Also present were Director of Planning & Community Services Gary L. Sieb, City Engineer Ken Griffin, P&Z Coordinator Taryon Bowman and Administrative Secretary Linda Glidewell. Chairman Green called the meeting to order and everyone was asked to stand while Commissioner Thompson gave the invocation. Item 5: Approval of Minutes of September 17, 1992 Following discussion, Commissioner Meador moved to approve the minutes of September 17, 1992, as submitted. Chairman Green seconded the motion; motion carried (4-0-1) with Chairman Green and Commissioners Meador, Thompson, Tunnell voting in favor of the motion, and Commissioner Hildebrand abstaining. Item 6: Consider approval of a final plat of Chambers Addition, located along the north side of Bethel Road, approximately 1,167 feet east of the centerline of Coppell Road, at the request of Chambers & Shafer, Inc. P&Z Coordinator Taryon Bowman introduced the item to the Commission. Ms. Bowman stated the plan for this site is a Day Care Center. She further stated that the Board of Adjustment had just recently approved a variance for a 15 foot sideyard instead of a 30 foot sideyard. Ms. Bowman then stated that the Historical Society also supports this request. Commissioner Thompson seconded the motion; motion carried (5-0) with Chairman Green and Commissioners Meador, Thompson, Tunnell and Hildebrand voting in favor of the motion. Item 7: PUBLIC HEARING: To consider approval of a zoning change, Case # S- 1062, from (C) Commercial, to (C -SUP) Commercial Special Use Permit, for the operation of a French bakery, located at 160 Denton Tap Road, Suite 4300 (Town Oaks Center), at the request of Mr. Behzad Esfahani. P&Z Coordinator Taryon Bowman introduced the item to the Commission. Ms. Bowman stated that the proposed restaurant will be 1500 square feet, and is to be located in the Town Oaks Shopping Center. She further stated that parking concerns have been taken care of. Mr. Behzad Esfahan was present to represent this item before the Commission and answer any questions. Chairman Green then opened the public hearing and asked for persons wishing to speak in favor of the request. Those persons speaking were: Lynn Dorn 606 Swan Drive He then asked for persons wishing to speak in opposition to the request. There were none. The public hearing was then declared closed. Following discussion Commissioner Tunnell moved to approve Case #S-1062 as submitted. Commissioner Meador seconded the motion; motion carried (5-0) with Chairman Green and Commissioners Meador, Thompson, Tunnell and Hildebrand voting in favor of the motion. Item 8: PUBLIC HEARING: To consider approval of a zoning change Case #ZC- 534(H), Bullock Cemetery, at the request of Mary Evelyn Mobley, from (C) Commercial, to (HD) Historic Designation, to allow a family historic cemetery, located west of Denton Tap Road, and north of Bethel School Road. Director of Planning Gary L. Sieb introduced the item to the Commission. Mr. Sieb stated that this request is located on an 11,000 square foot tract of ground located west of Denton Tap Road and north of Bethel School Road. Mr. Sieb also stated that two reply forms were returned in favor of this request. Ms. Mobley gave a brief history of the Bullock Cemetery. Chairman Green then opened the public hearing and asked for persons wishing to speak in favor of the request. Those persons speaking were: Wes Smith 529 Oak Grove Barbara Bailey 232 Plantation Noble Fortson 224 Plantation He then asked for persons wishing to speak in opposition to the request. Those persons speaking were: Bob Webb 614 Swan The public hearing was then declared closed. Following discussion Commissioner Tunnell moved to approve Case #ZC-534(H) as submitted. Commissioner Thompson seconded the motion; motion carried (5- 0) with Chairman Green and Commissioners Meador, Thompson, Tunnell and Hildebrand voting in favor of the motion. Item 9: PUBLIC HEARING: To Consider approval of a zoning change Case #ZC- 543(H), at the request of Historical Bethel Cemetery Association, from (PD -SF -9) Planned Development Single -Family -9, to (HD) Historic District, located at the east end of Christi Lane, and south of Bethel School Road. Director of Planning Gary L. Sieb introduced the item to the Commission. Mr. Sieb stated that the Historical Bethel Cemetery is already recognized by the State of Texas, and is approximately 8800 square feet in size. He further stated that there has been significant neighborhood opposition both to granting the Historic designation and also the Certificate of Appropriateness (which follows this case). Mr. Sieb then stated that 18 notices were mailed to property owners, and there were 10 notices returned in opposition to granting the Historic designation. Because of the opposition, a 3/4 vote at Council would be required for passage of this request, regardless of Commission action. Ms. Ann McNear of the Historic Bethel Cemetery Association was present to represent this item before the Commission and answer any questions. Ms. McNear gave a brief history of the Bethel Cemetery. Those persons speaking were: Mike Dorn 606 Swan Drive Lynn Dorn 606 Swan Drive The public hearing was then declared closed. Following discussion Commissioner Meador moved to approve Case #ZC-543(H) as submitted. Commissioner Tunnell seconded the motion; motion carried (5-0) with Chairman Green and Commissioners Meador, Thompson, Tunnell and Hildebrand and Gross voting in favor of the motion. Item 10: PUBLIC HEARING: To consider approval of a Certificate of Appropriateness at the request of Historical Bethel Cemetery Association, to allow a log cabin (10' X 16') to store cemetery maintenance equipment and supplies, located at the east end of Christi Lane, south of Bethel School Road. Director of Planning Gary L. Sieb introduced the item to the Commission. Mr. Sieb stated this request is to allow new construction on the Historic Bethel Cemetery site, which is allowed by the Ordinance. Again Mr. Sieb stated that there has been considerable neighborhood opposition to this request. He stated 18 notices were mailed to property owners within 200 feet of the request. Fifteen responses were returned from within the 200 feet in opposition, plus three additional xeroxed notices, also in opposition. Mr. Sieb then explained that a petition containing 36 signatures, which does include some duplicate signatures, was also submitted stating opposition to the request. Mr. Sieb then stated that because there is 20% opposition of property owners within 200 feet of the request, it will take a 3/4 vote from Council to approve this request, regardless of Commission action. Following discussion Commissioner Meador moved to deny Case #ZC-543(H). Commissioner Hildebrand seconded the motion; motion carried (5-0) with Chairman Green and Commissioners Meador, Thompson, Tunnell and Hildebrand voting in favor of the motion. DISCUSSION Item 11: General discussion concerning platting and zoning issues. A. Discuss and establish fees for the following: 1. Historic Landmark Designation/Zoning Change 2. Certificate of Appropriateness 3. Street Name Change 4. Minor/Secondary Plat 5. Other Minutes of October 15, 1992 Planning & Zoning Commission Page 6 Director of Planning Gary L. Sieb introduced the item to the Commission. Mr. Sieb stated that staff would recommend that each of these fees be established at $100.00, with the exception of the Minor/Secondary Plat Fee, which would be $100.00 + $10.00 per acre or portion thereof. Following discussion Chairman Green moved to approve the suggested fee schedule as recommended by City Staff. Commissioner Tunnell seconded the motion; motion carried (5-0) with Chairman Green and Commissioners Meador, Thompson, Tunnell and Hildebrand voting in favor of the motion. B. Other Discussion There was no other discussion. Item 12: Update on comprehensive planning process. Director of Planning & Community Services Gary L. Sieb gave the Commissioners a copy of the latest minutes of the Comprehensive Planning Committee, and stated there would be another meeting held in the coming week.
