BM 1991-05-16 PZMinutes of May 16, 1991 PLANNING AND ZONING COMMISSION The Planning and Zoning Commission of the City of Coppell met in pre -session at 6:30 p.m., and in regular session at 7:30 p.m., on Thursday, May 16, 1991, at the Coppell Town Center, 255 Parkway Boulevard, Coppell, Texas 75019. The following members were present: Chairman, Joe Munsch Vice -Chairman, Robert Green Commissioner, Charles Cotten Commissioner, Melvin Gross Commissioner, Lanny Mayo Commissioner, Marsha Tunnell Commissioner Redford was absent. Also Present were Director of Planning and Community Services Gary L. Sieb, P&Z Coordinator Taryon Bowman, City Attorney Larry Jackson and Administrative Secretary Linda Glidewell. Chairman Munsch called the meeting to order and everyone was asked to stand while Commissioner Cotten gave the invocation. Item 4: Approval of Minutes of March 21, 1991 Following discussion, Commissioner Gross moved to approve the minutes of April 18, 1991 as submitted. Commissioner Cotten seconded the motion; motion carried (6-0) with Chairman Munsch and Commissioners Mayo, Green, Tunnell Cotten and Gross voting in favor of the motion. PUBLIC HEARINGS Item 5: Consider request for a zoning change, Case #ZC-530, from (LI) Light Industrial, to (HC) Highway Commercial for the future development of Highway Commercial uses, located at the southwest corner of Coppell Road and S.H. 121, at the request of E-Systems Pool Trust. P&Z Coordinator Taryon Bowman introduced the item to the Commission. Ms. Bowman stated that this property is better suited for Highway Commercial zoning, which would allow such uses as hotels, restaurants, grocery stores, as well as low and mid -rise offices. Mr. Greg Carter of E-Systems Pool Trust was present to represent this item before the Commission and answer any questions. Minutes of May 16, 1991 Planning and Zoning Commission Page 2 Chairman Munsch then opened the public hearing and asked for persons wishing to speak in opposition to the request. There were none. He then asked for persons wishing to speak in favor of the request. Again there were none. The public hearing was then declared closed. Following discussion, Commissioner Cotten moved to approve Case #ZC-530. Commissioner Gross seconded the motion; motion carried (6-0) with Chairman Munsch and Commissioners Mayo, Green, Tunnell, Cotten and Gross voting in favor of the motion. Item 6: Consider request for a zoning change, Case #ZC-531, from (HC) Highway Commercial and (LI) Light Industrial, to (SF -12) Single -Family -12, (SF -9) Single -Family -9, and (SF -7) Single -Family -7, located on the west side of Denton Tap Road, along the north and south sides of S.H. 121 Bypass, at the request of Thompson Interests. P&Z Coordinator Taryon Bowman introduced the item to the Commission. Ms. Bowman stated that the total area of this request is 164.39 acres. Out of that total acreage, the applicant is requesting 41.2 acres be rezoned to (SF -12), 41.87 acres be rezoned to (SF -9), and 81.3 acres be rezoned to (SF -7). She further stated that all property owners within 200 feet were notified by mail, with one reply form being returned in favor of the rezoning. Ms. Bowman stated that transportation will be an important factor regarding this zoning case. Ms. Bowman then stated that the Comprehensive Plan shows this area as a mixed use area including office, retail, low to mid -rise offices and restaurant uses, but no multi -family development. Ms. Bowman then stated that if the Commission considers approval of this case, staff would request that the floodplain park area be retained, as well as the improvements to the park area. Staff is recommending denial of this request due to this area being a gateway into the City and because of its proximity to the 121 Bypass and considerable noise factors. Nathan Maier of Nathan Maier Engineers was present to represent this item before the Commission and answer any questions. Chairman Munsch then opened the public hearing and asked for persons wishing to speak in opposition to the request. There were none. He then asked for persons wishing to speak in favor of the request. Again there were none. The public hearing was then declared closed. Commissioner Tunnell seconded the motion; motion carried (6-0) with Chairman Munsch and Commissioners Mayo, Green, Tunnell, Cotten and Gross voting in favor of the motion. The Commission recessed for a short break at this time. Item 7: Consider request for a zoning change, Case #PD -117, from (MF -2) Multi -Family -2, to (PD -SF -7) Planned Development Single -Family -7, located along the west side of Harris Road, at the intersection of Bethel School Road, at the request of Matthews Investments. PU Coordinator Taryon Bowman introduced the item to the Commission. Ms. Bowman stated that staff strongly supports the down zoning of this property from multi -family to a planned development for single -family -7, especially since it would then comply with the Comprehensive Master Plan. She also stated that the zoning change would make this property compatible with the surrounding properties. Ms. Bowman stated that the developers first plan showed thirty lots, which they have revised to show twenty-eight lots. Ms. Bowman then stated that staff is recommending denial without prejudice of this zoning change due to several concerns. Those concerns include the physical design of this layout, that the developer completely ignores the existing dedication of Kaye Street to the north of this property, that the developer does not provide any alleys for the subdivision, and the awkward street intersection of Harris Road and Bethel School Road, which is not a true 90 degree intersection as required by the Subdivision Ordinance. Ms. Bowman further stated that the development lacks any type of identity such as landscaping or screening, and has not thoroughly addressed the preservation of trees, or the affect the subdivision will have on traffic in the area. Mr. Tim House, representing Matthews Investments was present to represent this item before the Commission and answer any questions. Chairman Munsch then opened the public hearing and asked for persons wishing to speak in opposition to the request. There were none. He then asked for persons wishing to speak in favor of the request. Following discussion, Commissioner Gross moved to approve Case #SPD -117 with the following conditions: 1) that the house sizes be a minimum of 1800 square feet, and 2) that lot 3 have a side entrance. Commissioner Green seconded the motion; motion carried (4-2) with Chairman Munsch and Commissioners Mayo, Green and Gross voting in favor of the motion and Commissioners Tunnell and Cotten voting against the motion. Item 8: Consider request for approval of a replat of Villages of Coppell, Phase II, Block E, Lots 11, 18, 19 and 20, for the purpose of abandoning an access easement along the rear of the lots, at the request of Westchester Homes. P&Z Coordinator Taryon Bowman introduced the item to the Commission. Ms. Bowman stated this request is actually being requested by four property owners. All property owners within 200 feet were notified by mail with three reply forms being returned in favor and one returned in opposition. Ms. Bowman then stated that the purpose of the request to abandon the access easement is so that the fences may be placed along the property line. Staff is asking that should this request be approved, that only the access portion of the easement be abandoned, as the utility portion of the easement does need to remain as is. Mr. Dan Hybel of 839 Chalfont Place was present to represent this item before the Commission and answer any questions. Chairman Munsch then opened the public hearing and asked for persons wishing to speak in opposition to the request. There were none. He then asked for persons wishing to speak in favor of the request. Again there were none. The public hearing was then declared closed. Commissioner Tunnell seconded the motion; motion carried (6-0) with Chairman Munsch and Commissioners Mayo, Green, Tunnell, Cotten and Gross voting in favor of the motion.
