AN ORDINANCE OF THE CITY OF COPPELL, TEXAS AMENDING
CHAPTER 3, SECTION 3-1-12 OF THE CODE OF ORDINANCES OF THE
CITY OF COPPELL TO ADD SUBSECTION E BY AMENDING THE
WATER USE MANAGEMENT PLAN TO IMPLEMENT A MANDATORY
DAILY WATER USE PLAN; PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT
TO EXCEED FIVE HUNDRED ($500.00) DOLLARS; AND PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That Chapter 3, Section 3-1-12 of the Code of Ordinances of the City
of Coppell, Texas, is hereby amended in part by adding a new subsection E to read as
follows:
"E. DAILY WATER USE PLAN
1. All persons using water for lawn watering, garden watering or
irrigation during the period of May 15 to September 15 of each year
shall do so in the following manner:
a) All persons with an even numbered street address must
conduct all lawn watering, garden watering or irrigation on an
even numbered calendar day.
b) All persons with an odd numbered street address must
conduct lawn watering, garden watering or irrigation on an
odd numbered calendar day. No watering will be allowed on
May 31, July 31 or August 31.
c) All irrigation of the center medians of streets or street rights-
of-way that run in a general east/west direction must be
conducted on an even numbered calendar day.
d) All irrigation of the center medians of streets or street rights-
of-way that run in a general north/south direction must be
conducted on an odd numbered calendar day. No watering
will be allowed on May 31, July 31, or August 31.
e) Golf courses and nurseries may water on odd/even calendar
days as well as between the hours of 9:00 p.m. and 9:00 a.m.
each day.
f) Variances shall be granted to persons establishing new lawns
or landscaping. All variances must be submitted in writing to
the Director of Public Works. Variances shall be in writing. A
variance may be revoked by the Director of Public Works if
the terms of the agreement are violated."
SECTION 2. All ordinances or parts of ordinances inconsistent with or in conflict
with the provisions of this ordinance are hereby repealed.
SECTION 3. If any article, paragraph, or subdivision, clause, or provision of this
ordinance shall be adjudged invalid or held unconstitutional, it shall not effect the validity
of this ordinance as whole or any part or provision thereof, other than the part so decided
to be invalid or unconstitutional.
SECTION 4. Any person, firm, or corporation violating any ofthe provisions ofthis
ordinance or of the code of Ordinances, as amended herein, shall be deemed guilty of
a misdemeanor and, upon conviction, shall be punished by a penalty of fine not to
exceed the sum of Five Hundred Dollars ($500.00) for each offense, and each and every
day such offense is continued shall constitute a new and separate offense.
SECTION 5. This ordinance shall take effect immediately from and after the
publication of its caption, as the law and charter in such cases provide.
