BM 1986-04-17 PZPLANNING AND ZONING COMMISSION Minutes of April 17, 1986 The planning and Zoning Commission of the City of Coppell met in a regular called session on Thursday, April 17, 1986 in the Coppell High School Administration Building. The pre -session began at 7:00 p.m. with the regular called session beginning at 7:30 p.m. The following members were present: R.W. Smedul, Chairman Frank Pope, Commissioner Joe Munsch, Commissioner Perry Jasiecki, Commissioner Steve Eberhardt, Commissioner Also present were Mayor Lou Duggan, City Engineer Ed Powell, City Consultant Engineer Gabe Favre, Administrative Assistant Vivyon Bowman and Secretaries Linda Grau and Linda Glidewell. PRE SESSION (Open to the public) 7:00 p.m. Item 1: Briefing on agenda A briefing on the agenda was held prior to the regular session. Following the pre -session, the meeting was called to order by Chairman Smedul who then asked for Commissioner Pope to give the invocation. Chairman Smedul stated that the minutes of March 20, 1986 should be changed to read Item 8 - vote should read 3-0 with Chairman Smedul voting in favor of the motion and Item 10 - vote should read 3-0 with Commissioner Smedul voting in favor of the motion. Commissioner Eberhardt motioned to approve the minutes of March 20, 1986 with noted changes. Motion was seconded by Commissioner Munsch; motion carried 4-1 with Commissioner Jasiecki abstaining. ZONING Item 6: Zoning Application #86-01-16 - PUBLIC HEARING To consider approval of zoning change request for J. Stephen Crim from "A" Agricultural to "LI' Light Industrial on two (2) tracts. Tract "A" located on the east side of Denton Tap Road north of Denton Creek. Tract "E" located north of Denton Creek split by proposed MacArthur Boulevard. Chairman Smedul referred to the request from Vista Mortgage and Realty, Inc. requesting a variance within the "LI" Light Industrial Zoning District referring to Section 25.2 Height Regulations and asking for the height restrictions be limited to fifty feet instead of thirty-five feet. Letters were also received from Doug Spiker of Triland, Tommy C. Wise of Wiseco Land Development, Inc. and Michael R. Allen of Univest Development Company in reference to this item. Chairman Smedul stated that this request was dated the 15th of April, 1986 and there was not adequate time to advertise this publicly, therefore, the Commissioner could not act on this particular item but would act on Item 6 stated above. Mayor Duggan asked to explain the City's position and the backrourid on the above item. Mayor Duggan stated that the City entered into an agreement with the City of Lewisville approx. 3 or 4 months ago regarding this land. He stated that there were four points he would like to make the Commissioners aware of. The agreement involves approximately fifty acres of land north of Denton Creek. The agreement was entered into between the City of Lewisville and the City of Coppell. The City of Lewisville has applied pressure to the developer to annex this land into the City of Coppell and the City of Lewisville has disannexed that land. The annexation that comes forward before the City Council on the 22nd of April, 1986 and the zoning before the Planning and Zoning Commission tonight are tied together. This was part of the agreement that they would submit an application for similar type of zoning. The political issue in previous months is an issue concerning the City of Coppell and the City of Lewisville. The developer is present tonight at the request of the City of Coppell and the City of Lewisville because part of his land is entered in that agreement and is requesting similar type of zoning. The similar zoning agreement made with the developer is that he would not be damaged by being asked or forced by the City of Lewisville to disannex part of his property and enter the City Limits of Coppell. The ETJ issue is an issue between the City of Coppell and the City of Lewisville and the developer is not involved in that issue and under the Similar Zoning agreement Mayor Duggan asked for compatable zoning and asked that the Commission consider the best use of the land. Following further discussion Mayor Duggan stated that if the zoning before the Commission is denied it will go before the City Council. If denied by the City Council the land will be annexed into the City of Lewisville and the developer will petition to be annexed back into the City of Lewisville. Mayor Duggan also stated that when this item comes before the City Council it will be for annexation into the City of Coppell and compatible zoning. After further discussion Mayor Duggan then excused himself from the meeting. Mr. Jeffrey W. Hurt representing Vista Mortgage & Realty, Inc. and J. Stephen Crim made the presentation to the Commission. Mr. Hurt introduced Stephanie Fess, Phil Deaton and Matt Mayberry. Mr. Hurt explained that Tract E was zoned "LI" Light Industrial in the the City of Lewisville and thet are asking for the same zoning in Coppell. Tract A was zoned "GB" General Business in the City of Lewisville and they are asking for "LI" Light Industrial in Coppell. Mr. Hurt referred to a copy of Restricted Covenant by Vista Ridge Project, which has more restrictions that the City of Coppell and the City of Lewisville. The tax base in the land would be approximately eighty-eight million dollars. Ms. Fess explained that Vista Ridge is requesting "LI" Light Industrial zoning because of the size of building restrictions in "C" Commercial zoning. Commissioner Munsch stated that the Commission would like to review Vista Ridge's Restricted Covenant before acting on this request. Chairman Smedul then declared the public hearing open. He then asked for those persons who wished to speak in favor of the zoning change. There were none. He then asked for those persons wishing to speak against the motion. Dawn Anders stated that she would like to know the restrictions. Mr. Hurt explained there would be no residential use of any kind, no trailer parks, mobile home parks, recreational vechicles or camp grounds, no agricultural uses of any kind, no storage, warehouseing, manufacturing or automobile sales and construction standards would have to be followed. Tom Wise referred to letter presented to the Planning and Zoning Commission. Mr. Hurt explained that "0" Office zoning does not allow Garden Apartments and planned specialty retail which is being planned for this area and this would be allowed in the "LI" Light Industrial zoning. Chairman Smedul then closed the public hearing. Following a lengthy discussion a proposal was made to provide each member of the Commission with a copy of Restricted Covenant Manual for further study and to table this zoning until May 15, 1986 which at such time the applicant will present a proposal for compatible zoning for office and retail mix and height waivers. Mr. Hurt stated that Vista Ridge will withdraw their petition for annexation and re -apply to the City in one month. Before the motion was made Commissioner Eberhardt stated that he was a former employee of Lomas & Nettleton and asked City Attorney, Larry Jackson if this would be a conflict of interest. Mr. Jackson stated that this was not a conflict of interest because Commissioner Eberhardt has no connection with the f irm or applicant at the present time and no possibility f or f inancial gain. Commissioner Munsch motioned to table this zoning change to the Planning and Zoning Commission meeting scheduled for May 15, 1986 at 7:30 p.m. Commissioner Jasiecki seconded; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. A copy of the Restricted Convenant Manual will be mailed to the Commission members. Item 7: Zoning Application #86-03-25 - PUBLIC HEARING To consider approval of a zoning change request for Fiori's Restaurant from "C-S.U.P." Commercial with a Special Use Permit for a restaurant to "C-S.U.P. - Commercial with a Special Use Permit for the inclusion of a private club, on property located on the southeast corner of Denton Tap Road and Sandy Lake Road. Donna Sloan, Manager and part owner of Fiori's Restaurant made the presentation to the Commission. Ms. Sloan stated that only beer and wine will be served at the table with dinner, there will be no mixed drinks served, and the restrictions on their lease with Univest states that there will be no bar. Ms. Sloan also stated that the restaurant would like to serve wine with dinner for fine dinning and not for drinking crowds. Chairman Smedul then opened the hearing to the public and asked for those persons wishing to speak in support of this petition. There were none. He then asked for those persons wishing to speak against this petition. Lou Brown, Pastor of the First Baptist Church of Coppell and speaking for Pastor, C.A. McBride stated that it was not in the best interest of the City, or citizens of Coppell to allow the sale and comsumption of alcohol in the City. He also stated that to allow this petition to pass would open the door for many other restaurants. Dean Wilkerson stated that this petition should be denied because of its location of being on a busy street and in a shopping center, and the closeness to the Coppell soccer fields. Pastor David Carr, First United Methodist Church asked if the City has an ordinance regulating this and made a request to deny this petition and requested the City to adopt an ordinance regulating alcohol in the City of Coppell. Chairman Smedul then closed the public hearing. Following discussion Commissioner Eberhardt proposed to table this request and stated he would volunteer his time to investigate ordinances from surrounding cities as to the negative or positive influence other cities have had and report his findings to the Commissioners. Commissioner Jasiecki motioned to approve request with stipulation that Commissioner Eberhardt requested, that there be a temporary "S.U.P." Special Use Permit for one year from the time the State of Texas authorizes Ms. Sloan to serve liquor. Commissioner Jasiecki then amended his motion for approval to incorporate the requests of his fellow Commissioners. Commissioner Munsch included that beer and wine will only be served with a meal, alcohol cannot be served without a meal, that the hours will not be later than midnight to serve alcohol. Commissioner Eberhardt added that alcohol can be served after 6 p.m. and no later than 12 midnight and that the "S.U.P." Special Use Permit be limited to six months and that the City can withdraw this permit upon a two week notice. Commissioner Jasiecki once again amended his motion to state the following; to approve the request of Fiori's Restaurant for "C" Commercial "S.U.P." Special Use Permit with the following requirements: Motion made by Commissioner Jasiecki: 1. Drinks will only be served with a meal 2. The City has the right to revoke the "S.U.P." Special Use Permit with a six month limitation with the option of renewal Commissioner Eberhardt amended the motion to include: 1. To limit sales to beer and wine only 2. That there be no open bar in the facility according to deed restrictions. Commissioner Munsch amended the motion to include: 1. Limit the hours that alcohol will be served from 11 a.m. to 12 midnight. Commissioner Eberhardt seconded the amendment made by Commissioner Munsch. Commissioner Munsch seconded the amendment made by Commissioner Eberhardt. Commissioner Jasiecki once again restated the motion: Commissioner Jasiecki made the motion to approve the request for Fiori's Restaurant zoning change from "C" Commercial" to "C" Commercial with an "S.U.P." Special Use Permit for the inclusion of a private club with the following: 1. Beer and wine will be served only with meals 2. There will be a six month limitation from the time the State issues the license with the option of renewal by the Planning and Zoning Commission 3. No open bar allowed 4. Beer and wine can only be served between the hours of 11 a.m. and 12 p.m. Motion was seconded by Commissioner Munsch. Motion carried 4-1 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki and Commissioner Munsch voting in favor of the motion and Commissioner Pope voting against the motion. Chairman Smedul asked Commissioner Eberhardt to report to the Commission his findings within thirty days. Item 8: Zoning Application #86-03-14 - PUBLIC HEARING To consider a zoning change request for Fletcher Park Addition from "SF -12" Single Family - 12 to "SF -7" Single Family - 7 on property located on the east side of Heartz Road 449.66 ft. south of Sandy Lake Road. Mr. Pete Hennessey of 329 Willow Springs Court, Coppell representing Fletcher Park Addition made the presentation to the Commission. Mr. Hennessey stated that the property in question would be limited to fifteen lots with the approximate size of lots measuring 15,000 sq. ft. and decreasing in size to approximately 8,840 sq.ft. Minimum lot measurements for this zoning is 65 feet stated by Gabe Favre, City Consulting Engineer and Mr. Hennessey stated that their lot size is 64.67 and would like the approval of the Commission. Mr. Favre also stated that there should be an alley around the back. Mr. Hennessey stated that because of the size of the back lots they would like to eliminate the alleys and again ask the Commissions approval. Chairman Smedul then opened the public hearing and asked for those persons wishing to speak in favor of the zoning change. There were none. He then asked for those persons wishing to speak against the zoning change. Dirk Anders of 137 Heartz Road related the concerns of the citizens and property owners of Heartz Road. Mr. Anders read and submitted a letter to Chairman Smedul signed and supported by the residents of Heartz Road. (See attached). Jennifer Sinn of 133 Heartz Road spoke in opposition of down zoning. Two letters of opposition were received at City Hall from adjacent property owners Mr. & Mrs. Worley, Route 3 Box 5780, Canton, Texas and also Mr. & Mrs. Garvin Sinn, 133 Heartz Road Coppell, Texas sent letters of opposition. (See attached). Chairman Smedul then closed the public hearing. Following discussion Commissioner Eberhardt motioned that Zoning Application #86-03-14 zoning change request for Fletcher Park Addition from "SF -12" Single Family - 12 to "SF -7" Single Family - 7 on properly located on the east side of Heartz Road be denied. Commissioner Jasiecki seconded the motion; motion carried 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 9: Zoning Application #86-02-17 - PUBLIC HEARING To consider a Sign Variance request for Northlake 635 Business Park from Section 10-6-1 (C.2) and Section 10-6-1 (C.3) of City of Coppell Sign Ordinance on property located at the intersection of south Beltline Road and Lakeshore Drive. Mr. Jim Connell with Connell Development of Northlake 635 made the presentation to the Commission. Mr. Connell is requesting a sign variance. Mr. Connell submitted photographs taken of a similar sign situated in Carrollton. The sign for Northlake 635 would be a single double-faced masonary monument sign. They are requesting this variance because of the widening of Beltline Road and felt that a bigger sign than specified for in the present sign ordinance would be to the advantage of advertising the property and a smaller sign would not be visible. Chairman Smedul then opened the public hearing and asked for those persons wishing to speak for the proposed change. There were none. He then asked for those persons wishing to speak against the proposed change. Again there were none. Chairman Smedul then declared the public hearing closed. Following discussion City Engineer Ed Powell stated his concerns of visability on Beltline Road. Kevin White also with Connell stated that the sign could be set back behind site lines. Ed Powell, City Engineer stated that he will work with Connell to work out distance of sign setback and safety factors. Commissioner Eberhardt motioned to approve Zoning Application #86-02-17 for a sign variance request for Northlake 635 Business Park with regard to construction of a 90 sq. ft. monument sign and motioned to deny the 10 ft. setback, but work with the City to satisfy the requirements of the City Engineering staff. Motion was seconded by Commissioner Munsch; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch, Commissioner Pope voting in favor of the motion. Item 10: Zo*ing Application #86-02-21 - PUBLIC HEARING To consider a Sign Variance request for Safeway/Corners of Coppell from Section 10-6-2 (E.3) of the City of Coppell Sign Ordinance on property located on the southeast corner of Sandy Lake Road and MacArthur Boulevard. Andrea Forman representing Safeway made the presentation to the Commission. Ms. Forman is asking for approval of a sign variance request. It includes two signs, two logo signs and the Safeway sign. Chairman Smedul then opened the public hearing and asked for those persons wishing to speak for the sign variance request. There were none. He then asked for those persons wishing to speak against the proposed sign variance. Again there were none. Chairman Smedul then closed the public hearing. Following further discussion Commissioner Munsch motioned to approve Zoning Application 486-02-21 for a sign variance required for Safeway/Corners of Coppell. Motion was seconded by Commissioner Jasiecki and motion carried unanimously 5-0 with Chairman Smedul, Commission Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 11: Zoning Application 486-03-24 - PUBLIC HEARING To consider a Sign Variance request for Univest Development Company from Section 10-5-6 of the City of Coppell Sign Ordinance on properties located at the intersection of Highland Meadow Circle and Sandy Lake Road, and the entrance of Park Meadow Addition on Parkway Boulevard. Chris Chisholm with Univest Development made the presentation to the Commission. Mr. Chisholm is requesting a variance on the sign ordinance for the Park Meadow Addition in the Parks of Coppell Development. Mr. Chisholm was asking to install a number of moving signs which would be flags, approximately five signs. Flag polls would be 18 ft. in height and to attach 3 ft. by 5 ft. flags. Mr. Chisholm also stated that Univest is requesting to install one sign on the outside brick wall of Highland Meadows for greater visability on Sandy Lake Road. He is also requesting that flags at both entrances at Park Meadow be installed for a period of one year. Chairman Smedul then opened the public hearing and asked for those persons wishing to speak in support of the petition. Lynn Brock of Carmen Homes, Louis Crump and Tom Wise all spoke in favor of this request because of no visability at the entryway to the project. Chairman Smedul then asked for those persons wishing to speak against this request. There were none. Chairman Smedul then closed the public hearing. Following discussion Commissioner Jasiecki motioned to approve the temporary Grand Opening flag for one year. Commissioner Munsch seconded; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Munsch, Commissioner Pope voting in favor of the motion. Item 12: Zoning Application #86-03-24.5 - PUBLIC HEARING To consider a Sign Variance request for Univest Development Company from Section 10-5-5 of the City of Coppell Sign Ordinance on properties located at four (4) locations: Denton Tap Road and Parkway Boulevard Sandy Lake Road and Moore Road Moore Road and Parkway Boulevard Park View Lane and Parkway Boulevard Chris Chisholm representing Wiseco Land Development, Inc., Univest and home builders in the area made the presentation to the Commission. Mr. Chisholm was requesting to install mobile advertising signs for a three day period for the Grand Opening at above locations. Chairman Smedul then opened the public hearing and asked for those persons wishing to speak in favor of the petition. Lynn Brock, Carmen Homes and speaking for Louis Crump spoke in favor of this petition. He then asked for those persons wishing to speak against the request. There were none. Chairman Smedul then closed the public hearing. Following discussion Commissioner Munsch motioned to approve the sign variance required for temporary off site signs for a period of three consecutive days. Commissioner Pope seconded; motion carried 4-1 with Chairman Smedul, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion and Commissioner Eberhardt voting against the motion. PLATTING Item 13: Plat Application #86-03-04 To consider approval of preliminary plat of Fairway Drive on property located north of existing Beltline Road, east of MacArthur Boulevard, south of Riverchase Drive and west of the Golf Course. Mr. Jay Patterson reppresenting Terra Company made the presentation to the Commission. Mr. Patterson was requesting a second access way to the Riverchase Development. He stated that Terra Company will build the railroad crossing and the road will be 45 ft. wide which is the same as Riverchase Drive and they will follow the same standards as Riverchase Drive and streetscape plans. Following further discussion Commissioner Jasiecki motioned to approve the request for a preliminary plat of 1.0956 acres of public street as requested by Riverchase. Motion was seconded by Commissioner Munsch; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 14: Plat Application #86-03-24 To consider approval of preliminary plat of Moore Road Elementary School on property located .2 miles south of Sandy Lake Road on the west side of Moore Road. Because of no representation Commissioner Eberhardt motion to table Item 14 on the agenda. Motion was seconded by Commissioner Munsch; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 15: Plat Application #86-02-24 To consider approval of a preliminary plat of Connell Skaggs Addition on property located on the northwest corner of Sandy Lake Road and Denton Tap Road. Mr. Jim Koch of Powell and Powell Engineering and Kevin White made the presentation to the Commission. They are requesting the approval of a preliminary and final plat for a grocery store (Skaggs), a retail center Exxon self-service gas station and car wash. Ed Powell, City Engineer referred to a drainage problem and felt they were very close to a solution to the problem. Mrs. Pat Boorhem stated that she had sent Chairman Smedul a letter asking the Commission to deny this request, but the easement and run-off problems have been resolved. Tim Peters, Real Estate Manager Connell/Skaggs explained the procedures for the enclosed trash compactors. Following further discussion Commissioner Munsch motioned to approve the preliminary plat with stipulation that the drainage problems be addressed with adjacent property owners and approved by the City Engineering staff. Commissioner Eberhardt seconded; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 16: Plat Application #86-03-14 To consider approval of a preliminary plat of Fletcher Park Addition on propery located on the east side of Heartz Road, 449.66 ft. south of Sandy Lake Road. Because of previous action on Fletcher Park Commissioner Eberhardt motioned to deny Plat Application #85-03-14. Commissioner Jasiecki seconded; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 17: Plat Application #86-04-01 To consider approval of a preliminary plat and site plan of Corners of Coppell on property located in the southeast corner of Sandy Lake Road and MacArthur Boulevard. Mr. Billy Thompson Consulting Engineer with Lichliter & Jameson & Associates and Steve Huntley of S.C.H. Architects and John Pearson, Landscaping Architects made the presentation to the Commission. The site plans have been changed from the previous site plans approved by the Commission and the exterior structures and lighting were addressed. Mr. Pearson explained landscaping plans to the Commissioners. Also discussed were three out parcels on the property. $40,000 was submitted for work on the channel and the bridges would be widened to 40 feet. Following further discussion Commissioner Pope motioned to approve the preliminary plat and site plan. Motion was seconded by Commissioner Munsch; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 18: Plat Application #86-02-20.5 to consider approval of final plat of Corners of Coppell on property located on the southeast corner of Sandy Lake Road and MacArthur Boulevard. Chairman Ray Smedul referred to a letter from Lichliter & Jameson & Associates in reference to conversation with Charles Ames. Commissioner Eberhardt motioned to table Item 18 - Plat Application #86-02-20.5. Motion was seconded by Commissioner Munsch; motion carried 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. The agreement involves approximately fifty acres of land north of Denton Creek. The agreement was entered into between the City of Lewisville and the City of Coppell. The City of Lewisville has applied pressure to the developer to annex this land into the City of Coppell and the City of Lewisville has disannexed that land. The annexation that comes forward before the City Council on the 22nd of April, 1986 and the zoning before the Planning and Zoning Commission tonight are tied together. This was part of the agreement that they would submit an application for similar type of zoning. The political issue in previous months is an issue concerning the City of Coppell and the City of Lewisville. The developer is present tonight at the request of the City of Coppell and the City of Lewisville because part of his land is entered in that agreement and is requesting similar type of zoning. The similar zoning agreement made with the developer is that he would not be damaged by being asked or forced by the City of Lewisville to disannex part of his property and enter the City Limits of Coppell. The ETJ issue is an issue between the City of Coppell and the City of Lewisville and the developer is not involved in that issue and under the Similar Zoning agreement Mayor Duggan asked for compatable zoning and asked that the Commission consider the best use of the land. Following further discussion Mayor Duggan stated that if the zoning before the Commission is denied it will go before the City Council. If denied by the City Council the land will be annexed into the City of Lewisville and the developer will petition to be annexed back into the City of Lewisville. Mayor Duggan also stated that when this item comes before the City Council it will be for annexation into the City of Coppell and compatible zoning. After further discussion Mayor Duggan then excused himself from the meeting. Mr. Jeffrey W. Hurt representing Vista Mortgage & Realty, Inc. and J. Stephen Crim made the presentation to the Commission. Mr. Hurt introduced Stephanie Fess, Phil Deaton and Matt Mayberry. Mr. Hurt explained that Tract E was zoned "LI" Light Industrial in the the City of Lewisville and thet are asking for the same zoning in Coppell. Tract A was zoned "GB" General Business in the City of Lewisville and they are asking for "LI" Light Industrial in Coppell. Mr. Hurt referred to a copy of Restricted Covenant by Vista Ridge Project, which has more restrictions that ...the..City . of Coppell and the City of Lewisville,. ..The tax base in the land would be approximately eighty-eight million dollars. Ms. Fess explained that Vista Ridge is requesting "LI" Light Industrial zoning because of the size of building restrictions in "C" Commercial zoning. Commissioner Munsch stated that the Commission would like to review Vista Ridge's Restricted Covenant before acting on this request. Chairman Smedul then declared the public hearing open. He then asked for those persons who wished to speak in favor of the zoning change. There were none. He then asked for those persons wishing to speak against the motion. Dawn Anders stated that she would like to know the restrictions. Mr. Hurt explained there would be no residential use of any kind, no trailer parks, mobile home parks, recreational vechicles or camp grounds, no agricultural uses of any kind, no storage, warehouseing, manufacturing or automobile sales and construction standards would have to be followed. Tom_ Wise --referred to letter .presented to the Planning and Zoning Commission. Mr. Hurt explained that "0" Office zoning does not allow Garden - Apartments and planned specialty retail which is being planned-for this area and this would be allowed in the "LI" Light Industrial zoning. Chairman Smedul then closed the public hearing. Following a lengthy discussion a proposal .was made to provide each member of the Commission with---a copy of Restricted Covenant Manual for further study and to table this zoning until May 15, 1986 which at such -time the applicant will present a proposal for compatible zoning for office and retail mix and height waivers. Mr. -- Hurt stated that Vista Ridge will withdraw their petition for annexation and re-apply to the City in one month. Before the motion was made Commissioner Eberhardt---stated that he--was- -a--former- employee- of Lomas & Nettleton and asked City Attorney, Larry Jackson if this would be a conflict of interest. Mr. Jackson stated that this was not a conflict of interest because Commissioner Eberhardt has no connection with the firm or applicant at the present time and no possibility for financial gain. Co=issioner 1-17unsch motioned to table this zoning change to the Planning and Zoning Commission meeting scheduled for May 15, 1986 at 7:30 p.m. Commissioner Jasiecki seconded; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. A copy of the Restricted Convenant Manual will be mailed to the Commission members. Item 7: Zoning Application #86-03-25 - PUBLIC HEARING To consider approval of a zoning change request for Fiori's Restaurant from "C-S.U.P." Commercial with a Special Use Permit for a restaurant to "C-S.U.P. - Commercial with a Special Use Permit for the inclusion of a private club, on property located on the southeast corner of Denton Tap Road and Sandy Lake Road. Donna Sloan, Manage: and part owner of Fiori's Restaurant made the presentation to the Commission. Ms. Sloan stated that only beer and wine will be served at the table with dinner, there will be no mixed drinks served, and the restrictions on their lease with Univest states that there will be no bar. Ms. Sloan also stated that the restaurant would like to serve wine with dinner for fine dinning and not for drinking crowds. Chairman Smedul then opened the hearing to the public and asked for those persons wishing to speak in support of this petition. There were none. He then asked for those persons wishing to speak against this petition. Lou Brown, Pastor of the First Baptist Church of Coppell and speaking for Pastor, C.A. McBride stated that it was not in the best interest of the City, or citizens of Coppell to allow the sale and comsumption of alcohol in the City. He also stated that to allow this petition to pass would open the door for many other restaurants. Dean Wilkerson stated that this petition should be denied because of its location of being on a busy street and in a shopping center, and the closeness to the Coppell soccer fields. Pastor David Carr, Firs United Methodist Church asked if the City has an ordinance regulating this and rade a request to deny this petition and requested the City_ to.. adopt an ordinance regulating alcohol in the City of Coppell. Chairman Smedul then closed the public hearing. Following discussion Commissioner Eberhardt proposed to table this request and stated he would volunteer his time to investigate ordinances from surrounding cities as to the negative or positive influence other cities have had and report his findings to the Commissioners. Commissioner Jasiecki motioned to approve request with stipulation that Commissioner Eberhardt -requested, that there be a temporary ,s x.r.,, Special Use Permit for one year from the time the State of Texas authorizes Ms. Sloan to serve liquor. Commissioner Jasiecki then amended his motion for approval to incorporate the requests of his fellow Commissioners. Commissioner Munsch included that beer and wine will only be served with a.meal, alcohol cannot be served without a meal, that the hours will not be -later yuan midnight to serve alcohol. - Commissioner Eberhardt added -that alcohol can -be served after 6 p.m. and no later than 12 midnight and that the ,s.U.r." Special Use --Permit be limited to six months and that the City. can withdraw _this permit upon a two week notice. Citzens buy property and invest their life savings in homes. They choose locations based on the most accurate information available to them, the zoning map. We bought our homes and moved based on the current zoning. It seems unfair to change that zoning three to four years after most of us on Heartz Road bought our homes. Second, we are concerned about the deterioration we are beginning to see in the Braewood and Fox and Jacobs areas bordering Heartz Road. We do not need anything that would accelerate or contribute to that deterioration We already have multi -family zoning on the other end of Heartz Road and we do not need further down -zoning. Third and last, we have a concern over the legalities of a zoning change. Mr. Fletcher may have the best intentions in the world and may plan to put a high quality development on this property; however, he has no legal obligation to do as he proposes once he has the zoning change. Unforseen problems, financial and otherwise, might necessitate changes later on. Thee woad be no obligation to notify citizens of these changes. We may like the ideas he has presented now, only to have the plans change later on. It may be true that he would have to bring those changes to the P & Z Commission but a citizen would have to obtain copies of the agendas before each and every P & Z meeting to be made aware of any changes. It is our belief that a developer would be more likely to put a higher quality home on a larger lot and possibly a lesser quality home on a__.. smaller -lot. Commissioner Jasiecki seconded the motion; motion carried 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 9: Zoning Application #86-02-17 - PUBLIC HEARING To consider a Sign Variance request for Northlake 635 Business Park from Section 10-6-1 (C.2) and Section 10-6-1 (C.3) of City of Coppell Sign Ordinance on property located at the intersection of south Beltline Road and Lakeshore Drive. Mr. Jim Connell with Connell Development of Northlake 635 made the presentation to the Commission. Mr. Connell is requesting a sign variance. Mr. Connell submitted photographs taken of a similar sign situated in Carrollton. The sign for Northlake 635 would be a single double-faced masonary monument sign. They are requesting this variance because of the widening of Beltline Road and felt that a bigger sign than specified for in the present sign ordinance would be to the advantage of advertising the property and a smaller sign would not be visible. Chairman Smedul then opened the public hearing and asked for those persons wishing to speak for the proposed change. There were none. He then asked for those persons wishing to speak against the proposed change. Again there were none. Chairman Smedul then declared the public hearing closed. Following discussion City Engineer Ed Powell stated his concerns of visability on Beltline Road. Kevin White also with Connell stated that the sign could be set back behind site lines. Ed Powell, City Engineer stated that he will work with Connell to work out distance of sign setback and safety factors. Commissioner Eberhardt motioned to approve Zoning Application #86-02-17 for a sign variance request for Northlake-635 Business Park`wit'h regard to"construction of a 90 sq. ft. monument sign and motioned to deny the 10 ft. setback, but work with the City to satisfy the requirements of the City Engineering staff. Motion was seconded by Commissioner Munsch; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch, Commissioner Pope voting in favor of the motion. Item 1-0: Zoning Application #86-02-21 PUBLIC BEARING To consider a Sign Variance request for Safeway/Corners of Coppell from Section 10-6-2 (E.3) of the City of Coppell Sign Ordinance on property located on the southeast corner of Sandy Lake Road and MacArthur Boulevard. - Andrea Forman representing Safeway made the presentation to the Commission. _ Ms. Forman is asking for approval of a sign variance request. It includes two signs, two logo signs and the Safeway sign. Chairman Smedul then opened the public hearing and asked for those persons wishing to speak for the sign variance request. There were none.He then asked for those persons wishing to speak against the proposed sign variance. Again there were none. Chairman Smedul then closed the public hearing. Following further _discussion Commissioner Munsch motioned to approve Zoning Application #86-02-21 for a sign variance required for Safeway/Corners of Coppell. Item 11: Zoning Application 486-03-24 - PUBLIC HEARING To ccnsider a Sign Variance request for Univest Development Com =n from Section 10-5-6 of the City of Coppell Sign it -7 Ordinance on properties located at the intersection of Highland Meadow Circle and Sandy Lake Road, and the entrance of Park Meadow Addition on Parkway Boulevard. Chris Chisholm with Univest Development made the presentation to the Commission. Mr. Chisholm is requesting a variance on the sign ordinance for the Park Yleadow Addition in the Parks of Coppell Development. Mr. Chisholm was asking to install a number of moving signs which would be flags, approximately five signs. Flag polls would be 18 ft. in height and to attach 3 ft. by 5 ft. flags. Mr. Chisholm also stated that Univest is requesting to install one sign on the outside brick wall of Highland Meadows for greater visability on Sandy Lake Road. He is also requesting that flags at both entrances at Park Meadow benstlled for a period of one year. Chairman Smedul then opened the publichearing and asked for those persons wishing to speak in support of the petition. Lynn Brock of Carmen Homes, Louis Crump and Tom Wise all spoke in favor of this request because of no visability at the entryway to the project. Chairman Smedul then asked for those persons wishing to speak against this request. There were none. Chairman Smedul then closed the public hearing. Following discussion Commissioner Jasiecki motioned to approve the temporary Grand Opening flag for one year. Item 12: Zoning Application #86-03-24.5 - PUBLIC HEARING To consider a Sign Variance request for Univest Development Company from Section 10-5-5 of the City of Coppell Sign Ordinance on properties located at four (4) locations: Denton Tap Road and Parkway Boulevard Sandy Lake -Road and Moore. -Road Moore Road and Parkway Boulevard Park View Lane and Parkway Boulevard Chris Chisholm representing Wiseco Land Development, Inc., Univest and home builders in the area made the presentation to the Commission. Mr. Chisholm was requesting to install mobile advertising signs for a three day period fer the Grand Opening at above locations. Chairman Smedul then opened the public hearing and asked for those persons wishing to speak in favor of the petition. Lynn Brock, Carmen Homes and speaking for Louis Crump spoke in favor of this petition. He then asked for those persons wishing to speak against the request. There were none. Chairman Smedul then closed the public hearing. PLATTING - Item 13: Plat Application #86-03-04 To consider approval of preliminary plat of Fairway Drive on property located north of- existing-- Beltline Road, east of -- - - - MacArthur Boulevard, south of Riverchase Drive and west of the - -oS " bourse . Mr. Jay Patterson reppresenting Terra Company made the presentation to - the Commissicn. Mr. Patterson was requesting a second access way to the Riverchase Development. He stated that Terra Company will build the railroad crossing and the road will be 45 ft. wide which is the same as Riverchase Drive and they will follow the same standards as Riverchase Drive and streetscape plans. Following further discussion Commissioner Jasiecki motioned to approve the request for a preliminary plat of 1.0956 acres of public street as requested by Riverchase. Motion was seconded by Commissioner Munsch; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 14: Plat Application #86-03-24 To consider approval of preliminary plat of Moore Road Elementary School on property located .2 miles south of Sandy Lake Road on the west side of Moore Road. Because of no representation Commissioner Eberhardt motion to table Item 14 on the agenda. Motion was seconded by Commissioner Munsch; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 15: Plat Application #86-02-24 To consider approval of a preliminary plat of Connell Skaggs Addition on property located on the northwest corner of Sandy Lake Road and Denton Tap Road. Mr. Jim Koch of Powell and Powell Engineering and Kevin White made the presentation to the Commission. They are requesting the approval of a preliminary and final plat for a grocery store (Skaggs), a retail center Exxon self-service gas station and car wash. Ed Powell, City Engineer referred to a drainage problem and felt they were very close to a solution to the problem. Mrs. Pat Boorhem stated that she had sent Chairman Smedul a letter asking the Commission to deny this request, but the easement and run-off problems have been resolved. Tim Peters, Real Estate Manager Connell/Skaggs explained the procedures for the enclosed trash compactors. Following further discussion Commissioner Munsch motioned to approve the preliminary plat with stipulation that the drainage problems be addressed with adjacent property owners and approved by the City Engineering staff. Commissioner Eberhardt seconded; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 16: Plat Application #86-03-14 To consider approval of a preliminary plat of Fletcher Park Addition on propery located on the east side of Heartz Road, 449.66 ft. south of Sandy Lake Road. Because of previous action on Fletcher Park Commissioner Eberhardt motioned to deny Plat Application #85-03-14. Commissioner Jasiecki seconded; motion carried unanimously 5-0 with Chairman "Smedul, Commissioner -Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 17: Plat Application #86-04-01 - To consider approval of a preliminary plat and site plan of Corners of Coppell on property located in the southeast corner of Sandy Lake Road and MacArthur Boulevard. Mr. Billy Thompson Consulting Engineer with Lichliter & Jameson & Associates and Steve Huntley of -- S. C.H. -- Architects and John Pearson, Landscaping Architects -made -the presentation-- -to- -tire -Commission -- The site plans have been changed from the previous site plans approved by the Commission and the exterior structures and lighting were addressed. Mr. Pearson explained landscaping plans to the Commissioners. Also discussed were three out parcels on the property. $40,000 was submitted for work on the channel and the bridges would be widened to 40 feet. Following further discussion Commissioner Pope motioned to approve the preliminary plat and site plan. Motion was seconded by Commissioner Munsch; motion carried unanimously 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion. Item 18: Plat Application 486-02-20.5 to consider approval of final plat of Corners of Coppell on property located on the southeast corner of Sandy Lake Road and MacArthur Boulevard. Chairman Ray Smedul referred to a letter from Lichliter & Jameson & Associates in reference to conversation with Charles Ames. Commissioner Eberhardt motioned to table Item 18 - Plat Application #86-02-20.5. Motion was seconded by Commissioner Munsch; motion carried 5-0 with Chairman Smedul, Commissioner Eberhardt, Commissioner Jasiecki, Commissioner Munsch and Commissioner Pope voting in favor of the motion.
