BM 1985-12-19 PZPLANNING AND ZONING COMMISSION Minutes of December 19, 1985 The Planning and Zoning Commission of the City of Coppell met in a regular called session on Thursday, December 19, 1985 in the Coppell High School Administration Building. The pre -session began at 7:10 p.m. with the regular called session beginning at 7:30 p.m. The following members were present: R.W. Smedul, Chairman Perry Jasiecki, Commissioner Steve Eberhardt, Commissioner Frank Pope, Commissioner Absent: Joe Munsch, Commissioner Also present were City Attorney Larry Jackson, City Engineer Edward Powell, Consulting Engineer Gabe Favre and Secretary Linda Grau. TTFM NO. 1: Briefing on agenda A briefing on the agenda items was held prior to the regular session. Following the pre -session, the meeting was called to order by Chairman Smedul who then asked for Commissioner Pope to give the invocation. TTF.M NO- 9! Approval of Minutes Commissioner Frank Pope motioned to approve the minutes from November 21, 1985 and December 4, 1985. Motion was seconded by Commissioner Steve Eberhardt and motion carried 4-0. Chairman Smedul then introduced City Engineer Edward Powell, City Attorney Larry Jackson and Secretary Linda Grau to the public and welcomed and thanked the citizens for attending the meeting. The meeting was then opened to the public. TTFM NO. 3: A. Consideration of both major and minor admendments to the City of Coppell Comprehensive Zoning Ordinance. Recognize conforming structures as opposed to non -conforming structure - residential structure on properties which have been zoned for commercial or business use - which was in existence at the time the property was zoned for such business use. Such conforming status to continue as long as the residential structure is used for residential purposes. Chairman Smedul opened the meeting to the public and asked for those citizens present wishing to speak on the above item. Citizens wishing to speak before the commission were Vivian Checkley - 812 Howell Drive. Mrs. Checkley stated that when she moved in there was no zoning. Although she is satisfied with the commercial zoning status as it is now she would like to have better drainage but is against sidewalks being installed because of being reassessed. Howard Neal 808 Bullock, stated that he would like to see the streets and alleys fixed. Rich Pilone - 801 Howell, stated that this is not a rezoning issue but to allow structures on property to be conforming. Tim Mayrath 832 Howell, asked for City Attorney Larry Jackson's opinion because he feels he is locked in because structures do not meet commercial or residential codes. Rich Pilone also stated that structures cannot be sold as commercial or residential. Don Horne, Moore Road, stated that he would like to see his residential property changed to commercial. Mr. Lee 636 Parkway, stated that he would like to see the zoning of apartments changed to towne houses in his area because he finds the apartments disturbing to the people living in single family houses, and Kurt Wall 205 Parkmeadow Way stated that a long range master thoroughfare plan would be a good idea. (Chairman Ray Smedul assured Mr. Wall that the city did have a long range master thoroughfare plan). City Attorney Larry Jackson was asked to address the proposal of commercial zoning with residential structures. The public hearing was then closed. Following a very lengthy discussion Commissioner Pope motioned to accept City Attorney Larry Jackson's amendment with new additions to be presented at the next Planning and Zoning meeting. Motion was seconded by Commissioner Jasiecki and motion carried 4-0. B. To consider amending the Special Use Section of the Comprehensive Zoning Ordinance of the City to provide that churches shall be permitted in any zoning district under Special Use Classification. Chairman Smedul opened the public hearing and asked for those citizens wishing to speak for the proposed amendment. The following were in favor of the amendment. Reverend McBride - Assembly of God, Reverend Brown - First Bapist Church, Pastor Carr - First United Methodist, Reverend Nevels - Sandy Lake Road Bapist Church. Pastor Liersemann - Lutheran Community Church, Father Duesman - St. Ann's Catholic Mission were also in favor of amendment but not present. Also in favor was Rich Pilone and Don Horne. Chairman Smedul then asked for those persons in opposition to this ordinance. There were none. The public hearing was then closed. Commissioner Eberhardt motioned to amend zoning ordinance to the City of Coppell to delete paragraph 29.5 Sub -4 and 29.6 and insert paragraph 29.13 drafted by City Attorney Larry Jackson. Motion was seconded by Commissioner Jasiecki and motion carried 4-0. C. Chairman Smedul opened the public hearing and asked for those citizens wishing to speak before the commission. Randy Gross asked if the special use permit was for a short period of time. Dennis Easton 147 Moore Road wanted to know if amendment applies to existing churches, Bill Coss questioned the special use permit and City Attorney Larry Jackson once again read the amendment to the public. Bill Godwin 320 Woodhurst Place wanted to know if the special use permit would state whether the special use permit was for a long or short period of time. Kurt Wall was in favor of not changing "Special Use Permit". The meeting was then closed to the public. Following disucssion Commissioner Eberhardt motioned to table this item until the next Planning and Zoning meeting at which time City Attorney Larry Jackson will present a new draft with changes for presentation to the commission. Commisssioner Pope seconded and motion carried 4-0. ITEM NO. 4: Zoning Application #85-10-25 - to consider approval of a zoning change at the request of Vistaplex Development, Inc., from "SF -12" Single Family - 12 to "R" Retail and "0" Office on property generally located on the northside of Sandy Lake Road, the southside of Denton Creek and just east of the city of Coppell East City Limit Sign. Mr. Dan Sefko made the presentation to the Commission and verified that this property was indeed within the city limits. Zoning request is by owner of property. Chairman Smedul then opened a public hearing and asked for those wishing to speak for the proposed change. David Hath owner of Vistaplex Development, Inc., was willing to work with the city. Citizen Kurt Wall was in favor of proposal. Chairman Smedul then asked for those wishing to speak against the proposed change. There were none. The public hearing was then closed. Commissioner Eberhardt motioned to accept zoning change from "SF -12" Single Family - 12 to "R" Retail and 110" Office. Commissioner Pope seconded and motion carried 3 - 1 with Chairman Smedul opposing. T TF.M NO. 5: Zoning Application #85-10-24 - to consider approval of a zoning change at the request of Jareco Enterprises Inc. from "A" Agricultural to "0" office on property generally located on the northside of Coppell Road, 850 feet east of State Highway 121. Mr. Gary Sanford made the presentation to the commission to review this proposal at a later date. Commissioner Smedul opened the public hearing and asked for those persons who wished to speak for the proposed change. Citizen Kurt Wall was in favor of the proposal. Commissioner Smedul then asked for those wishing to speak against the proposal. There were none. The public hearing was then closed. After discussion Commissioner Jacieski motioned to table this item until the next Planning & Zoning Commission meeting at which time site plans will be submitted. Motion was seconded by Commissioner Pope and motion carried 4-0. ITEM NO. 6: Plat Application #85-11-19 - to consider approval of replat of final plat for Village of Cottonwood Creek Section III. Mr. Ulys Lane made the presentation to the commission. After discussion Commissioner Pope motioned to approve replat of final plat. Motion was seconded by Commissioner Jasiecki and motion carried 4-0. ITEM N0. 7: Plat Application #85-11-18.1 - to consider approval of a final plat for Daybridge Learning Center. Mr. Larry Frassinelli made the presentation to the commission. After discussion Commissioner Eberhardt motioned to approve final plat. Commissioner Jasiecki seconded motion and motion carried 4-0. ITEM N0. 8: Plat Application #85-11-18.2 - to consider approval of a final plat for Town Creek II Apartments. Mr. Robert Shaw made the presentation to the commission. After discussion concerning screening and drainage problems which Gabe Favre, consulting engineer for the city, assured the commission is a minor problem Commissioner Jasiecki motioned to approve final plat. Commissioner Eberhardt seconded this motion and motion carried 4-0. ITEM N0. 9: Plat Application #85-11-20 - to consider approval of a final plat for Riverview Plaza. Mr. Gary Sanford made the presentation to the commisson. After discussion Commissioner Pope motioned to approve final plat. Motion was seconded by Commissioner Jasiecki and motion carried 4-0. ITEM N0. 10: Plat Application #85-10-31 - to consider approval of preliminary plat for Carmel at the Lakes of Coppell. Mr. George Michulka and engineer Tim Lackey made the presentation to the commission. After discussion Commissioner Eberhardt asked to be excused from voting for personal reasons. Commissioner Jasiecki motioned to approve preliminary plat. Motion was seconded by Commissioner Pope and motion carried 3-0. ITEM N0. 11: Plat Application #85-11-18 - to consider approval of preliminary plat for Coppell Road Business Park. Mr. Dale Veenker made the presentation to the commission. After discussion Commissioner Frank Pope motioned to approve preliminary plat. Motion was seconded by Commissioner Eberhardt and motion carried 4-0. The meeting was then adjourned. r R.W.
