BM 1983-07-21PZMinutes of July 21, 1983 The Planning and Zoning Commission of the City of Coppell met in regular session at 7:30 p.m. in the Coppell High School Administration Building on Thursday, July 21, 1983. The following members were present: Frank Pope, Commissioner Peyton Weaver, Commissioner Gary Adams, Commissioner Chairman Ray Smedul and Co -Chairman Geren Burton were not present. Also present were City Manager Ron Ragland, City Secretary Dorothy Timmons and City Planning Coordinator Scott Barnett. Commissioner Peyton Weaver acted as chairman for the meeting. The meeting was called to order and everyone askbd to stand while Commissioner Pope gave the invocation. Following the invocation, Commissioner Weaver asked if all members present had read the minutes. All indicated they had. Com- missioner Pope then moved that the minutes be approved as submitted; Commission- er Adams seconded and motion carried 3-0. ITEM NO. 4: Consider approval of preliminary and final plat of The Phillips Addition (II) Mr. David Phillips made the presentation to the Commission for approval of the preliminary and final plat on two lots in The Phillips Addition subdivision. Mr. Phillips is akking for a variance on the street right-of-way dedication and design criteria as well as the exception of a fire hydrant within 500 feet of the two lots. It is the staff recommendation that the plats be approved with the exception of the street right-of-way dedication and design criteria but with the fire hydrant being located to serve both lots. Following dis- cussion, Commissioner Adams moved that the preliminary and final plats of The Phillips Addition (II) be recommended for approval with the two variances as requested; Commissioner Pope seconded and motion carried 3-0. ITEM NO. 5: Consider approval of preliminary and final plat of the Sandy Lake Road and Moore Road Retail Center Mr. Mack McWilliams made the presentation to the Commsssion concerning this development. Planning Coordinator Scott Barnett informed the Commission that this development went beyond the minimum requirements on landscaping as re- quired by the City. The water and sewer pro -rata has not been paid at this time, but will be paid prior to final approval by the Council. One-third of the cost of improvements to Sandy Lake Road and Moore Road that fronts this particular property would also be paid by this developer. It is the staff recommendation that this preliminary and final plat be approved; Following discussion, Commissioner Pope moved that these plats be recommended for approval; Commissioner Adams seconded and motion carried 3-0. ITEM NO. 6: Public hearing to consider a zoning change request of William G. Thompson, Trustee and Joel H. Robuck, Trustee for a zoning change from "I-1" Light Industrial and "R" Retail to a zoning classification of "PD" Planned Development, "TH-2" Townhouse and being approximately 33.6 acres of land situated in the McKinney & Williams Survey, Abstract No. 1054, City of Coppell, Dallas County, Texas and being North of the Cotton Belt RR right- of-way and 350 feet East of Denton Tap Road. Mr. Joel Robuck made the presentation to the Commission on this devlopment which would include 180 single family lots with a 60' undivided four lane road throughout the development. The proposed site plan meets all the sub- division requirements with the exception of a 27' back to back residential street section rather than a 29' back to back as required and the proposed drainage facilities are inadequate to meet the requirements of the subdivision regulations. It is the staff's recommendation that a six feet high screening fence be constructed along the southern boundary of this property between the industrial development and the single family residences. Commissioner Weaver then declared the public hearing open and asked for those persons who wished to speak against the proposed change. Mr. Ted Hoggatt was recognized and stated his opposition. Commissioner Weaver then asked for those persons who wished to speak for the proposed change. Other than the applicant, there were none. The public hearing was then declared closed. Following discussion by the Commission, Commissioner Adams moved that this zoning change be recommended for denial; Commissioner Pope seconded and motion carried 3-0. ITEM NO. 7: Consider approval of preliminary plat on The Creekview Residential Development (Thompson-Robuck) Because the action taken on Item No. 6, this item was not considered. ITEM NO. 8: Public hearing to consider a zoning change request of Ken Marchant Custom Homes for a zoning change from "SF -12" Single Family Residential to a zoning classification of "PD" Planned Development (SF -7, Office and Daycare) and being a tract of land situated in the Alfred Logsdon Survey, Abstract No. 783, said tract being part of the Stringfellow Addition 45 acre tract, and located west and south of the Stringfellow Addition, fronting both on Moore Road and Sandy Lake Road and containing approximately 16.3 acres of land. Mr. Ken Marchant made the presentation to the Commission. Mr. Marchant indicated that they were willing to dedicate the required right -6f -way on both Sandy Lake and Moore Road along this development for future expansion of these roads. He also stated that a contribution would be made to the City in the amount of 1/3 of the cost of upgrading both Sandy Lake and Moore Roads. The staff's recommendation is for approval of this zoning change. Commissioner Deaver declared the public hearing open and asked for those persons who wished to speak against the proposed change. Those persons speaking were Mr. Tony Dobecka. Commissioner Weaver then asked for those persons who wished to speak for the proposed change. There were none. The public hearing was then de- clared closed. Following discussion by the Commission, Commissioner Adams moved that this zoning change be recommended for denial; Commissioner Pope seconded and motion carried 3-0. ITEM NO. 9: Consider approval of preliminary plat on Sandy Lake Place (Marchant) Because of action taken on Item no. 8, this item was not considered. ITEM NO. 10: Public hearing to consider a zoning change request of Pat Mus- grave for a zoning change from "2F-1", Two Family to a zoning classification of "C" Eommerial and being four tracts of land out of the J. W. Anderson Survey, Abstract '18 and being more particularly described as 512, 516, 520 and 524 Coppell Road. Mr. Pat Musgrave made the presentation to the Commission. Staff recommendation is for approval of a retail zoning classification rather than the commercial zoning classification. Commissioner Weaver declared the public hearing open and asked for those persons who wished to speak for the proposed change. There were none. He then asked for those persons who wished to speak against the proposed change. Again, there were none. The public hearing was then declared closed. Following discussion, Commissioner Adams moved that this zoning change be recommended for approval as Commercial; Commissioner Pope seconded and motion carried 2-1 with Commissioner Weaver voting against the motion. ITEM NO. 11: Public hearing to consider a zoning change request of Whispering Hills Development for a zoning change from "SF -12" Single Family to a zoning classification of "SF -7", Single Family and being a tract of land out of the J. W. Anderson Survey, Abstract'18, being generally located south of Sandy Lake Road, east of Coppell Road and west of the General Telephone Plant, containing 17.5682 acres of land. Mr. James Ray made the presentation to the Commission on this development which presently is zoned for 44 single family lots. The requested zoning change would allow 77 single family lots. Staff recommendation is that the applicant request a zoning change of SF -9, Single Family rather than SF -7, because of compatability with surrounding land use as well as open drainage system being changed to a closed drainage system in compliance with our sub- division regulations. The public hearing was declared open and Commissioner Weaver asked for those persons who wished to speak against the proposed change. Those persons speaking were Mr. Lanny Mayo, Mrs. Janice Phillips, Mr. and Mrs. Craig Johnson. Commissioner Weaver then asked for those persons who wished to speak for the proposed change. There were none. The public hearing was declared closed. Following discussion, Commissioner Pope moved that this zoning change be recommended for denial; Commissioner Adams seconded and motion carried 3-0. ITEM N0. 12: Public hearing to consider a zoning change request of James Dunn for a zoning change from "SF -12" Single Family to a zoning classification of "C" Commercial and said property being Lot 5, Block C. Abstract 694, Shadydale Acres, also known as 162 N. Shadydale Lane, City of Coppell, Texas. There was no -person present to discuss this item with the Commission. Staff recommendation is that the zoning change be recommended for denial based on the ingress and egress accessibility to the site and incompatability with the existing residential land use adjoining the proposed site. The public hearing was declared open and Commissioner Weaver asked for those persons who wished to speak against the proposed change. Those persons speaking were Mr. Lanny Mayo, Mrs. Betty Aldridge, Mr. Craig Johnson, and Mrs. Janice Phillips. A petition opposing the proposed zoning change was presented to the Commission. Commissioner Weaver then asked for those persons who wished to speak for the proposed change. There were none. The public hearing was declared closed. Following discussion by the Commission, Commissioner Adams moved that this zoning change be recommended for denial; Commissioner Pope seconded and motion carried 3-0. The meeting was then adjourned.
