ORDINANCE NO. 93592
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THAT PART
OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL THAT
HERETOFORE CREATED THE COPPELL CABLE TELEVISION REVIEW BOARD;
PROVIDING A REPEALING CLAUSE AND SPECIFICALLY REPEALING ORDINANCE
NO. 92563; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS;
SECTION 1. AMENDING CODE THAT CREATED THE COPPELL CABLE
TELEVISION REVIEW BOARD.
The City of Coppell Code of Ordinances is hereby amended by adding to Chapter
2 the following Article 2-7, thereby transferring the provisions heretofore creating
the Coppell Cable Television Review Board to this new Article as follows:
"Article 2-7. COPPELL CABLE TELEVISION REVIEW BOARD
Section 2-7-1 CREATION
The Coppell Cable Television Review Board is hereby
established.
Section 2-7-2 APPOINTMENT
A. The Coppell Cable Television Review Board shall
consist of five (5) members, two (2) alternates, and one
(1) ex-officio and, who would be a representative of
Coppell High School (a student involved in cable
programming), to be nominated by the Mayor and
appointed by the City Council. Members shall be
residents of the City of Coppell for at least twelve (12)
months, and a registered voter, preceding the date of
appointment.
B. The term of office for each Board member shall be for
two (2) years, or until a successor is appointed.
C. Any vacancy created on the Board shall be filled by
majority vote of the City Council for the remainder of
the unexpired term within thirty (30) days after the
vacancy occurs.
D. The members of the Board shall serve without pay or
compensation; provided, however, that they shall be
entitled to reimbursement of and for necessary
expenses incurred in the performance of their duties,
when approved by the Council.
E. The members of the Board shall have advisory powers
only and shall not be deemed to be agents of the City.
F. Regarding initial appointments, and based on the
Council's decision concerning the length of each
member's term; three will be for one (1) year and two
will be for two (2) years.
Section 2-7-3 OFFICERS
A. The Board shall elect annually a chairman, vice-
chairman and secretary for one year terms of office, or
until their successors are elected.
B. They may hold office for two (2) terms, after which one
(1) term must elapse before being eligible for re-
election.
C. In the event of a vacancy in the office of chairman, the
vice-chairman shall assume the duties of chairman until
the next regular meeting of the Board, at which time
the Board shall elect a new chairman.
D. In the event a vacancy occurs in the office of vice-
chairman or secretary, the chairman may appoint a
board member to temporarily assume the duties of that
office until the next regular meeting, at which time
election shall be held to fill such vacancy.
Section 2-7-4 MEETINGS
A. The Coppall Cable Television Review Board shall meet
in regular sessions at times established by the by-laws
adopted by the Board and approved by the City
Council. The Board shall hold such special meetings
as shall be called by the chairman or, upon written
request of at least two (2) members of the Board.
Three (3) members of the Coppell Cable Television
Review Board shall constitute a quorum.
B. All meetings of the CoppelI Cable Television Review
Board shall be open to the public, unless otherwise
permitted by law, and shall be subject to both current
and future laws of the State of Texas concerning public
meetings.
C. The Coppell Cable Television Review Board shall keep
and maintain minutes of any proceedings held and
shall submit a written report of such proceedings to the
City Council at least once each month.
D. If a Board member is absent from three (3) consecutive
regularly scheduled meetings, or if a Board member is
absent from twenty-five (25) percent of the regularly
scheduled meetings within a twelve (12) month period,
the position shall be declared vacant and the vacancy
shall be filled for the remainder of the unexpired term
by the City Council within thirty (30) days after the
vacancy occurs.
Section 2~7-5 POWERS AND DUTIES OF COPPELL CABLE TELEVISION
REVIEW BOARD
A. Advise the City Council on all matters relating to cable
television, both wire and wireless.
B. Monitor compliance with the cable television franchises
and standards of performance by the franchises.
C. Assist in the evaluation of prospective franchises.
D. Analyze comments or complaints relating to cable
television service that are received and make
recommendations to the City Council.
E. Monitor and support the development of minority
and/or multi-cultural entrepreneurial programming.
F. Monitor and support the development of public,
educational and governmental access programming.
G. Assist and advise the Council on all matters relating to
public, educational and governmental access
programming.
H. Perform studies and make such other reports as the
Council or the City may request.
I. Develop policies regarding community access
programming policies to be forwarded through the City
Manager to the Council for approval.
J. Advise the City Council of objectives to be obtained in
the City's communication system based upon its
continued evaluation of the Coppell cable television
franchise and continued assessment of cable
technology.
K. Recommend the use of dedicated channels and
sharing of public facilities, especially with regard to
educational services.
L. Review and comment on budgets proposed by the City
involving the use of funds for community programming.
M. Review and comment on new communication
technologies to the City to maintain the latest in
telecommunication technology."
SECTION 2. REPEALING CLAUSE
All ordinances, or parts of ordinances, inconsistent or in conflict with provisions of this
ordinance, are hereby repealed. Ordinance No. 92-563 is specifically repealed.
SECTION 3. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance shall be
adjudged invalid or held unconstitutional, the same shall not affect the validity of this
ordinance as a whole or any part or provision thereof, other than the parts so decided
to be invalid or unconstitutional.
SECTION 5. EFFECTIVE DATE
This ordinance shall take effect immediately from and after its passage as the law and
charter in such cases provide.
