AN ORDINANCE OF THE CITY OF COPPELL, TEXAS
ORDINANCE NO 95683.
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
ABANDONING PORTIONS OF UTILITY EASEMENTS DESCRIBED IN
EXHIBITS "Al" THROUGH "A12" AND "BI" THROUGH "B12", ATTACHED
HERETO, IN FAVOR OF THE TWELVE ABUTTING PROPERTY
OWNERS, IDENTIFIED IN EXHIBIT "C" ATTACHED HERETO;
PROVIDING THAT SUCH ABANDONMENT SHALL BE THE INTEREST
WHICH THE CITY MAY LEGALLY AND LAWFULLY ABANDON;
PROVIDING THAT SAID ORDINANCE SHALL CONSTITUTE A
QUITCLAIM DEED THAT MAY BE RECORDED WITH THE COUNTY
CLERK OF DALLAS COUNTY, TEXAS; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Council of the City of Coppell has determined that the portions
of utility easements described in Exhibits "Al" through "Al2" and "BI" through "B12"
attached hereto, are no longer needed for City services; and
WIlE ~REAS, the City Council of the City of Coppell has determined that the interest
of the City and the public therein should be abandoned; and
WHEREAS, the abutting property owners desire that such portions of the easements
be abandoned; and
WHEREAS, the City Council of the City of Coppell has determined that the City and
public have no need for such portions of the easements, and that the cost of keeping and
maintaining such portions of the easements is in excess of the fair market value of the City's
interest in the easements being abandoned;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That the City Council of the City of Coppell, Texas has
determined that the portions of utility easements described in Exhibits "Al" through "Al2"
and "BI" through "B12", attached hereto and made a part hereof for all purposes, are no
longer needed or necessary for public purposes and should be abandoned in favor of the

twelve abutting property owners, identified in Exhibit "C", attached hereto and made a part
hereof for all purposes.
SECTION 2. That the City of Coppell, Texas, hereby abandons all its right, rifle, and
interest in and to said portions of easements, and abandons, conveys, and relinquishes all
such public interest the City may have in and to said portions of easements to the twelve
abutting property owners.
SECTION 3. That the City Council of the City of Coppell, Texas, has determined
that the cost of keeping and maintaining such portions of the easements is in excess of the
fair market value of the City's interest in the portions of the easements being abandoned.
SECTION 3. That the abandonment ordinance of the City's interest in said portions
of easements shall constitute a Quitclaim Deed in favor of the twelve abutting property
owners, and a certified copy of the same may be filed in the Deed Records of Dallas
County, Texas, to indicate such abandonment.
SECTION 3. That the abandonment provided for herein shall extend only to the
public right, rifle and interest which the City of Coppell, Texas, may have in and to said
portions of utility easements, and shall be construed to extend only to such interests that the
governing body of the City of Coppell, Texas, may legally and lawfully abandon.
SECTION 4. That this ordinance shall become effective from and after its passage
as the law and charter in such cases provide.

ADDITION, an Addition to the City of Coppell, Dallas County, Texas as recorded in Volume
88116, Page 3069 of the Plat Records of Dallas County, Texas, and being more particularly
described as follows:
COMMENCING at an intersection point common to the West property line of Lot 33, the
Southeast comer of LOt 42, Block B, CREEK VIEW ADDITION, and the East right-of-way line
of an alley;
THENCE departing from the West property line of LOt 33, following the line common to the
