The Town Council of Coppell, Texas convened on the the 10th
day of June 1988 with the following members present, to-wit:
R. M. Johnson, Mayor
C. C. Mitchell,
C. T. Waters,
J. H. Burns,
F. Howell,
constituting a quorum, when among other preceedings had was the
following:
Mr. C. T. Waters was appointed to contact Mr. Tom McKail, for
Coppell Development Committee.
Each of the following persons to be paid $7.50 for serving as
Election Officers 1 April 1958. Mr. Tom Moore, Mrs. Bill Kirkland
and Mrs. Anne Barfenecht.
Mr. Mitchell introduced A proposed o,dinance and made a motion
that the rules requiring ordinances to be read at more than one
seperate meeting be suspended for the meason stated in the emergency
clause.
The motion was seconded by Mr. Watere.
The motion prevailed by,he following vote:
AYES: Messrse Mitchell, Waters, Burns, Harwell.
NOES: None.
The ordinance as finally passed is am follows:
NO-016 AN ORDINANCE DISPENSING WITH THE OFFICE OF TOWN
MARSHAL AND PROVIDING FOR THE APPOINMENT OF A
CHIEF OF POLICE TO PERF0M THE DUTIES OF THE
TOWN MARSHAL AND DECLARING AN EMERGENCY·
WHEREAS, the Town Council of the Town of Coppell, Texas, have
investigated into and have determined that it would be to the benefit
of the Town, and its inhabitants, to abolish the office of Town Marshal
and provide for the appointment of a Chief of Police.
THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
COPPELL, TEXAS.
1. That the office of Town Marshal be and the same is hereby
dispensed with and abolished.
2. That there be and there is hereby created the office of Chief
of Police, and such officer shall perform all the duties and shall be
clothed with all of the powers of Town Marshal.
3· That the Chief of Police shall be appointed by the Mayor, with
the approval of a 2/3rds majority vote of the Town Council, and shall
hold office until the second Tuesday in April next succeeding his
appointment, or until his successor has been appointed and qualified.
4. That the Chief of Police may be removed from office at any
time for cause by a resolution adopted by a 2/3rds majority vote of all
the Aldermen elected, provided that the Chief of Police may make
application for a public hearing within ten (10) days after the adoption
of such resolution and such removal shall be held in abeyance until
after a public hearing has been had.
5. That the salary of the Chief of Police shall be established by
the Town Council and may be raised or lowered from time to time as may
be determined expedient by the Town Council.
6. The present Town Marshal shall seeve as Chief of Police until
his successor shall have been appointed and qualified.
The fact that the provisions of this ordinance are needed immediate-
ly creates an emergency and an imperative public necessity, demandind
that the rules requiring ordinances tobe passed at more than one separate
meeting be suspended, and that this ordinance take effect immediately
after its passage, and it is so ordained.
Mr. Waters introduced a proposed ordinance and made a motion that the
rules requiring ordinances to be read at more than one separate meeting
be suspended for the reasons stated in the emergency clausee
The motion was seconded by M . Mitchell.
The motion pevailed by the following votes
AYES: Messrs. Waters, Mitchell, Burns, Howell
NOES: None.
Mr. Waters made a motion that the ordinance be passed finally.
The motion was seconded by Mr. Mitchell.
The motion carrying with it the final passage of the ordinance
prevailed by the following vote:
AYES: Messrs. Waters, Mitchell, Burns, Howell·
NOES: None
The Mayor requested to be recorded as voting "Aye".
The ordinance as finally passed is as follows:
NO-017 AN ORDINANCE PROVIDING FOR A VOLUNTEER FIRE DEPAR~{ENT AND DECLARING AN EMERGENCY.
DEPARTMENT AN DECLARING ANA EMERGENCY.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF COPPELL, TEXAS
SECTION 1. There is hereby created a Volunteer Fire Department of
the Town of Coppell, Texas.
SECTION 2: The volunteer Fire Department of the Town of Coppell,
Texas, shall consist of a Chief and not to exceed twenty-five (25) able-
bodied, active members.
The Mayor of the Town of Coppell, Texas, shall appoint the Chief
by and with the advise and consent of the Town Council.
SECTION 3: The Volunteer Fire Department of the Town of Coppell,
Texas, shall be the judge of the qualifications of its members and shall
by by-laws provide for the regulation and discipline of its members, and
shall provide for such other officers as it shall deem necessary.
SECTION 4: Whenever any hose of the Fire Departnent is laid upon
any street or alley for the purpose of being used for the Fire Department,
it shall not be lawful for any kind of vehicle to pass over the same. The
owner or driver of any vehicle who shall drive or cause the same to be
driven over said hose, shall be deemed guilty of a mesdemeanor punishable
by fine not exceeding One Hundred ($100.00) Dollars.
SECTION 5: Any person who shall wilfully delay or prevent any fire-
man from attending any fire or in any manner hinder any fireman, shall be
deemed guilty of an offense, and on conviction shall be punished by a fine
not to exceed One Hundred ($100.O0) Dollars.
SECTION 6: Any person who shall wilfully make a false alarm of fire
shall, on conviction, Be deemed guilty of an offense punishable by a fine
not to exceed One Hundred ($100.00) Dollars.
SECTION 7: If any person shall, during the continuation of a fire,
in any manner obstruct the work of the firemen or any of them, or shall
conduct himself in a boisterous or disorderly manner, or shall refuse to
obey the officer in commmnd, he shall be deemed guilty of a misdemeanor
and upon conviction shall be punished by a fine not to exceed One Hundred
($100.00) Dollars.
SECTION 8: Every person present at a fire shall be subject to the
order of the Chief and assistants, in extinguishing the fire, and the re-
moval and the protection of propertye If any person present at any fire
shall refuse to obey such orders, he shall be punished by a fine not to
exceed One Hundred ($100.00) Dollars. Provided, that no person shall be
bound to obey such officer, unless such officer is designated by the
badge of his office.
SECTION 9: It shall hereafter be unlawful for any person not an
active bonafide members of the Volunteer Fire Department of the Town of
Coppell, Texas, to jump on any moving fire apparatus belonging to the
Town, or to ride on the same while in practice, or going to or returning
from a fire.
Any person violating any section of this ordinance shall be deemed
guilty of a misdemeanor and upon conviction shall be fined in any sum not
exceeding One Hundred ($100.00) Dollarse
The fact that the Town of Ccppell, Texas, and its inhabitants, are
in immediate need of the relief afforded by the provisions cf this ordinance
creates an emergency and an imperative public necessity demanding that any
and all rules requiring ordinances to be passed at more than one meeting
be suspended, and that this ordinance take effect immediately upon its
passage, and it is so ordained.
There being no further business to come before the Town Council on
motion duly made, seconded and carried, the meeting adjourned.
