CM 1960-04-18 THE STATE 0F TEXAS COUNTY 0F DALLAS The Town of Council of the Town of Coppell, Texas, convened on this the 18th day of April, 1960 with follwing members present, to-wit: W. T. Cozby, Mayor John Burns, Frank Harwell, E. E. Parker, C. T. Waters, Lester Johnson, Bill Harwell, Secretary constituting a quorum, when among other prececdings had was the following: Motion made by John Burns that S. L. Lesley be nominated as Fire Chief. seconded by Parker. Vote carried. Motion made by C. T. Waters as to putting light at Denton Tap Road and Sandy Lake road. Motion seconded by Harwell Vote carried. Motion made by Waters that service pole be installed at Fire Huse #2. Seconded by Harwell. Vote Carried. Motion made by Burns that flat rate of $25.00 for Building Permits on all new buildings and $17.00 for permits for remodeling when said remodeling is in excess of $2500.00. Motion seconded by Waters. Vote Carried. Motion made by Burns to require permits to move any type building or trailer into corporate limits. Seconded by Parker. Vote carried. Motion made by Waters that all dogs be vaccinated against Rabies before June 1, 1960. Motion seconded by Johnson. Vote Carried. There being no further business to come before the Town Council on motion duly made, seconded and carried the meeting was adjourned. PASSED AND AFPROVEE, this the 18th day of April, 1960. Waters, Bill Harwell, Town Secretary constituting the entire membership when among other proceedings had was the following: Mr. Burns introduced a proposed ordinance and made a motion that the rules requiring ordinances to be read at more than one separate meeting be suspended for the reasons stated in the emergency clause. The motion was seconded by Mr. Parker · The motion prevailed By the following vote: AYES: Messrs. Harwell, Parker, Johnson, Burns, and Waters. Mr. Burns made a motion that the ordinance be passed finally. The motion was seconded by Mr. Parker . The motion, carring with it the final passage of the ordinance prevailed by the following vote: AYES: Messrs. H&rwell, Parker, Johnson, Burns and Waters. NOES: None. The ordinance as finally passed is as follows: No. 019 AN ORDINANCE PROVIDING FOR THE PROCURING OF A BUILDING PERMIT BEFORE THE COMMENCING OF ANY CONSTRUCTION WITHIN THE TOWN OF COPPEL, TEXAS; PRSCRIBING REGULATING FOR THE ISSUANCE OF SUCH PERMITS; PROVIDING A PENALTY AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF COPPELL, TEXAS: 1. That from and after the passage of this ordinance it shall be unlawful for any person, firm or corporation to commence the construction of any building or the construction of any alterations or repairs to any existing building, when the estimated cost of such alterations or repairs exceed Fifty ($50.00) Dollars, within the Tows of Coppell, Texas, or move any building from without the corporate limits to within the corporate limits of the Town of Coppell, Texas, without first having procured a per- mit authorizing such construction from the Town Secretary of the Town of Coppell, Texas. 2. That the Town Secretary shall not issue a permit authorizing the construction of any building or the construction of any alterations or repairs to any existing building when the estimated cost of such alterations or repairs exceed Fifty ($50.00) Dollars, within the Town of Coppell, Texas, or move any building from without the corporate limits to within the corporate limits of the Town of Coppell, Texas, until authorized by a resolution duly entered in the minutes of the Town Council of the Town of Coppell, Texas. 3. That any person, firm or corporation desiring to construct any building or to construct any alterations or repairs to any existing build- ing, when the estimated cost of such alterations or repairs exceed Fifty ($50.00) DolLars, within the Town of Coppell, Texas, or move any building from without the corporate limits to within the corporate limits of the Town of Coppell, Texas, shall file an application with the Town Secretary, together with a filing fee; (a) in the amount of $25.00 in the event the application is for new construction or to move an existing building; (b) in the amount of $17.00 in the event the application is for alterations or repairs, such application to contain plans and specifications and estimates of cost of the contemplated construction. 4. That no permit authorizing the construction of any building or the construction of any alterations er repairs to any existing building, when the estimated cost of much alterations or repairs exceed Fifty ($50.00) Dollars, within the Town of Coppell, Texas, or the removal of any building from without the corporate limits to within the corporate limits of the Town of Coppell, Texas, shall be issued until the applica- tion, including the plans and specifications ami estimate of cost, pro- vided for herein, shall have been on file in the office of the Town Secretary of the Town of Coppell, Texas, for five (5) full days. 5. That the Town Council shall on or before fifteen (15) days after the filing of any such application with the Town Secretary, pass a resolution authorizing the granting of a permit or rejecting the applica- tion. Failure to pass a resolution authorizing the granting of a build- lng permit within the fifteen (15) day period provided for herein shall automatically constitute a rejection of the application. 6. No permit authorizing the construction of any building within the Town of Coppell, Texas, except auxiliary building to existing building, or the moving of any building from without the corporate limits to within the corporate limits of the Town of Coppell,Texas, shall be issued unless the plat showing the subdivision of the area where such construction is to be prosecuted has been approved by the Town Council of the Town of Coppell, Texas. 7. Any person, firm or corporation who has been granted a permit to construct any building or to construct any addition to any existing building within the Town of Coppell, Texas, or to move any building from without the corporate limits to within the corporate limits of the Town of Coppell, Texas, pursuant to and under the terms of this ordinance shall prosecute such construction in strict conformity with the plans and specifi- cations on file and the permit issued hereunder. Upon being notified, in writing, of a failure to prosecute such construction in accordance with the plans and specifications and permit, any such person, firm or corpor- ation, shall have ten (10) days in which to take such building or con- struction conform to the plans and specifications and building permit. Failure to make such correction shall constitute a violation under the terms of this ordinance. 8. The permit issued by the Town Secretary of the Toen of Coppell, Texas, shall be posted in plain view at the site of construction during the entire period of construction. 9. The violation of any of the provisions of this ordinance shall be deeded a misdemeanor and shall be punished, on conviction thereof, by a fine of not to exceed Fifty ($50.00) Dollars. The fact that the Town of Coppell, Texas, is in immediate need of the relief afforded by the provisions of this ordinance creates an emergency and an imperative public necessity demanding that any and all rules requiring ordinances to be passed at more than one separate meeting be suspended, and that this ordinance take in effect immediately upon its passage, and it is so ordained.
