BM 2012-10-04MINUTES OF OCTOBER 4, 2012 BOARD OF ADJUSTMENT The Board of Adjustment of the City of Coppell met in Regular Session on Thursday, October 12, 2012, at 7:00 p.m., in the Council Chambers at Town Center, 255 Parkway Boulevard, Coppell, Texas. The following members were present: In attendance: Donald Perschbacher, Chairperson Mark LeGros, Vice Chairperson Laura Ketchum, Board Member Douglas Robinson, Board Member John Hirschy, Board Member Also present: Michael Arellano, Chief Building Official Amy Swaim, Administrative Technician REGULAR SESSION Item 1: Call to Order. Absent: Jeffrey Turner, Alternate Board Member Melinda Gillam, Alternate Board Member Mark Holmstrup, Alternate Board Member Kathie Troy -Rucker, Alternate Board Member Chairperson Perschbacher called the meeting to order at 7:00 p.m. Item 2: Approval of the July 5, 2012, minutes. Motion by Vice Chairperson LeGros, second by Board Member Hirschy, to approve the July 5, 2012, minutes as presented. AYE: Ketchum, Robinson, Hirschy, LeGros, Perschbaher. NAY: None. The motion carried 5-0. Item 3: Public Hearing to consider a variance from Section 12-35-2.B.2(b)i of the Zoning Ordinance of the City of Coppell to allow an accessory building (garage) to encroach into the 10 -foot side yard setback by approximately 7 -feet for the property located at 305 Meadowcreek Road. Mr. Arellano summarized the request, noted the zoning for the property as SF -12, and cited Section 12-35- 2.B.2(b)i of the zoning ordinance. He explained Rick Hickman, property owner, is proposing the construction of a 420 -SF (20 -FT x 21 -FT) garage in the side yard on the west side of the property. Mr. Arellano stated the intent of the proposed structure would be to allow for front -load garage access. According to the property owner, the existing garage (side -load) has a limited turning radius, allowing only one vehicle to enter the garage. Additionally, Mr. Arellano explained the property owner plans to convert the existing garage into living space for his mobility -impaired mother. He furthered by stating the proposed structure, which encroaches approximately 7 -feet into the 10 -foot side yard setback, would be approximately 3 -feet from the property line. Mr. Arellano recommended denial of the request. Rick Hickman, property owner, explained his request. Mr. Hickman stated the following issues created a hardship for his property: slope in the back yard; sewer easement in the back yard; and floodplain in the back BOAm 10042012 Page 1 of 2 yard. Furthermore, he indicated constructing the garage on the east side of the property would take away the only useable outdoor space. Therefore, positioning the proposed garage on the west side of his property seemed to be the only viable alternative. Michael Betz, 1214 Cedar Pine Lane, Oak Point, Texas, spoke in favor of the request. Ron Wommack, 2401 Douglas Avenue, Dallas, Texas, spoke in favor of the request. Motion by Board Member Ketchum, second by Board Member Robinson, to approve the variance from Section 12-35-2.B.2(b)i of the City of Coppell Zoning Ordinance to allow an accessory building (garage) to encroach into the 10 -foot side yard setback by approximately 7 -feet for the property located at 305 Meadowcreek Road. AYE: None. NAY: Ketchum, Robinson, Hirschy, LeGros, Perschbacher. The motion failed 0-5. There being no further business, the meeting was ad ourned at -00 P.M.
