OR 92-565 General & special fees & charges to be assessed AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 92565 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 18 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL TO PROVIDE FOR GENERAL AND SPECIAL FEES AND CHARGES TO BE ASSESSED AND COLLECTED BY THE CITY AS AUTHORIZED BY THIS OR OTHER ORDINANCES OF THE CITY; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. AMEND CHAFFER 18 OF THE COPPELL CITY CODE Chapter 18 of the Code of Ordinances of the City of Coppell is hereby amended to read as follows: CHAFFER 18 GENERAL AND SPECIAL FEES ARTICLE 18 - 1 GENERAL PURPOSE WHEREAS, the City of coppell wishes to adopt a special chapter for the purpose of setting forth the majority of fees and charges to be assessed and collected by the City so that reference may be made to the fees so named without specifically stating the amount of fee in the basic ordinance calling for a charge; and WHEREAS, the purpose of this chapter to list such fees and charges but it is not the intent of this chapter to amend or change any fee heretofore established or that may hereinafter be established that is not provided for in this chapter; and WHEREAS, in the event there is a conflict between a fee established in this Chapter and the MASTER FEE SCHEDULE - Page I provisions of any other chapter of City ordinance the provisions of this chapter shall prevail. ARTICLE 18-2 BUILDING FEES The following fees and charges shall be assessed and collected by the City pursuant to the provisions of the City of Coppell Building Code, the City of Coppell Plumbing Code, and the City of Coppell Mechanical Code, as such codes have heretofore been adopted and shall from time to time be amended. The fee for nonresidents shall be $150.00 MASTER FEE SCHEDULE - Page 6 ARTICLE 18-4 PEDDLER AND SOLICITOR PERMIT FEES Sec. 184-1 The City of Coppell will collect a fee of $50.00 per year for the first permit issued to a company and $10.00 per year for each additional permit issued to the same company shall be charged which shall not he returned if application is denied. ARTICLE 18-5 ZONING APPLICATION AND FILING FEES Sec. 18-5-1 All owners, lessees or any other persons, firms or corporations making an application with the City of Coppell requesting a change, amendment or variance to the zoning ordinance applicable to his property shall be charged a mandatory fee for processing such request as follows: A. Standard Filing Fee - $500.00 minimum plus $10.00 per acre or portion thereof. B. Specific Use Permit - $200.00 minimum plus $5.00 per acre of portion thereof. C. Conceptual Plan - No charge when submitted with zoning request; $100.00 when submitted separately D. Development Plan (Detail Site Plan) - $100.00 ARTICLE 18.-6 SUBDIVISION CONSTRUCTION PERMIT FEE Sec. 18-6-1 Prior to obtaining a construction permit, the developer shall escrow an additional 2% of the cost of the items to be constructed for dedication to the City ARTICLE 18-7 LIBRARY FEES Sec. 18-7-1 The City of Coppell will collect a fee of $25.00 per year from non-Dallas County residents for use of the Library. ARTICLE 18-8 FIRE FEES Sec. 18-8-1 Permits shall be required for the following activities. The fees for such permits is as follows: A. Combustible/Flammable Materials Storage $100.00 B. Explosive Materials Storage $250.00 C. Hazardous Materials Storage $150.00 D. Burn Permit (each site, each day) $50.00 E. Fuel Storage (per tank installation) $250.00 MASTER FEE SCHEDULE - Page 7 ARTICLE 18-9 FOOD ESTABLISHMENTS Sec. 18-9-1 Prior to obtaining a food establishment permit, the operator of the establishment shall pay the appropriate annual fee as follows: A. Permanent establishment $100.00 B. Temporary establishment $200.00 C. Temporary Permit $50.00 plus $5.00 for each concession with food and/or drink sales. D. Plan review fee $50.00 E. Reinspection fee 50% of annual permit fee. ARTICLE 18-10 ANIMAL CONTROL FEES Sec. 18-10-1 TRAP LOAN A deposit of $25.00 shall be made when requesting a small animal trap from the City. A $75.00 deposit shall be required on large size traps. Sec. 18-10-2 REGISTRATION FEES A. Dog/Cat altered $5.00 B. Dog/Cat unaltered $10.00 C. Replacement of lost or $2.00 D. Stolen registration. Sec. 18-10-3 IMPOUNDMENT FEES AND HANDLING CHARGES A. Impoundment fees shall be: 1. Class A: Dogs and cats (each cat or dog spayed or neutered) First Second Third Fourth Imp. Dogs and cats under the age of six (6) months shall be charged the sterilization fee. Animals may be exempted from sterilization upon written recommendation from a licensed veterinarian that such alternatives would be harmful or dangerous to the animal. Owners of these animals are to be subject to the lower impoundment fee. 2. MASTER FEE SCHEDULE - Page 9 B. Daily Handling Fees A daily handling fee shall be charged for every day, or fraction thereof, that an animal is at the animal shelter or confined by City personnel. Said fee shall be based upon the class of animal enumerated above: Class A $9.00 Class B $9.00 Class C $10.00 Class D $10.00 C. Observation Fees for Animals in Quarantine The owner of any animal held in quarantine for observation purposes shall be charged five dollars ($5.00) for every day or fraction of a day an animal is at the animal shelter. This is in addition to any impoundment or daily handling fee. D. Other Fees Any other costs that have been incurred by the City may be charged to the owner or adopting party. Sec. 18-10-4 EUTHANIZATION FEE An owner who no longer wishes responsibility for an animal, or believes the animal to be in an ill or injured condition, may sign a written waiver supplied by the Animal Control Officer allowing the animal to be immediately euthanized, in a humane manner. Provided that no warm blooded animal that has bitten a human being shall be euthanized until the Local Health Authority or the veterinarian supervising the quarantine has released the animal from such quarantine status. The quarantine shall be for a period of not less than ten (10) days. Pets released to the Animal Control Officer by their owner for euthanasia or disposal shall be charged a fee for this service. A. Cats $20.00 B. Dogs (less than 25 pounds) $25.00 C. Dogs (over 25 pounds) $30.00 With financial hardship cases, these fees may be waived in whole or in part by the City. REPEALING CLAUSE All parts of ordinances, inconsistent or in conflict with the provisions of this ordinance are hereby repealed. SECTION 3. SEVERABILITY CLAUSE If any article, paragraph or subdivision, clause or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or m~y part or provision thereof, other than the part so decided to be invalid or unconstitutional.
