CM 1966-12-05 STATE OF TEXAS COUNTY OF DALLAS The City Council of the City of Coppell, Texas, convened in regular meeting on the 5th day of December, 1966, with the following members present to-wit: W. T. Cozby, Mayor C. J. Dobecka, Councilman W. H. Wilaon, Councilman Thomas Sisk, Councilman B. J. Harwell, Councilman E. C. Gentry, City Secretary Constituting a quorum where among other proceedings had was the fo llowing: CANVASS OF THE RETURNS AND DECLARATION OF THE RESULTS OF AN ELECTION HELD IN THE CITY OF COPPELL, TEXAS, ON DECEMBER 3, 1966, ON THE QUESTION OF ANNEXING AN AREA FROM THE CITY CORPORATE LIMITS. 309 VOTES CAST - 100 FOR DISANNEXATION 209 AGAINST DISANNEXATION r Mr. G. E. Aldridge appeared before the Council to discuss the matter of getting water to his lot. Motion was made by W. H. Wilson and seconded by C. J. Dobecka that the city allow Mr. Aldridge to pay the $15.00 meter deposit and $8.00 as down payment tie-on fee now and the balance at $6.00 per month in 12 monthly payments. Check for $23.00 was accepted as per this agreement. THE STATE OF TEXAS COUNTY OF DALLAS CANVASS OF THE RETURNS AND DECLARATION OF THE RESULTS OF AN ELECTION HELD IN THE CITY OF COPPELL, TEXAS ON DECEMBER 3, 1966 ON THE QUESTION OF DISANNEXING AN AREA FROM THE CITY CORPORATE LIMITS BE IT REMEMBERED that on the 19th November, 1966, W, T. COZBY, Mayor of the City of Coppell, Texas, called an election to be heln on December 3, 1988 on the question of dis- annexing from the corporate existence el the Ciuy the following described territory: BEGINNING at a point where the Northwest right-of-way line of Texas State Highway No. 121 intersects the line between Denton and Dallas Counties, which point is also in the northern corporatelimits line of the Town of Coppell, Texas; THENCE Southwesterly along the said Northwest right-of-way line of Texas State Highway No. 121 to the point of its in- tersection with the Western boundary line of the J. Gibson Survey, Abst. No. 1715, which point is salo in the Western corporate limits line of the Town of Coppell, Texas, and which point is also in the boundary line between Dallas and Tarrant Counties; THENCE South along the Western boundary line of said survey ' to a point in the Northwest corner of the J A. Humphrey 35 . acre tract in the J. Gibson Survey Abst. No. 1716, said point also being in the Western Corporate line of the Town of Coppell, Texas and in the boundary line between Dallas and Tarrant Counties; THENCE South along the Western property line of said J. Humphrey tract to its intersection with the center line of Cottonwood Branch; THENCE Northeasterly along the corner line of Cottonwood Branch fo the point of its intersection with the Southest corner boundary line of the J. Morre Survey, Abst. No. 968; THENCE South along the Western boundaryline of said survey to the point of its intersection with the Southwest corner of the Wm. E. Dalton 23.6 acre tract in the S. A. & M. G. RR Survey, Abst. No. 1436; THENCE East with the Southern line of said Wm. E. Dalton tract to its Southeast corner on State Road; THENCE East from the Southeast corner of said tract in a straight line crossing State Road and crossing Coppell Road to a point in the East right-of-way line of Coppell Road which point is at the northwest corner of the C.O. Parker 1-acre tract int he J. Anderson Survey, Abst. No. 18; THENCE East along the North line of said C. O. Parker tract of its Northeast corner which point is also the Northwest corner of the A. Webb Roberts 8 acre tract in the J. Anderson Survey, Abst. 18; THENCE East along the North line of the said A. Webb Roberts tract 9 to its Northeast corner which point is in the West line of the J. E. Harris 3.75 acre tract in the J. Anderson Survey, Abst. 18; THENCE South along the West line of said J. E. Harris tract to its Southeast corner; THENCE East along the South line of said J. E. Harris tract to its Southeast corner; THENCE East with a direct extension of the South line of the said J. E. Harris tract to a point in the center line of Denton Tap Road, said center line also being in the Eastern boundary line of the original corporate limits of the Town of Coppell, Texas, as set forth in the petition for incorporation dated December 19, 1955; THENCE South with the center line of Denton Tap Road and the East line of said original corporate limits to its intersec- tion with the Southwest corner of the 14.065 acre tract know as the Coppell Heights Addition in the McKinney and Williams Survey, Abst. No. 1054, said addition being futher described in Vol. 52, p. 229 of the Map Records of Dallas County, Texas; THENCE East along the South line of said Coppell Heights Addi- tion to its Southeast corner; THENCH North along the East line of said Coppell Heights Addi- tion to the point at its intersection with the Southern Right- of-Way Line at Belt Line Road; THENCE in turn generally in Easterly, Northerly and Westerly directions and all times following the present corporate limit line of the Town of Coppell, Texas, to the place of BEGINNING. And, it appearing that proper notice had been given as required by law and that the other requirements of law having been com- plied with, such election was held December 3, 1966, at which election was submitted the propositions: FOR DISANNEXATION AGAINST DISANNEXATION Whereupon, official returns of said election have been filed with me, Mayor of the City of Coppell, Texas, for the purpose of canvassing the same and declaring the result of said election . It appearing that said returns being duly made according to law and duly authenticated, and it being shown by affidavit of E. C. GENTRY that written notices of said election were duly posted for the time and in the manner provided by law and all -2- other proceedings pertaining to said election having been shown to have been done and performed at and within the time and in the manner provided by law and all papers pertaining thereto having been returned and filed according to law; NOW, THEREFORE, I, W. T. COZBY, Mayor of the City of Coppell, Texas, after examining said returns and opening and canvassing the votes cast in said election, do hereby declare the result of said election as follows: That a total of 309 votes were cast at said election. That 100 votes were cast "For Disannexation." That 209 votes were cast "Against Disannexation." That a majority of said votes were cast "Against Disannexing" the above described area from the corporate limits of the City of Coppell and said result is hereby so declared and the said area shall continue in existence as a part of the corporate limits of the City of Coppell, Texas. IT IS, THEREFORE, ORDERED that said area shall not be disannexed from the corporate limits of the City of Coppell, Texas, and the same shall continue as a part of such city. IT IS, FURTHER, ORDERED that this order shall be in- corporated as a part of the Minutes of the City Council of the City of Coppell, Texas. ORDERED this the 5th day of DECEMBER 1966. W. T. Cozby Mayor , City of Coppell, Texas --3-- Motion was made that the Report of Examination for the year ending September 30, 1966, as presented by auditors Parker & Sanford be accepted as presented to the Council. Motion was made by W. H. Wilson and seconded by Thomas Sisk and carried. The City Secretary was instructed to mail copies of the Report of Examination to 1. Municipal Advisory Council, Austin, Texas 2. County Clerk, Dallas, Texas 3. Elbert Morrow, bond man to Motion was made by B. J. Harwell and seconded by W. H.
