OR 92-546 Sign requirements for resolution trust corporation property AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO.92546 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING SECTION 10-8-3 AND 10-8-6 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL; PROVIDING SIGN REQUIREMENTS FOR RESOLUTION TRUST CORPORATION PROPERTY; REQUIRING A PERMIT; PROVIDING THAT NO PERMIT FEE BE ASSESSED; PROVIDING REGULATIONS FOR NON-PROFIT ORGANIZATIONS; REQUIRING A PERMIT; PROVIDING THAT NO PERMIT FEE BE ASSESSED; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE, EXCEPT THAT WHERE A DIFFERENT PENALTY HAS BEEN ESTABLISHED BY STATE LAW FOR SUCH OFFENSE, THE PENALTY SHALL BE THAT FIXED BY STATE LAW, AND FOR ANY OFFENSE WHICH IS A VIOLATION OF ANY PROVISION THAT GOVERNS FIRE SAFETY, ZONING, PUBLIC HEALTH OR SANITATION OR THE DUMPING OF REFUSE OR JUNK THE PENALTY SHALL BE A FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1: AMENDING SECTION 10-8-3 OF CHAPTER 10 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL Section 10-8-3 of Chapter 10 of the Code of Ordinances of the City of Coppell is hereby amended by amending subsections "C" thereof read as follows: Sec. 10-8-3 REAL ESTATE SIGNS - TEMPORARY "C. Where a property is owned by the Resolution Trust Corporation, one (1) fifteen (15) square foot sign shall be allowed. No other signs will be allowed on the property. The sign must be located a minimum of fifteen (15) feet from all property lines. A permit shall be required for this sign; however, no permit fee will be assessed. Permits allowing such signs shall be limited to a period of one (1) year from the date the permit is issued." SECTION 2: AMENDING SECTION 10-8-6 OF CHAPTER 10 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL Section 10-8-3 of Chapter 10 of the Code of Ordinances of the City of Coppall is hereby amended by amending subsection "E" thereof read as follows: Sac. 10-8-6 TEMPORARY OFF-PREMISES SIGNS "E. Bona-fide non-profit organizations may erect temporary off-premises signs which refer to an activity or function of the organization. Such signs shall not be erected for more than ten (10) days. No more than 30 such signs shall be placed within the city which refer to the activity or function. Signs shall not exceed six (6) square feet in effective area and may be placed within the city right-of-way, provided that they do not project out over a street or sidewalk. No sign will be allowed within any street median. A permit shall be required for such signs; however, no permit fee shall be assessed." SECTION 3. REPEALING CLAUSE All parts of ordinances inconsistent or in conflict with the provisions of this ordinance are hereby repealed. SECTION 4. SEVERABILITY CLAUSE If any article, paragraph or subdivision, clause or provision of this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so decided to be invalid or unconstitutional. SECTION 5. PENALTY CLAUSE Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction shall be punished by a penalty of fine not to exceed the sum of Five Hundred Dollars ($500.00) for each offense, except where a different penalty has been established by state law the penalty shall be that fixed by state law, and for any offense which is a violation of any provision that governs fire safety, zoning, public health and sanitation or the dumping of refuse or junk as such terms are defined by Section 365.011 of the Texas Litter Abatement Act, Chapter 365 V.T.C.A., Health and Safety Code, as amended, the penalty shall be a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 6. EFFECTIVE DATE This ordinance shall take effect immediately from and after the publication of its caption, as the law in such cases provides.
