AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND MAP
OF THE CITY OF COPPELL, TEXAS, AS HERETOFORE AMENDED, BY
GRANTING A CHANGE IN ZONING FROM S-1196R-TC (SPECIAL USE
PERMIT-1196 REVISED-TOWN CENTER) TO S-1196R2-TC (SPECIAL
USE PERMIT-1196 REVISION 2- TOWN CENTER), TO AMEND THE
EXISTING SPECIAL USE PERMIT TO ALLOW AN 867-SQUARE-FOOT
COVERING, WITH AN ADDITIONAL 180-SQUARE-FOOT
OVERHANG, OVER THE PATIO IN FRONT OF THE EXISTING 3,700-
SQUARE-FOOT RESTAURANT LOCATED AT 130 N. DENTON TAP
ROAD, SUITE 120 ANDBEING MORE PARTICULARLY DESCRIBED IN
EXHIBIT “A”, ATTACHED HERETO AND INCORPORATED HEREIN
FOR ALL PURPOSES; PROVIDING FOR SPECIAL CONDITION
REGULATIONS; PROVIDING FOR THE APPROVAL OF THE DETAIL
SITE PLAN AND ELEVATIONS, ATTACHED HERETO AS EXHIBIT
“B”; PROVIDING A REPEALING CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE;
PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF
TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS
, the City Planning and Zoning Commission and the governing body of the City
of Coppell, Texas, in compliance with the laws of the State of Texas and pursuant to the
Comprehensive Zoning Ordinance of the City of Coppell, have given requisite notices by
publication and otherwise, and after holding due hearings and affording a full and fair hearing to all
property owners generally, and to all persons interested and situated in the affected area and in the
vicinity thereof, the said governing body is of the opinion that Zoning Application No. S-1196R2-
TC should be approved, and in the exercise of legislative discretion have concluded that the
Comprehensive Zoning Ordinance and Map should be amended.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1.
That the Comprehensive Zoning Ordinance and Map of the City of Coppell,
Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be
and the same is hereby amended to grant a change in zoning from S-1196R-TC (Special Use
Permit-1196 Revised-Town Center) to S-1196R2-TC (Special Use Permit-1196 Revision 2-
Town Center), to amend the existing Special Use Permit to allow an 867-square-foot covering,

with an additional 180-square-foot overhang, over the patio in front of the existing 3,700-square-
foot restaurant located at 130 N. Denton Tap Road, Suite 120 and being more particularly
described in Exhibit “A”, attached hereto and incorporated herein for all purposes.
SECTION 2.
That the property shall be developed and used only in accordance with the
special condition regulations, which are as follows:
(A)Except as amended herein, the property shall be developed in accordance with
Ordinance 91500-A-312, and S-1196R2-TC regulations which is incorporated
herein as set forth in full and hereby republished, and as amended and
administratively approved by the Director of Planning on August 24, 2009 in
accordance herewith.
(B)The covering for the patio shall be constructed, installed and maintained in
accordance with the Site Plan and Elevations, and notes contained therein, as
depicted on Exhibit “B”.
SECTION 3.
That the Site Plan and Elevations and notes contained therein, attached
hereto as Exhibit “B” and made a part hereof for all purposes, is hereby approved.
SECTION 4
. That the above property shall be used only in the manner and for the purpose
provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore
amended and as amended herein.
SECTION 5
. That all provisions of the Ordinances of the City of Coppell, Texas, in
conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other
provisions not in conflict with the provisions of this ordinance shall remain in full force and effect.
SECTION 6
. That should any sentence, paragraph, subdivision, clause, phrase or section
of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not

affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so
decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the
Comprehensive Zoning Ordinance as a whole.
SECTION 7. An offense committed before the effective date of this ordinance is governed
by prior law and the provisions of the Comprehensive Zoning Ordinance, as amended, in effect
when the offense was committed and the former law is continued in effect for this purpose.
SECTION 8. That any person, firm or corporation violating any of the provisions or terms
of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning
Ordinance of the City of Coppell, as heretofore amended, and upon conviction shall be punished by
a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and
every day such violation shall continue shall be deemed to constitute a separate offense.
SECTION 9. That this ordinance shall take effect immediately from and after its passage
and the publication of its caption, as the law and charter in such cases provide.

described in a deed from Good Financial Corporation to M. Douglas Al ins, Trustee,as recorded in Volume
76188, Page 2355 of the Deed Records of Dallas County, Texas and being more particularly described as
follows:
BEGINNING at a 1/2" iron rod found for corner on the east line of Denton Tap Road (a variable width
right-of-way), said point being the northwest corner of Lot 2 in Block 1 of Town Center Addition, an arirlition
to the City of Coppell as recorded in Volume 95172, Page 4749 of the Deed Records of Dallas County, Texas;
THENCE N.01°00'58"W., 314.68 feet along the said east line of Denton Tap Road to an "X" found cant
in concrete for corner, said point being the southwest corner of Lot 3 in Block 1 of Town Center Addition,an
addition to the City of Coppell as recorded in Volume 95240, Page 4999 of the Deed Records of Dallas County,
Texas;
THENCE N.88°59'02"E., 336.00 feet leaving the said east line of Denton Tap Road, and running
along the south line of said Lot 3 in Block 1, to an "X" found cut in concrete for corner, said point being on the
west line of Town Center Boulevard(a 28 foot wide right-of-way), said point also being in a non-tangent curve
to the right running in a southerly direction and having a central angle of 35°44'27" a radius of 286.00 feet and
a chord bearing of S.16°51'15"W.;
THENCE along said curve, and along the said west line of Town Center Boulevard, 178.41 feet to the
end of said curve, a 1/2" iron rod found for corner, said point being the beginning of a curve to the left having
a central angle of 29°11'42"a radius of 314.00 feet and a chord bearing of S.20°07'38"W.;
