OR 2014-1399 Boards and Commissions ORDINANCE NO. 2014-1399 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS AMENDING THE CODE OF ORDINANCES, BY AMENDING CHAPTER 2, BOARDS AND COMMISSIONS, ARTICLE 2-1 “LIBRARY BOARD”; BY AMENDING SECTION 2-1-2, “MEETINGS” AND “POWERS AND DUTIES”; BY AMENDING ARTICLE 2-2 “PARKS AND RECREATION BOARD” BY AMENDING SECTION 2-2-2, “TERM; VACANCIES”; BY REPEALING AND REPLACING ARTICLE 2-3 “KEEP COPPELL BEAUTIFUL” WITH A NEW ARTICLE 2-3, “COPPELL RECREATION DEVELOPMENT CORPORATION”; AND BY AMENDING ARTICLE 2-5 BY ADDING A NEW ARTICLE 2-5, “ECONOMIC DEVELOPMENT COMMITTEE”; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS , the City of Coppell has an interest in promoting participation by citizens on boards and commissions; and WHEREAS , the City of Coppell has ordinances establishing and regulating the city boards and commission. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1 . That the City of Coppell, Texas, be and is hereby amending the code of ordinances by amending Chapter 2, Boards and Commissions, Article 2-1 “Library Board” to repeal and replace Section 2-1-4(c) and 2-1-5, which shall hereinafter read as follows: “ARTICLE 2-1. LIBRARY BOARD “….. Sec. 2-1-4. Meetings. ….. C. All meetings require a quorum of five (5) voting members. A voting member is defined as a regular member who has been appointed by Council or by an alternate member who is standing in to constitute a quorum. Youth advisors shall not be voting members of the Board. …..” Page 1 TM 68780 “Sec. 2-1-5. Powers and Duties. The Board shall have the following powers and duties: A. Abide by applicable ordinances of the City of Coppell and follow the rules and regulations prescribed by the City Council for the conduct of its business. B. Adopt bylaws governing board actions, proceedings, and deliberations, subject to approval by the City Council. C. Act in an advisory capacity to the City Council, City Manager and Library Director in matters pertaining to library services. D. Promote library services to the community and cooperate with other governmental agencies and civic groups in the advancement of library services. E. Review and/or recommend policies to govern the operations of the library. F. Assist in interpreting the policies and functions of the Library Department to the public. G. Review the effectiveness of library services with the Library Director. H. Assist in long-range planning and give input for improvement and expansion of library services and facilities and review and make recommendations to the City Council regarding the library’s master and five-year plans. I. Unless deferred, provide annual Library Board reports to the City Council regarding its goals and objectives and its input for future library services.” SECTION 2 . That the City of Coppell, Texas, be and is hereby amending the code of ordinances by amending Chapter 2, Boards and Commissions, Article 2-2 “Parks and Recreation Board,” Section 2-2-2(A) by repealing and replacing with a new Section 2-2-2(A), which shall hereinafter read as follows: “ARTICLE 2-2. PARKS AND RECREATION BOARD” ….. Sec. 2-2-2. Terms; vacancies. Page 2 TM 68780 A.The Board shall be composed of seven (7) regular members appointed by City Council, each of which shall be appointed for two-year staggered terms, four (4) members’ terms expiring in even-numbered years and three (3) members’ terms expiring in the odd-numbered years. Two (2) alternate members shall be appointed for two-year staggered terms, one (1) member’s term expiring in even-numbered years and one (1) member’s term expiring in the odd-numbered years. Each member shall be a qualified voter in the city and shall have been a resident of the City for at least twelve (12) months preceding the date of appointment. Members shall be appointed by the City Council in accordance with the rules and regulations governing Board appointments. …..” SECTION 3. That the City of Coppell, Texas be and is hereby amending Chapter 2, Boards and Commissions, Article 2-3 “Keep Coppell Beautiful” by repealing Article 2-3, in its entirety, and replacing a new Article 2-3; which shall hereinafter read as follows: ARTICLE 2-3. “COPPELL RECREATION DEVELOPMENT CORPORATION” “ Sec. 2-3-1. Creation There is hereby created and established for the city a corporation composed of seven (7) Directors appointed by a majority vote by the City Council for two-year terms. Each member shall be a qualified voter in the city and shall have been a resident of the City for at least twelve (12) months preceding the date of appointment pursuant to its Certificate of Formation and the creation by adoption of the sales tax under Chapter 501 and 505 of the Texas Local Government Code. Sec. 2-3-2. Terms; vacancies Each Director of the Board shall serve a term of two (2) years. Any Director A. may be removed from office by the City Council, at will. B. The Board shall appoint a President and Vice President from its membership. They shall be approved by City Council and shall serve a term of one (1) year. C.An official committee of the Board shall consist of two (2) or more Directors. D.Directors shall not receive any salary or compensation for their services. E.A vacancy in the office of any officer shall be filled by a majority vote of the entire membership of the Board. Page 3 TM 68780 Sec. 2-3-3. Officers A. A vacancy in any position of Director which occurs by reason of death, resignation, disqualification, removal, or otherwise, shall be appointed as prescribed by the city council. B. A vacancy in the office of President and Vice President which occurs by reason of death, resignation, disqualification, removal, or otherwise, shall be appointed by the Board, with approval by the City Council, for the unexpired portion of the term of that office. C. Any Director may resign at any time. Such resignation shall be made in writing, addressed to the Board and the City Manager, and shall take effect at the time specified therein, or if no time is specified, at the time of its receipt by the Board. Sec. 2-3-4. Meetings. A. All meetings and deliberations of the Board, or committees, shall be called, convened, held, and conducted, in accordance with the Texas Open Meetings Act, Chapter 551 of the Texas Local Government Code, as amended. B. The Board shall meet annually each year or an alternate date as determined by the Directors. The Board shall hold regular and special meetings, in the corporate limits of the City, at such place or places as the Board may from time to time determine. Sec. 2-3-2. Powers and Duties. A.The Board shall review a Project(s) approved and adopted by the City Council and determine whether or not the Project(s) are eligible under the approved referendum for formation of the corporation, the Certificate of Formation and the applicable state laws; and whether or not there is eligible funds for said project(s). B. The Board shall approve an annual budget in accordance with these by-laws. C. The Board shall provide an Annual Report to the City Council which shall include, but not be limited to the following: 1) a review of the accomplishment/activities of the Corporation with any proposed changes in these activities; and Page 4 TM 68780 2) the policies, strategies, procedures, and directives followed by the Corporation together with any new or proposed changes in these policies and strategies. SECTION 5. That the City of Coppell, Texas be and is hereby amending Chapter 2, Boards and Commissions, by adding a new Article 2-5 “Economic Development Committee” to read as the following: “ARTICLE 2-5. ECONOMIC DEVELOPMENT COMMITTEE Sec. 2-5-1. Creation There is hereby created and established for the city a committee composed of nine (9) members appointed by a majority vote by the City Council for staggered two-year terms. Each member shall be a qualified voter in the city and shall have been a resident of the City for at least twelve (12) months preceding the date of appointment. Sec. 2-5-2. Terms; vacancies A.Members shall be appointed by the City Council in accordance with the rules and regulations governing Board appointments. Members shall be appointed for two-year terms with four (4) members whose terms expire in the even-number years and five (5) members whose terms expire in odd- number years. The City Council may appoint two (2) alternate members for two-year staggered terms, one (1) member's time expiring in even-numbered years and one (1) member's term expiring in the odd-numbered years. B.In addition, the following may be appointed by City Council as non-voting ex-officio members of the Committee: Two (2) members of the Coppell City Council, two (2) members of the Coppell Chamber of Commerce, and one (1) member of the Coppell Independent School District Board. C.The Coppell City Manager, the Asst. Finance Director, the Economic Development Coordinator and any other appropriate person shall also be non- voting ex officio members of the Committee. Sec. 2-5-3. Officers A.The committee shall annually elect from their membership a chairman and vice-chairman for one-year terms of office, or until their successors are elected. B.In the event of a vacancy in the office of chairman, the vice- chairman shall assume the duties of chairman until the next regular meeting of the committee, at which time the committee shall elect a new Page 5 TM 68780 chairman. C.In the event of a vacancy in the office of vice-chairman, the chairman may appoint a board member to temporarily assume the duties of that office until the next regular meeting, at which time an election will be held to fill any such vacancy. Sec. 2-5-4. Meetings A.Regular monthly meetings of the committee will be held unless otherwise designated. The Committee shall hold such special meetings as shall be called by the Chairperson or upon written request of at least two (2) members of the Committee, at the request of the Coppell City Council or City Manager. B.All meetings require a quorum of members to be present. C.Six members of the committee shall constitute a quorum for the purpose of transaction of business, and no action of the committee shall be valid or binding unless adopted by an affirmative vote of five or more members of the committee unless authorized by the laws of the State of Texas. D.The order of business for each meeting shall be as contained in an agenda prepared by the City Manager, Economic Development Coordinator, and Committee Chairperson. Any committee member may submit items to the Chairperson, City Manager, or Economic Development Coordinator to be considered for the agenda. E.If a committee member is absent for three (3) consecutive regular scheduled meetings, or 25% 12-month period, of the regular scheduled meetings within a said member shall be removed from the Committee, and the City Council will appoint an individual to fill the unexpired term. F.Should any member of the Committee choose to abstain from voting on any question before the Committee, where no declared conflict of interest exists, the abstention shall be recorded as an affirmative vote in favor of the motion pending before the Committee in the official minutes of the City of Coppell. G.All meetings of the committee shall be open to the public unless otherwise permitted by law and shall be subject to the open meetings act. Sec. 2-5-5. Powers and Duties The committee shall have the following powers and perform the following duties: Page 6 TM 68780 Act in an advisory capacity to the City Council in matters that pertain to A. economic development and shall not have any responsibility or authority over the public officials or employees of the city in the area of economic development. In conjunction with city staff, review and make recommendations to the City B. Council regarding applications for tax abatement, sales tax rebate or economic development incentives under § 380.001 of the Tex. Local Govt. Code Monitor incentive programs and policies to ensure the City's competitive C. position in the Metroplex. Review the effectiveness of Coppell Economic Development programs and make appropriate recommendations for improvement or change. Participate in a variety of special projects related to business recruitment, D. retention, and marketing efforts. Receive suggestions and recommendations from citizens relating to E. economic development. Create and stimulate public support for economic development activities F. of the City. Investigate and recommend to the Coppell City Council various methods G. of advertising and promoting the growth and development of Coppell. Recommend to the City Council economic and business development H. priorities on a Citywide basis. Maintain contact with economic development allies in the Metroplex and I. the State of Texas. Visibility for the City will be maintained through attendance at economic development professional association meetings, conference, etc. Insure the maintenance of a statistical database for use in responding to J. economic development inquiries, including an inventory of land sites and available space. Follow the rules and regulations prescribed by the city council for the K. conduct of its business. Adopt by laws, rules and regulations for the governing of their actions, L. proceedings, and deliberations and set the time and place of their meetings, subject to approval by the City Council.” Page 7 TM 68780 SECTION 7. That all ordinances of the City of Coppell in conflict with the provisions of this ordinance be and the same are hereby repealed and all other ordinances of the City of Coppell not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 8. That an offense committed before the effective date of this ordinance is governed by the prior law and the provisions of the Code of Ordinances, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 9. That should any sentence,paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be invalid, illegal or unconstitutional, and shall not affect the validity of the Code of Ordinances as a whole. SECTION 10. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Code of Ordinances of the City of Coppell, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00) for each offense. SECTION 11.
