OR 98-822 Amends City budget for FY 10/1/97 - 9/30/98 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 98822 AN ORDINANCE OF TFIE CITY OF COPPELL, TEXAS, AMENDING ORDINANCE NO. 97808, AS AMENDED, THE ORDINANCE APPROVING AND ADOPTING TF[F, BUDGET FOR TFIE CITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1997, AND ENDING SEPTEMBER 30, 1998 TO ESTABLISH AN INFRASTRUCTURE MAINTENANCE FUND; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WIW~REAS, City Council approved and adopted a budget for the City for the fiscal year beginning October 1, 1997 and ending September 30, 1998; and WBE~S, City Council desires to establish an Infi'astru~re Maintenance Fund (IMF) to be restricted to the maintenance of streets, drainage, water/sewer system reconstruction and public buildings to be funded on an annual basis from the unencumbered fund balances from the general fired and water and sewer fund, NOW TFIF~REFORE, BE IT ORDAINED BY THE CITY COUNCIL OF ~ CITY OF COPPEIJ~, TEXAS: SECTION 1. That Ordinance No. 97808 and the budget for the City beginning October 1, 1997 and ending September 30, 1998 be and the same axe hereby amended to add the following provision to establish an Infrastructure Maintenance Fund (IMF) to read as follows: "Infrastructure Maintenance Fund (IMF): IMF is to be funded on an initial basis by four hundred fifty thousand dollars ($450,000)of the unencumbered fund balances from each of the general fund and the water and sewer fund. °After completion of each fiscal year audit, the City Manager is authorized to transfer one-third (1/3) of the annual operating surpluses, up to a maximum of two hundred thousand dollars ($200,000) from each of the general fund and the water and sewer fund to the IMF provided all required fund balance requirements axe met. No expenditure may be made from the IMF until fiscal year beginning October 1, 2001; and such funds axe restricted to maintenance of streets, drainage, water and sewer reconstruction, and public buildings." SECTION 2. That all ordinances of the City of Coppell in conflict with the provisions of this Ordinance, be, and the same are hereby, repealed and all other provisions of the Ordinances of the City Page - 1 - ss14819 of Coppell including Ordinance No. 97808 as amended, not in conflict with provisions of this Ordinance shall remain in full force and effect. SECTION 3. That should any word, phrase, paragraph, section or phrase of this ordinance or of the Ordinances of the City, as amended hereby, be held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Ordinances as a whole. SECTION 4. That this ordinance shall take effect immediately from and after its passage, as the law and charter in such cases provide.
